HomeMy WebLinkAbout1995-01-04 CRC MINSMINUTES OF A REGULAR MEETING OF THE CHARTER REVIEW COMMITTEE JANUARY 4, 1995 January 4, 1995 City Attorney's Conference Room 3:00 p:m. MEMBERS PRESENT: Bob Campbell, Sharon Reid, Jack Blakely, Deric Prescott, Rosie Bystrak. and Janet Lawry (arrived 3:25 p.m.) MEMBERS ABSENT: None STAFF PRESENT: City Attorney Bruce Boogaard The meeting was called to order by Chairperson Campbell.at 3.:05 p.m. The roll, was called and all members were. present except Member Lawry, who arrived at 3:25 p.m. The Commission briefly discussed Proposition 183 (Recall Elections. State Officers.) from the November, 1994 ballot, a copy of which was provided in the packet at the request of Commissioner Reid, and it.was determined that the proposition did not deal with a.runoff issue as previously thought. Chairman Campbell reported he had met with Mayor Horton to discuss the Commission's Proposed Measure No. 5 making the second Council secretary an. Unclassified position. Mayor Horton indicated she had no problem with leaving that position in the Classified Service. Mayor Horton stated she had interviewed John Dorso and was recommending him for ratification to the Charter Review Commission. General discussion continued as to how to resolve the situation brought forward by Attorney Boogaard at the 12/19/94 meeting wherein when Councilman Moot's term' is up in March of 1996, whatever candidate chooses to run, he must receive a majority vote or there will need to be a special run off election in November which leaves the period from March to November in limbo. Member Blakely believes there were'two separate problems (1) what do we do for the future and .(2) what do we do in the situation we have now. He felt we have to eliminate runoff elections for special elections. The City Attorney stated that the, Council specifically added that provision regarding the runoff after special elections. Mr. Blakely suggested the wording be changed to say "until a successor is qualified" which.would deal with problem. Sharon Reid pointed out a measure needs to. -be on the 3/96 ballot %perhaps to say whomever gets a plurality could serve the remainder of that term and then the section would be null and void after April 1. Member Reid said that in the City of San Diego, whomever fills an appointed seat cannot run for re-election. Charter Review Commission Minutes January 4, 1995 Page 2 Bob Campbell stated §300, Subsection G, is confusing especially whether or not the term "general municipal election" includes primary elections. Attorney Boogaard clarified it did include all elections. The cost.for a special election is -approximately $120,000, for consolidated election, it's $20,000 and to add a measure onto an existing election is $2,000-$x,000 per measure.. Various suggestions were made by the members including the possibility of sending the. matter back to the City Council and let" them deal with putting it on the 3/96 ballot; letting the present language remain; eliminating the runoff election because it is too costly and have the majority vote getter; be elected. The final consensus was to have the City Attorney draft appropriate language to be brought back at the next meeting. Janet Lawry questioned what the Commission's deadline was on review. of the 18 measures before them, and it was determined the Commission should try and complete their,ieview by June 30, 1995 in order to forward the measures to Council for their review. i The Commission decided to have their next meeting on Wednesday, January 18, 1995 at 4:30 p.m. The meeting adjourned at 4:45 p.m. Lorraine.Kraker_, Secretary C:\crc\minute\1-4-95.min �4�
