HomeMy WebLinkAbout1994-09-20 CRC MINS` MINUTES OF A REGULAR MEETING OF THE CHARTER REVIEW COMMITTEE SEPTEMBER 20, 1994 September 20, 1994 Council Conference Room 4: 00 p.m. ------------------------7---------------------------------------- MEMBERS PRESENT: Bob Campbell, Sharon Reid, Jack Blakely Rosie Bystrak and Janet Lawry (arrived at 4: 3'5 p.m. ) MEMBERS ABSENT: Deric Prescott (excused) and Linda Brown (excused) STAFF PRESENT: City Attorney Bruce Boogaard and Mayor Tim Nader The meeting was called to order by Chairperson Campbell at 4: 10 p.m. The roll was called and all members were present except Members Prescott and Brown who were excused due to previous commitments and Member Lawry who would be arriving late because of jury duty. MSUC (Reid/Campbell) to approve the minutes of the July 25, 1994 regular meeting. Chairman Campbell announced that Members Dorso and Fuller would not be returning and that Rosie Bystrak and Linda Brown were appointed to the Commission. MSUC - (Blakely/Reid) to accept the excused absences of Deric Prescott and Linda Brown and the late arrival of Janet Lawry. Member Blakely questioned the fact that Member Dorso was elected as Vice-Chairman at the last meeting and requested that the election of the Vice-Chair be scheduled for a future meeting. Since the proposals to change the Charter will not be voted on by the public until 1996, Chairman Campbell noted the Commission needed to review 16 measures along with the analysis of the City Attorney for each of the items: Charter Review Commission Minutes September 20, 1994 Page Two Measure No. 1 - Mayoral. Salary Adjustments Sharon Reid questioned the wording "grammatically correct" in the ballot label in that she viewed the change as more of a technical change. General discussion ensued by the Commission in regard to the Consumer Price Index and what the intent of the language was insofar as whether or not the Council was allowed to accumulate the increase from year to year, or if they did not take it in any one particular year, would it be lost? Chairman Campbell would like to see the Council address the salary review issue every year as is appropriate in other governmental agencies and the business world. Janet Lawry would find it difficult to give automatic raises, but Chairman Campbell sees merit and value in having an annual review. The difficulty in continuing to attract qualified people to run for the Mayor's office was addressed. Mayor Nader pointed out that he voted against pay raises for the Mayor because (1) of the awareness that constituents have been going without cost of living increases because of the economic times (2) fiscal condition of the City due to the State raiding our funds and (3) the message it sends to employees when they have not been given raises. The Commission noted that their recommendation to the Council had been to tie the Mayor's salary to a certain percentage of the Supervisor's salary, however, the Council in placing the item on the ballot voted to tie the raise to 'the CPI. MSUC (Reid/Blakely) to make the technical correction in the language that it is an annual opportunity which is then lost if not exercised. Member Blakely suggested adding to the Commission's items for consideration the matter of periodic review of the Mayor's base salary. Mayor Nader pointed out the fact that after his term of office expires, the next Mayor will no longer have a vehicle, but will use a pool car. The Commission may wish to consider this when looking at the overall compensation package for the Mayor. Charter Review Commission Minutes September 20, 1994 Page Three MSUC (Reid/Blakely) to amend the minutes of the July 25, 1994 meeting to reflect an "excused" absence for Janet Lawry as she was on vacation at the time. the packets went out and was unaware there was a meeting scheduled. Measure No. 2 - Vice-Mayor to Serve in Event of Death of Mayor. Chairman Campbell asked about the Vice-Mayor serving as Mayor in the event of a serious illness of the Mayor. Attorney Boogaard stated that would be covered under "disability" listed in Section 304 (d) .' MSUC (Reid/Campbell) to clarify the term "disability" in Section 304 (d) to mean one that prevents the execution of the duties of the office. Mr. Boogaard .explained that the Vice-Mayor and Mayor Pro Tempore were actually the same and that the Mayor Pro-Tempore is designated annually by the Council.' .The Commission felt it was confusing to use the two titles and it should be clarified. MSUC (Campbell/Reid) to have the Chairman send a letter to the City Council that public usage of the title Vice-Mayor be changed to Mayor Pro-Tempore in order to be consistent with the Charter which refers to the Mayor Pro-Tempore. Member Blakely suggested another item the Commission_ may wish to consider is a review of campaign contributions for elected officers.
