REGULAR MEETING OF THE CHARTER REVIEW COMMITTEE DECEMBER 19, 1:994- December 994 December 19, 1994 Council Conference Room 4:30 p.m. ----------------------------------------------------------------- MEMBERS PRESENT: Bob Campbell, Sharon Reid, Jack Blakely, Janet Lawry and Deric Prescott .MEMBERS ABSENT: Rosie Bystrak (unexcused) STAFF PRESENT: City Attorney Bruce Boogaard The meeting was called to order by Chairperson Campbell at 4:30 p.m. The roll was called and all members were present except Member Bystrak, who was unexcused. MSUC (Lawry/Reid) to approve the minutes of the November 28, 1994 regular meeting. Chairman Campbell announced the vacancy created by Linda Brown's resignation. Mr. Campbell stated he was talking with Mayor Horton regarding the two follow-up items and would have a report back to the Commission shortly. The Attorney gave a report of a problem created and reported to the City Council immediately prior, ,to the appointment of a successor to the seat vacated by Shirley to The City Attorney announced that he reported to the City. Council the Charter language, as it currently exists,, created the awkward situation. that prevented a known and expected vacancy from being on a convenient and intervening election date because the vacancy had not occurred even though it was known prior to the vacancy, and well in advance of the election, that the seat was going to be vacated by the June election of the Mayor. The City Attorney further reported to the Council that the language of the.Charter only allowed the Council to make the appointment until the Tuesday following the next general "municipal -election, and due to recent Charter changes elongating the period of time.between the date of the general municipal election and the seating date in December, there was a`requirement.in the Charter to have two elections in March, one to fill the vacancy that exists between March and December, and another to fill the seat from December for the, normal succeeding terms to, in this case, December, 2000. The City Attorney further reported that the Council desired the Charter Review Commission to examine the problem and report 'back to the City Council with its analysis and recommendations. _ Charter Review Commission Minutes r' December 19, 1994 Meeting Page Two The City Attorney presented a overhead'diagramming the problem, the matter was deliberated and debated and the Charter Review Commission asked the City Attorney. to prepare some proposed moderating language and to report back when same had been accomplished for the purpose of discussing the matter in further detail at subsequent Charter Review Commission meetings.
