MINUTES OF A MEETING OF THE
CHARTER REVIEW COMMISSION
OF THE CITY OF CHULA VISTA
February 28, 2018 6:00 P.M.
A Special Meeting of the Charter Review Commission of the City of Chula Vista was called to order at 6:00 p.m.
in the Executive Conference Room 103, located at 276 Fourth Avenue, Building A, Chula Vista, California.

PRESENT: Chair Rhamy, Commissioners O’Donnell, Robert Ross, Edgar Hopida, and Bryan Felber
(showed up at 6:41 p.m.)

Manager; Marisa Aguayo, Secretary

Report of subcommittee regarding increasing public outreach/communication and discussion of
future action
Marketing & Communications Manager, Anne Steinberger provided information on the City’s Social Media
and outreach efforts.

1. Approval of November 8, 2017 minutes
ACTION: Commissioner O’Donnell made a motion to approve the November 8, 2017 minutes.
Commissioner Hopida seconded and motion passed as follows:

No: 0

3. Report of subcommittee on concepts for public workshop concerning potential amendments to
Articles III and V and discussion of future action
Chair Rhamy presented two PowerPoints and provided two handouts. Attorney Maland suggested that the
subcommittee prepare draft survey questions to present for Commission consideration at the next meeting,
and then prepare a report to the City Council, in accordance with the Council’s direction to provide bi-
annual reports. Subcommittee to work with Jill Maland and Anne Steinberg on content for survey.
ACTION: Commissioner O’Donnell made a motion that the website content subcommittee, consisting of
Chair Rhamy, and Commissioners O’Donnell and Felber, prepare draft survey content for presentation at
next Commission meeting. Commissioner Hopida seconded and motion passed as follows:

No: 0

4. Discussion of the potential formation of a subcommittee to participate in the consideration of
nominations for vacancies on the Board of Ethics, for referral to, and ratification by, the City
Council
Jill Maland presented. Commission would like additional feedback from the Board of Ethics with respect to
time commitment.

1. STAFF COMMENTS – Maland reminded Commission that there is still one opening available on
Commission. Get the word out.
2. CHAIR’S COMMENTS – Thank you all for attending. Nice work on PowerPoint presentation. You are
awesome.
3. COMMISSIONERS’/BOARD MEMBERS’ COMMENTS – No comment.

Section I.
Term Limits: The Chula Vista City Charter currently allows the Mayor, City Council Members,
and the City Attorney to serve a maximum of (2) consecutive four year terms (Sections 300 and
503). All are permitted to seek nomination and election to the same offices after a one year
period following the end of their second consecutive four year term.

City Attorney: The Chula Vista City Charter currently requires the City Attorney to be elected
from the city at large and requires the individual to be a California resident (Section 503).
1. Are you in favor of the City Attorney being appointed by the Mayor and City Council
Members rather than being elected by the city at large?

2. Are you in favor of requiring the City Attorney to be a Chula Vista resident?

Section III.
Prohibited Acts: The Chula Vista City Charter currently allows for the removal from office of any
City Council Member attempting to unduly influence the City Manager or other appointed
officer, performing administrative or executive functions not authorized by the Charter, and
except for inquiry, not dealing with administrative services for which the City Manager is
responsible, solely through the City Manager (Section 305).
1. Are you in favor of suspending Chula Vista elected officials from their duties without pay
when they are under felony indictment until their case is resolved?

Unconsolidated Special Elections: The Chula Vista City Charter currently allows for the holding
of elections conducted by means of a mailed ballot only, except to elect the Mayor and City
Council Members (Section 902).

Section II.
In accordance with a June 2008 voter approved City Charter amendment, the City Attorney position was
changed from a City Council appointed position to an elected position. Currently, the City Attorney is
required to a resident of the State of California but is not required to be a resident of the City of Chula
Vista. (Section 503).
Of the 482 cities in the State of California, eleven have elected City Attorneys. Of those eleven cities, all
but Chula Vista require the City Attorney to be a resident of the city.
