HomeMy WebLinkAbout1959-11-16 PC MINS MINUTES OF AN ADJOURNED REGULAR MEETING OF THE PLANNING COMMISSION OF THE CITY OF CHULA VISTA, CALIFORNIA November 16, 1959 An adjourned regular meeting of the Planning Commission of the City of Chula Vista was held at 7:30 P.M, on the above date in the Council Chamber at Civic Center with the following members present:. Weakland, Sparlingq Harmstead, Adams and Guyer. Absent: Members .Stewart and Stevenson, Also present: Director of Planning Fretz, City Attorney Kugler and Principal Engineer Harshman, STATKIENT The Secretary of the Planning Commission hereby states that she did post within 24 hours of adjournment, as provided by law, the order of adjournment of the City Planning Commission for the adjourned meeting of November 16, 1959® APPROVAL OF MINUTES: It was moved by Member Harmstead, seconded by Member Guyer and unanimously carried that the minutes of the meeting of November 2, 19599 be approved, with the following change: the addition of the unanimous roll call vote to the action of the Planning Commission on the application for zone variance of D. R. Tyson, rear of property on the southwest corner of Broadway and "J" Street. REZONING PUBLIC HEARING - Northeast Corner Third and I'D" St. - R-1 to R-_3 (continued) Vice-Chairman Sparling reopened the public hearing, Planning Director Fretz submitted a map showing adjacent zoning and stated that a public hearing would be held before the Planning Commission on December 99 19599 for consideration of an application for R-3 zoning on the southeast corner of Third and 11Dtt Street, There being no further comment, the hearing was closed. It was moved by Member Adams and seconded by Member Guyer that the application for rezoning be continued until the meeting of December 7, 1959, at which time a public hearing will be held on the application for rezoning the southeast corner of Third and I'D" Street, The motion carried by the following vote, to fait: AYES: Members Adams, Guyer, Sparling and Harmstead NOES: Member Weakland ABSENT: Members Stewart and Stevenson PUBLIC HEARING - Northeast Corner Third and IliP ­R 1 to C-2 (continued) Vice-Chairman Sparling reopened the public hearing, Planning Director Fretz submitted a plot plan of the property and stated that the owner and lessee had agreed to comm- ercial zoning for the frontage on Thrid and R-3 zoning for the eastern portion of the property. Mr. Carl Jaeger, representative of the lessee, the Shell Oil Company, spoke favoring the rezoning as proposed. Protests to zoning the entire property C-2 were heard from Mr. Ira Skinner, 262 rtY; Mr. Carl DeGaur, 267 "Li1 and Mr. H. E. Sullivan, 256 "Llt. Mr. Sullivan stated that the eastern portion should be rezoned to R-3 for a depth from 11Ler Street equal to the lots fronting on I'Ll'. Mr. DeGaur stated that he feels the R-3 zone should extend to the north property line, forming a buffer between the C-2 and the R-1 homes to the easte There being no further comment, the hearing was closed. RESOLUTION NO. iltl - Recommending Rezoning of Property on the Northeast Corner of Third and RL" from R-1 to R-3 and C-2 Offered by Member Adams, passed, adopted and approved by the following vote, to-�wit: AYES: Members Adams, Guyer, Weakland, Sparling and Harmstead NOES: none ABSENT: Members Stewart and Stevenson PUBLIC HEARING --Pylant Annexations No. 1 and No. 2 - Precise R-2 and R-3 Zoning Planning Director Fretz submitted a map showing proposed zoning and zoning of ad- jacent land. This being the time and place ,as advertised, Vice-Chairman Sparling opened the hearing. Mrs. Ann Te£ft, 1071 Del Max, stated that her lot is large enough for desirable multiple unit development and would prefer R-3 zoning to the proposed R-2. There being no further comment, the hearing was closed. Member Weakland questioned the proposal of zoning the one lot on the east side of Del Mar to R-3 and the rest 'R-2. Planning Director Fretz stated that the lot proposed for R-3 zoning at the north end of Del Mar would act as a buffer between the higher restricted area and the property to the north which could develop into commercial use. .RESOLUTION NO.' 142 - Recommending Precise R-2 and R--3 Zoning for Pylant Annexations No. 1 and No. 2 Offered by Member Guyer, passed, adopted and approved by the following vote, to-wit: AYES: Members Guyer, Weakland, Sparlingl Harmstead and Adams NOES: none ABSENT: Members Stewart and Stevenson PRECISE ZONING - Palomar Annexation Planning Director Fretz submitted a map showing interim zoning of the Palomar Annex- ation. It was moved by Member Harmstead, seconded by Member Guyer and unanimously carried that a public hearing be set for December 7, 1959 for consideration of precise C-2 and R-3 zoning for the Palomar Annexation. REQUEST FOR REZONING - 247 Fifth Avenue - R-1 to R-2 The application was read requesting rezoning from R-1 to R-2 for the property on the northeast corner of Fifth and Davidson, .. 2 ., It was moved by Member Guyer,, seconded by Member Harmstead.and unanimously carried that a public hearing be set for December 7, 1959, for consideration of the application for zone change from R-1 to R-2 at 247 Fifth Avenues VARIANCES PUBLIC HEARING - Clarence Spohr - 228 East James Street ( continued) Vice-Chairman Sparling reopened the hearing. Planning Director Fretz reviewed the matter, stating that Mr. Spohr had constructed a wall within the setback higher than allowed by the ordinance and that the hearing on a variance covering the wall had been continued so that a determination could be made as to how much of the wall could be considered as a retaining wall, He stated that the wall is approximately six feet above grade on the high point side, Mr. Fretz explained that the topography of the adjacent lots is such that needed retaining walls will be higher than Mr, Spohrts wall, There being no further comment' the hearing was closed. It was moved by Member Harmstead and seconded by Member Guyer that the variance be granted to .allow maintenance of a wall over 42 inches in height within the setback along Myra Avenue at 228 East James Street. Further that the action be based on the followings 1. The wall was built over height in error; there are unusual circumstances about the property in that the grade of the adjacent lots is such that needed retaining walls will be higher than Mr. Spohr's wall. 2. The granting of the variance will not be materially detrimental to adjacent property in that the ground level of the property involved is much lower. It will not create a traffic hazard in that the wall is located away from the intersection, The motion carried by the following vote' to-wit: AYES: Members Harmstead, Adams, Guyer., Weakland and Sparling NOES: none ABSENT: Members Stewart and Stevenson PUBLIC HEARING - The Hale Company - Southeast Corner of Broadway and "J"; Southeast Corner of Woodlawn and "H"; West Side of Broadway., 250 South of "I"; Northwest Corner Broadway.and ►'F►' - M-1 Use_ The application was read requesting permission to construct temporary directional signs measuring 10 feet by 30 feet, at the above locations. Planning Director Fretz submitted plot plans of the sites, This being the time and place as advertised' Vice-Chairman Sparling opened the hearing© Member Adams stated that the application does not present evidence that there are special circumstances about the locations for proposed signs as justification for granting a variance. He stated that the granting of such a variance would establish a precedent. 3 i There being no further comment' the hearing was closed* It was moved by Member Adams' seconded by Member Harmstead and unanimously carried that the application .be denied because there are no exceptional circumstances per. taining to the proposed sign locations* PUBLIC HEARING - W. Ray Coyle - L29 Third Avenue - Expansion of C-2 Use The application was read requesting permission to expand a non-conforming use a newspaper, publishing plant - at 429 Third Avenue, a C-l. zone and to allow reduction of rear yard setback from 5 to zero feet. Planning Director Fretz submitted a plot plan showing existing building and proposed additions* This being the tiiae. and place as advertised, Vice-Chairman Sparling opened the hearing. There being no comment, either for or against, the hearing was closed* Planning Director Fretz stated that there is a question as to whether the Planning Commission may grant a variance allowing expansion of a non-conforming use, and suggested that he and the City Attorney be given time to study the matter* It was moved by Member Harmstead, seconded by Member Adams and unanimously carried that the matter be continued to December 7th* PUBLIC HEARING . Max Lassman - 264 Rogan Road - Reduction in Setback Mr. Lassmants application was read requesting a reduction in rear yard setback from 20 to 10 feet for construction of a dwelling. Planning Director Fretz submitted a plot plan of the property showing its irregular shape and steep contour, This being the time and place as advertised, Vice-Chairman Sparling opened the hearing. Protests were heard from Mr. Fred Boach and Mr. John Swift, adjacent property owners. The Commission discussed the possibility of moving the house to the minimum front yard setback, thus allowing a 15 foot rear yard.. There being no further comment, the hearing was closed. It was moved by Member Adams and seconded by Member Guyer that the applicant be granted a reduction in rear yard setback from 20 to 15 feet for the following reasons: p to There are unusual circumstances in that the lot has an irregular shape and steep contour, 2. The variance is necessary for the enjoyment of a substantial property right0 3a The variance will not be materially detrimental to-,adjacent properties. The motion carried by the following vote, to-wit: AYES: Members Adams, Guyer, Weakland, Sparling and Harmstead NOES: none ABSENT: Members Stewart and Stevenson - 4 i SUBDIVISIONS Sweetwater Valley Industrial Park Subdivision a Tentative Map Planning Director Fretz submitted the tentative map of Sweetwater Valley Industrial Park and reviewed the staff's recommendations. He pointed out areas adjacent that the staff- feels should be served by access streets* He stated that he feels we need an industrial park zone which could include provisions for off-street parking, loading and unloading, street width, and setbacks. He stated that without such ordinance requirements, it becomes necessary to require wider street widths. He suggested that the main entrance street from Highland be 100 foot right-of-way and 64 foot improved section . all other streets be 60 foot right-of-way and 48 foot improved section.. It was moved by Member Guyer and seconded by Member Harmstead that the tentative map of Sweetwater Valley Industrial Park be recommended to the City Council subject to the following conditions: la Street widths be as follows: a® The street entering the subdivision from Highland Avenue - 100 foot right-of-way with a 64 foot travel-way. b. All other streets - 60 foot right-of-way with 48 foot travel-way. 2. Provision for extension of two streets to the area south of the subdivision and one additional street. extension to the area north of the subdivisiona 3. Provision of a 20 foot alley to the.rear of the commercially zoned lots* 4. Zero building line on all streets excepting on Highland Avenue, which shall be five foot. 5. Street sections as recommended by the City Engineer* The motion carried by the following vote, to wit: AYES: Members Guyer, Weakland' Sparling' Harmstead and Adams NOES: none ABSENT: Members Stewart and Stevenson CHATEAU HEIGHTS (Formerly Country Club View No, 4) A Final Map Planning Director Fretz submitted the final map of Chateau Heights and reviewed the conditions of the tentative map. It was moved by Member Adams, seconded by Member Guyer and unanimously carried that the Planning Commission recommend the final map of Chateau Heights to the City Council, subject to change of setback around the cul--de-sac from 15 to 10 feete ROBINHOOD NO. 5 - Final Map Planning Director Fretz reviewed the final map of Robinhood No. 5 and read a letter from the Police Chief concerning the lack of a north south street in this area. Mr. Fretz stated that the subdivider had agreed to grade a portion of a future street for his model homes and this will provide the needed north-south route* - 5 � It was moved by Member Harmstead, seconded by Member Adams and unanimously carried that the final map of Robinhood No® 5 be recommended to the City Council, the conditions of the tentative map having been complied with. MONTEBELLO CIRCLE - Tentative Map Mr. Henry Algert submitted a tentative map of a one.-lot subdivision. He explained that it will involve vacation of a,portion of Montebello Street. It was moved by Member Harmstead' seconded by Member Guyer and unanimously carried that the Planning Commission recommend approval of the map and recommend that that portion of Montebello Street dedicated but not used for street purposes be vacated. SETBACKS Setback Along Highland Avenue A letter was read from Mr. Henry Long requesting that the city establish a building line along Highland Avenue, north. of IV' Street. It was moved by Member Harmstead' seconded by Member Guyer and unanimously carried that a hearing be set for December 7, 1959 to consider establishing a 5 foot building line along Highland Avenuee STREETS AND HIGHWAYS Woodlawn South of "L" Street A letter was! read from the Ratner Manufacturing Company requesting the city to abandon Woodlawn Avenue between ''L" and Arizona Streets. It was- moved by Member Guyer, seconded by Member Adams and unanimously carried that abandonment of Wbodlawn Avenue, between „Ll' and Arizona Streets' be recommended to the City Council. MISCELLANEOUS Meetings in December .It was moved by Member Harmstead' seconded by Member Guyer and unanimously carried that the regular meeting for December-be on the 7th and that no adjourned meeting be helde COMM[TNICATIONS Written A letter was read from Mrs, Edna Morrison requesting an extension of time on a variance to allow the division of the rear of their property into building sites. It was moved by Member Adams, seconded by Member Guyer and unanimously carried that the request for extension of time be granted and the variance will now expire on December 153 1960. A. letter was read from Mr. Frank Kinsey, 54 East Shasta, concerning the extension of 6 «, "H" Street, east of Hilltop Drive, and the Commission asked that it be considered when the subject is brought back before the Commission. A copy of a letter from the Police Chief to active subdividers was read informing them that posting of directional signs is a violation of the zoning ordinance and asking their cooperation in keeping violations downm City Attorney Kugler stated that he is of the opinion that the section of the subdivision ordinance requiring alleys at the rear of business lots applies to industrial lots as well as commercial lots. He stated that the Commission must adopt a resolution ren commending to City Council suspension of this provision for the Sweetwater Valley Industrial Park if they do not wish to require the dedication of alleys. RESOLUTION NO. 143 - Recommending to City Council Suspension of Alley Requirement for Industrial Lots in Sweetwater Valley Industrial Park Offered by Member Guyer, passed' adopted and approved by the following vote, to-wit: AYES: Members Guyer, Weakland, Sparling' Harmstead and Adams NOES: None ABSENT: Members Stewart and Stevenson Oral Planning Director Fretz distributed the San Diego County Planning Congress Annual Progress .Report for 1958 and extended an invitation to the Commission to a dinner meeting on December 9, 1959, at the Mission Valley Inn„ Planning Director Fretz submitted a plot plan of proposed commercial development by Dale Horton, on Third Avenue and raised the question of desirability of requiring rear yards in commercial zones. He stated that quite often required rear yards are just waste space in commercial develoQments. Mr. Fretz stated that Mr. Horton would like to know the correct procedure for elimination of the setback. The Commission directed that an ordinance be prepared for the December 7th meeting for consideration of elimination of rear yard setbacks in commercial areas. Planning Director Fretz submitted to the Commission the plan for development of the old library site for adult recreation, as prepared by himself and Mro Jasinek and approved by the City Council.
