CHARTER REVIEW COMMISSION
FEBRUARY 9, 1995

MEMBERS PRESENT: Bob Campbell, Jack Blakely, Deric
Prescott, Rosie Bystrak, and John Dorso
MEMBERS ABSENT:. Sharon Reid and Janet Lawry
STAFF PRESENT: City Attorney Bruce Boogaard
The meeting -was called to order by Chairman Campbell at 4:40 p.m.
The roll was called and Members Reid and Lawry were absent. MSUC
(Blakely/Dorso) to excuse Sharon Reid due to an out of town
business commitment.and Janet Lawry due to her husband's surgery.
MSUC (Blakely/Dorso) to approve the minutes of January 18, 1995.
Agenda,Item 3 - Further Discussion of Amendment of Specific Run-
off Election Provision.
Jack Blakely noted an article in the newspaper wherein. the City of
Vista was conducting a special election using a private firm rather
than the Registrar of Voters because it was considerably less
expensive. Attorney Boogaard will explore the possibility of using
a private firm and contact.the City Attorney of Vista for further
information.
Attorney. Boogaard. gave a history of the reasons for clarifying
Sections 300 and 303 and walked the Commission through his changes.
Chairman Campbell disliked the language added to the last sentence
regarding ties among candidates as being resolved by'"lot using a
coin selected and tossed by the City Clerk". The consensus was to
change the wording to "by lot.conducted by the City Clerk".
Section 303.A. When a Vacancy Occurs; Granting Permission for
Absences., the City Attorney reviewed the reasons for a vacancy:
(1) four consecutive unexcused absences'(2) conviction of a felony
or crime involving moral turpitude or (3) submitting a letter of
resignation. He suggested changing the last sentence to read:
"The City Council shall declare the existence of any vacancy --or
anticipated vacancy as soon as practicable.
Section 303;.B. Anticipated Vacancies with Intervening Consolidated
Elections; 'Duration of Elected Replacee's Term. The last sentence
will be changed to read: "A person elected in such special

election to fill a vacancy shall serve for the remainder of the
term of the office and until a successor qualifies. The question
was raised as to when the seating date would be after a letter of
resignation was submitted. Attorney Boogaard responded it would be
the date set forth in the letter of resignation and once the City
Council declares a vacancy, the resignation is irrevocable.
Discussion ensued regarding revising the ballot label.and whether
or not to separate the item' in three. ballot measures. It was
determined it was safer to keepthe measure as ohe package because
the possibility exists that one portion would pass and not the
others. However, the City Attorney was requested to switch the
order of (2) and (1) in the label.
Attorney Boogaard proposed adding a new Subsection E. Effective
Date. This ordinance shall take effect immediately upon adoption,
and shall apply, in particular, to eliminate special runoff
election as of the date of the adoption of this measure. He'will
refine this language and bring it back at the -next meeting.
Bruce Boogaard recommended sending this item forward to the City
Council for their input -and review.
Agenda Item 4. Establishment of a budget for Charter Review
Commission.
Secretary Kraker briefly explained the budget process to the
Commission and it was MSUC (Dorso/Blakely) to accept. the proposed
budget of $510. It was noted the Board/Commission ,Handbook
authorizes members to have business cards and name tags. The
members expressed a desire to have business cards .printed. Amended
Motion (Dorso/Blakely) to have a $600 budget. Motion carried
unanimously.
The. Commission decided to have their next meeting on Thursday!
February 23, 1995 at 4:30 p.m.
The meeting adjourned at 5:45 p.m.
