'OF THE PLANNING COMMISSION OF THE
CITY OF CHULA VISTA, CALIFORNIA
September 289 1959
An adjourned regular meeting of the Planning Commission of the City of Chula Vista
was held on the above date at 7:30 P.M. in the Council Chamber at Civic Center, with
the following members present: Stevenson, Sparling, Weakland, Stewart, Harmstead and
Adams. Absent: Member Guyer. Also present: Planning Director Fretz, City Attorney
Kugler and Principal Engineer Harshman.
APPROVAL OF MINUTES:
It was moved by Member Sparling9 seconded by Member Harmstead and unanimously carried
that the minutes of the special meeting of September 10 and the regular meeting of
September 14 be approved, copies having been mailed to each member.
REZONING
PUBLIC HERRING - Halecrest Estates Subdivision Zoning
Planning Director Fretz submitted a map showing proposed zoning and reviewed the
original tentative map of Halecrest Estates and the zoning proposed thereon. He
stated that the commercial area on the tentative map was for six or seven acres but
the Hale Company has now requested some 17-20 acres of commercial which has approx-
imately 2,000 feet of frontage on Telegraph Canyon Road.
This being the time and place as advertised, Chairman Stewart opened the hearing.
In answer to an inquiry, Mr. Ralph Lovett, speaking for the subdivider, stated that
the two main streets entering the subdivision from Telegraph Canyon Road have a 10
percent grade and that any access into the shopping area from these streets would
need to be by ramps. He stated there is approximately 45 feet difference in ele-
vation from Telegraph Canyon Road and the next east-west street. He stated that,
since submission of the tentative map, the Hale Company had received inquiries from
concerns desiring more space than would have been available on the original map. He
also gave the net area available for buildings, considering a parking ratio of four
square feet of parking to one square foot of building.
Planning Director Fretz stated that a t-en to twelve acre shopping center would be
considered a second-class center rather than a neighborhood center. He pointed out
that commercial zoning in relatively undeveloped areas should be based upon a market
analysis of the potential and then zoning should be based upon actual needs Mr. Fretz
_said that he has not figured the market potential but that the developer is asking for
18 or 20 acres and evidently this is the ultimate he feels that will be needed. He
added that obviously less than half the need exists at present and recommended that
the commercial zoning reflect this.
Mr. .Lovett stated they would have no objections to eliminating commercial zoning on
the west side of Halecrest Drive. Mr, C. C. Alley stated that he feels 12 acres
would make a nice shopping center in this area.
There being no further comment, the hearing was closed,

RESOLDTION NO. 134 - Recommending Precise R-1, RP-3 and C-1 Zoning for Halecrest
Subdivision
Offered by Member Sparling, passed, adopted and approved by the following vote, to-Wit:
AYES-. Members Sparling, Weakland, Stewart, Harmstead, Adams and Stevenson
NOES: none
ABSENT: Member Guyer
PUBLIC HEARING - Olivewood Acrea Annexation Zoning
Planning Director Fretz submitted a map showing proposed C-1. C-2 and M-1 zoning for
the Olivewood Acres Annexation.
This being the time and place as advertised., Chairman Stewart opened the hearing.
Mr. Vincent DeLucia, owner of property on 30th at Edgemere., stated that he feels the
line dividing the proposed M-1 zone and C-1 zone on 30th should follow the river bed
which is the property line, Member Sparling stated that the channelization of the
river will no doubt necessitate adjustments to the zone boundaries at a later date.
Mr. Fretz added that M-1 property can be developed as C-1, if Mr. DeLucia desires,
the only difference being that the M-1 cannot be developed with any residential use.
Mr. Fretz told the Commission that Mr. Craig Anderson, representing the Trousdale
Company, had told him that they have no objection to the zoning proposal except they
do desire some R -3 zoning across from the sanitarium on Edgemere, He suggested that
since we do not know their request, the matter be left up to the City Council.

RESOLUTION NO. 135 - Recommending Precise Cpl, C-2 and Mil Zoning for Olivewood
Acres Annexation
Offered by Member Adams, passed., adopted and approved by the following vote, to-wit:
AYES: Members Adams, Stevenson, Sparling, Stewart, Harmstead and Weakland
NOES: none
ABSENT: Member Guyer
APPEAL - Denial of Zone Change for 600 Block t'Htt Street .. Jadson, Inco
The report of the findings of the Planning Commission in denying a zone change to
C-2 for property on the north and south side of "H" Street, beginning 600 feet west
of Broadway, was read. Member Sparling stated that he feels the property owners are
,just as entitled to rezoning as that property within 600 feet of the west side of
Broadway, which the Commission recommended to Council. Chairman Stewart stated that
zoning properties that are developed with high-standard residential units to comm-
ercial, is not good zoning practice.
It was moved by Member Stevenson, seconded by Member Adams and carried that the
findings be approved as read and forwarded to City Council with the appeal. Members
Sparling and Harmstead voted "not *
Elmer Sorrenson stated that he realizes that a certain procedure must be followed in
zoning matters. He stated that the original request for zone change had been denied
on the basis that it would be spot zoning and that Jadson was lead to believe that if

the whole area requested commercial zoning, it would be looked upon with favor. He
stated that at the first meeting this present application was considered, it was held
over, but that objections were heard only for zoning of the south side to commercial
and things appeared favorable for commercial zoning for the north side of the street,
Mr. Sorrenson asked if the Commission had any suggestions for development. He stated
that the property is not good for more multiple units in that the area is already
saturated, and that they do not want to leave the land vacant,
Member Adams stated that the south side of t'Htr Street would be entitled to commercial
zoning as much as the.north side, but that he feels neither should be zoned for
business® He stated that every property in the city cannot be zoned in such a way
that it can be developed immediately, Member Stevenson stated that he agrees that the
area is saturated with multiple units, but that the area has sufficient commercial
districts at the present time.
CONDITIONAL USE PERMITS
PUBLIC HEARING - Nancy Fitzpatrick - 430-!�32: 11Ftt Street
The application was read requesting approval of a conditional use permit to allow
operation of a general office in the existing residential buildings on the property
at 430-432 t1Ft' Street.
This being the time and place as advertised, Chairman Stewart opened the hearing,
Mr. Fitzpatrick stated that the area is no longer suitable for residential use and
that the proposed use will not change the appearance of the dwelling unit. He stated
that sidewalk will be installed on the property- when the street widening project is
completed,
Mr, Fretz presented a plot plan showing all of Mr, Fitzpatrick's property and stated
that he feels the use, if granted, should apply only to the two residential buildings,
Mr. Fitzpatrick stated that the request involves only the two dwelling units. He stated
that in the future he intends to develop the lot zoned C-2 with an office building and
off-street parking.
There being no further comment, the hearing was closed.
It was moved by Member Adams and seconded by Member Harmstead that the application of
Nancy Fitzpatrick for conditional use permit to allow operation of a general business
office in the existing residential buildings at 430 and 432 tPt Street be recommended
to City Council for approval, subject to the following conditions;
1. That the character of the buildings remain residential in appearance.
2. That the sign be placed on the building as proposed in application,
3. Off-street parking be provided on site or adjacent to ,the property, as
specified in the application.
Further, that the recommendation be based on the following:
1. The granting of the permit will not be materially detrimental to the public
health, safety or welfare, because the use proposed will not entail any noise,
smoke, odor, dust or vibration; there will be no danger from explosion, con.
tamination or fire; there will be no unusual volume of traffic.

2. The proposed use is compatible with the other uses in the neighborhood,
a fire station, postoffice, Chamber of Commerce across. 1711 Street and a
miniature golf course adjacent on the east.
The motion carried by the following vote, to wit:
AYES: Members Adams, Stevenson, Sparling, Weakland, Stewart and Harmstead
NOES: none

PUBLIC HEARING - Lowell Terry - 600 Block }IFrr Street
The application was read requesting permission to extend the existing Terry Trailer
Park onto property fronting on 'IF" Street. Mr. Fretz presented a vicinity map
showing adjacent streets and property cuts.
This being the time and place as advertised, Chairman Stewart opened the hearing.
It was noted that plans submitted were not adequate to determine access to the
trailer court, parking spaces and location of proposed buildings.
It was moved by Member Sparling, seconded by Member Harmstead and unanimously ,
carried that the hearing be continued to the next meeting so that the applicant
may submit more complete plans for the trailer park and so that a representative
of the owner may be present.
LOGAN SUBDIVISION -• North of t°D'I Street, West of Hilltop
Planning Director Fretz explained that this is not a subdivision as normally under-
stood, He stated that PSr. Logan desires to divide his property into four lots, one
fronting on Hilltop Drive and three fronting on a dedication of a half-street.
It was moved by Member Sparling, seconded by Member Stevenson and unanimously
carried that the proposed division of Mr. Logan1s property, with the dedication
and improvement of a half street as proposed, be approved with the dedication of
a 1 ft. lot along the centerline of the proposed street.
SETBACKS
PUBLIC HEARING - Establishing Setbacks for Newly Zoned Commercial Areas
A. list was read of the streets that have been recently rezoned for commercial de-
velopment upon which setbacks were not changed. It was noted that the Commission
proposed establishing a five foot setback along these streets.
This being the time and place as advertised, Chairman Stewart opened the hearing.
Planning Director Fretz stated that an 80 foot right-of-way with a 64 foot travel®
way would have 13 feet between curb and building line.
There being no further comment, the hearing was closed.
It was moved by Member Stevenson,and seconded by Member Sparling that the Planning
Commission recommend to the City Council that a five foot setback be established
along streets in the newly zoned commercial areas following:

"Et" Street - both sides, from the freeway east to Broadway
"Ft' Street north side, from the freeway east to Broadway
south side, from a point 310 feet west of Fourth to a point
587.5 feet east of Fourth Avenue.
Z-TToodlawn - both sides from t'Ett to "F" Street
Jefferson both sides, from REtt Street to Flower
Fourth Aves- west side, from "F" Street south for 290 feet
Third Ave. - east side, from "Ktt Street south for 1,000 feet
west side, from RKit to "L" Street

STREETS & HIGHWAYS
PUBLIC HEARING - Amendment to Master Plan of Major Streets - "H" Street, East of
Hilltop
Planning Director Fre tz explained the provisions for major streets and highways as shown
on the Master Plan of Major Streets. He then pointed out that this hearing was set by
the Commission to consider amending that portion of the master plan showing "H" Street
extended eastward. He added that soge people evidently feel that the City of Chula
Vista in approving the Pardee-Phillips Subdivision indicated that it is no longer
interested in extending "H" Street eastward. Mr:: Fretz pointed out the extent of the
right-of-way for "H" Street which the county has reserved for street purposes in
considering subdivision maps.
This being the time and place as advertised, Chairman Stewart opened the hearing.
Mr. Charles Butler, owner of property near the intersection of Hilltop and "H" in the
county, opposed the extension of "H" Street, stating that "H" would run very close to
his home and the value of his property would be destroyed. He stated that a quarter
of mile .of homes would back up to the street and it is not needed for access to the
high school and will not be interchanged with the freeway. Mr. Butler added that the
development of a street in this area is very far in the future. He said he doesn't feel
the city is being reasonable in holding up development of the area for so long a time;,
that being on the Master Plan of Major Streets, it holds a cloud over his and other's
properties.
Mr. Lewis Fry, 505 Hilltop, stated that the Toaster Plan of Major Streets provides

for "H" to extend east south of the existing "H" extended and that Pardee-Phillips
Subdivision did not make provision for it. He questioned whether or not this action
actually cancelled "H" on the roaster Plan of Major Streets. He quoted minutes of the
City Council which appeared to indicate that the city's intention was to extend "H"
slightly south of its right-of-way west of Hilltop, in order to avoid existing homes,
Planning Director Fretz stated that a master plan is only general and until a
precise plan is adopted, based on engineering design, the exact location of the street
is not binding. He said that the only may a master plan can be amended is for both
the Planning Commission and the City Council to hold public-hearings and pass reso-
lutions altering the original plan. Mr. . Fretz said that to his knowledge this has
not been done.
Member Weakland stated that he feels "H" Street should have been considered -when
Pardee-Phillips Subdivision was developed and that if it goes east from existing right-
of-way, it will make "through- lots" out of those facing Shasta Street in Pardee-Phillips

Principal Engineer Harsl-man stated that the City Engineer feels the city has
spent a considerable amount of money on improvement of "H" as far east as Third and
that it has a distinct advantage for a through street over "G" or "I" because of its
connection with,Montgomery Freeway.. He stated that there will be a problem in getting
"H" down to the bottom of Rice Canyon, but it is not an insurmountable problem.
Mr. Cyril Woods, 93 East Shasta, stated he feels running "H" through directly
east will work a hardship on Mr. Butler's property as well. as those homes on Shasta,,
He feels that some consideration should be given to providing a street to the east
along the north line of Por. Butler's property. Mr. C. C. Alley presented maps of
a tentative subdivisidn of Dr. Gidding' s property stating that it will be built in
two units, the second unit, abutting "H" extended,being held off for later development.
He stated that he feels it would take at least five years of the city gas tax
money to pay for a span over Rice Canyon. Mr. Alley stated that traffic could be
routed east on a street approximately 200 feet north of "H". Mr. John Malloy, owner
of property near Hilltop and "H", protested the extension of "H", stating that his
home would have to be removed. Member Harmstead. stated that he feels better access
is needed to serve the vast area between Sweetwater Beltline proposed and Telegraph
Canyon Road. Chairman Stewart stated that it has been pointed out the cost of condem-
nation and improvements and also that the area is all in the county and cannot be de-
veloped by the city. He stated that it appears the property owners are not interested
in annexing to the city and that he doesn't feel the city should impose tine provision
of "H" Street on the property owners any longer,
Planning Director Fretz stated that he feels that a decision will have to be
made sooner or later upon an access to the "core" of the .city from the area between
the proposed Sweetwater Beltline and Telegraph Canyon. Chairman Stewart stated that
some time ago a study was made on realigning "E" Street down into Bonita and the
cost was estimated at $150,000 to ;1801000.
Protests to an "H" Street extension were heard from Mr. Jim Dernall and Mr.
E. Digitelli.
Mr. Lewis Fry stated he feels the city will be forced to do somthir_g about
"E" and First because of the interchange at Bonita. He also stated that if "Hit

Street were to be connected with the proposed freeway, it would actually make a
"freeway" right through the center of Chula Vista, creating a by-pass. Member Sparling
stated that he doesn't feel a connection with the freeway is as important asproviding
access to the city from the area east. He stated the area will have to be provided
access to Chula Vista if it is annexed and developed,
Mr. Fretz stated he feels as much study should go into an amendment to a
master plan as went into the initial plan and to date the Planning Department has not
had sufficient time to make such a study. There being no further continent, the hearing
was closed.
Member Weakland moved that the Planning Commission recommend to the City Council
that "H" Street be eliminated from the Master Plan of Major Streets for the reason that
it is not in the city and doesn't appear that it will become a part of the city..
The motion died for lack of a second®
Member Adams stated that he feels we need an extensive study on the matter and
that six months delay will not cause a hardship to the proposed Giddings' development
since they do not intend to develop Unit #2 at the present time, He feels the city
should not abandon "H" Street extension from the plan without an alternate route.
It was moved by Member Sparling and seconded by Member Stevenson that a decision
as to the amendment of the Master Plan of Major Streets to eliminate "H't Street east
of Hilltop be delayed for six months and the matter referred to the Planning Department
for further study as to what should be done for access to the area east of the present
city limits. The motion carried by the following vote, to-wit:
AYES: Members Sparling, Weakland, Harmstead, Adams and Stevenson
NOES: Member Stewart
ABSENT: Member Guyer
CHANGE OF NAME - Jamul Street in Judson Estates #2.
Planning Director Fretz stated that the Fire Chief had requested consideration
of a change of name for Jamul Street in Judson Estates #2 because of the confusion
of numbers. He stated that going cast from the Country Club area, Jamul goes through
several new subdivisions, some of which have been developed and that going south from
the Country Coub Area, Jamul goes through Judson Estates #2 which is presently under
cons truc tion.
It was moved by Elember Sparling, seconded by Member Harmstead and unanimously
carried that the Planning :Commission recommend to theCity Council that Jamul Street be
renamed in the Judson .Estates #2 Subdivision before houses presently under construction
are completed,
C 01,24UNI CATIONS
Reauest for Classification - Kenneth Corley
A letter was read from Mr. Kenneth Corley requesting classification of the
manufacture of concrete block. The property which Mr. Corley proposes to use for
the business is located at 316 "K", an M-1 zone. Mr®..Freta,explained the--ordinance
procedure in classifying uses.. Col. Weisman, owner of the property, appeared and
explained the hardship imposed on him by having his property split between two
radically,different zones, Mr. Fretz submitted a map of the property in question
showing how the zone boundary between M-1 and R-1 divides it.

Mr. Adams stated that the Planning Commission has indicated its desire
to upgrade this M-1 areas as soon as is feasible. Member. Sparling stated that he
feels the described use should be classified as M-2 because of the type of equip-
ment normally associated with this type of business. Mr. Corley stated that their
process cannot be compared to one such as "Hazard Block".. He stated that they
actually manufacture "artificial stone" rather than concrete block and they do not
use heavy machinery. Their equipment will consist of a cement mixer, fork lift, molds
and a vibration machine. Mr. D. S. Bradley, a partner of Mr. Corley, stated that this
is a new company and they are not looking 2or a long-term location at this time. When
the business is large enough for expansion, it will be in another location.
Member Stevenson stated that he feels it is similar to other listed M-1 uses
and is no more objectionable. Mr. Bradley stated their equipment will not be any
larger, nor as noisy as' that presently used in the machine shop.
RESOLUTION NO. 136 - Establishing the Manufacture of Artificial Stone as an M-1 Use
Offered by Member Adams, passed, adopted and approved by the following vote, to
AYES: Membem Adams, Stevenson, Weakland, Stewart and Harmstead
NOES: Member Sparling
ABSENT: Member Guyer
Industrial Park Zoning - Robert Carlin
Mr. Carlin stated that he has acquired M-2 property south of "L" Street, .-west
of Industrial Boulevard and proposes to construct a 100,000 square foot building for `:_ LI
lease. He stated that there are no restrictions in Chula Vista for off-street parking,
planting, adequate setbacks, architeetural,control, etc. in the industrial areas and
feels that desirable industrial development cannot be obtained without them. He sug-
gested that the city consider either adopting restrictions on the existing M-1 and M-2
zones or create another for industry with restrictions. He stated this area can be
developed into a great industrial park and he will go along with any restrictions the
city desires.as long as his neighbors are required to do the same,
The Planning Commission directed that Mr. Fretz confer with Mr. Carlin and report
to the Commissi on.
Improvement of "D", West of Woodlawn - Elmer Sorrenson
Mr. Sorrenson stated that inasmuch as the Planning Commission recommended denial
of a requested vacation of "D" west of Woodlawn and conditioned Bpproval of a trailer
park for Hal Johnson on improvement of "D" Street, he mnuld like consideration of a
reduction in setback along "D". He stated that the ordinance now requires 25 feet
which seems extreme. The Commission stated that action on the setback cannot be taken
without an application being filed.,
MISCELLANEOUS
,Director of Planning Fretz stated that again in October there would be conflict in
meeting dates and asked the Commission to set the meeting dates. The Commission set
October 15 and October 26th as, the meeting dates in October.. City Attorney Kugler
stated that the Commission must soon decide their "regular meeting" date so that it
can be establish d by resolution or ordinance as required,

Discussion of Home Occupation Ordinance
City Attorney Kugler read the proposed definition of "home occupation" and stated
that it was discussed at previous Planning Commission meetings.
It was moved by Member Stevenson, seconded by Member Sparling and unanimously carried
that a public hearing be set on October 15, 1959 for consideration of amending the
Zoning Ordinance to provide for "home occupation".
Amendment to zoning Ordinance - Creating R-1 Districts with Larger Lots
The matter was held over to the October 15th meeting for consideration.
Request for Zone Change
An application was read for change of zone from R-1 to R-3 on the northeast corner
of Third`Lnd ''D". It was moved by Member Sparling, seconded by Member Harmstead and
unanimously carried that the matter be set for hearing on October 26, 1959.
