PLANNING COMMISSION OF THE
CITY OF CHULA VISTA' CALIFORNIA
December 143 1959
A special meeting of the Planning Commission of the City of Chula Vista was held on
the above date at 4:30 P.M. in the Council Chamber at Civic Center, with the following
members present: Stewart, Sparling, Weakland' Harmstead, Adams and Guyer. Absent:
Member Stevenson. Also present: Director of Planning Fretz and City Attorney Kugler.
VARIANCES
PUBLIC HEARING - Howard and Margaret Bernes 328 Third Avenue and 316 and 318 Center St.
Reduction in Rear Yard Setback
The application was read requesting reduction in rear yard setback from 15 feet to
zero to allow construction of a commercial building with provision for off-street
parking parallel with Center Street. Planning Director Fretz submitted a plot plan
showing proposed construction and zoning of adjacent area.
This-being the time and place as advertised, Chairman Stewart opened the hearing.
Mrs Howard Berns,, applicant, explained to the- Commission that the rear 15 feet,
being landlocked, would be of no use and would, in fact, become a place for litter.._,
to collects Mrs Howe, owner of property on the northeast corner of Third Avenue
and Center Street, asked if Mrs Bernes was building on property that could be used
for parking, Chairman Stewart stated that 'existing ordinances do not require parking
but the applicant has indicated he intends to provide off-street parking as shown on
the plot plan.
There being no further comment, the hearing was closed.
It was moved by Member Sparling and seconded by Member Guyer that the applicant be
granted a reduction in rear yard setback from 15 feet to zero on the property located
at 328 Third Avenue and 316 and 318 Center Street, Further that- the variance expire
one year from date® That the action be based on the following findings of fact:
1, The applicant would suffer a hardship in that he would be losing 15
feet on the southerly side of the property and 15 feet on the westerly
side of the property at Third and. Center.
2. The variance will not be materially detrimental to adjoihing properties.
The motion carried by the following vote,. to-wits.
AYES: Members Sparling, Guyer, Weakland, Stewart, Harmstead and Adams
NOES: none
ABSENT: Member Stevenson
ADJOURNMENT
The meeting adjourned sine die.
