CITY OF CHULA VISTA
CHARTER REVIEW COMMISSION
May 19, 1997 City Attorney's Conference Room 4:30 p.m.

MEMBERS PRESENT: John Dorso, Sharon Reid, Jack Blakely,
Rosie Bystrak, Barbara McAllister and Bob
Campbell
MEMBERS ABSENT: Deric Prescott
STAFF PRESENT: City Attorney John M. Kaheny
The meeting was called to order at 4:30 p.m.
1. Roll Call.
The roll was called and all members were present except Member
Prescott.
2. Approval of Minutes.
MSUC (Reid/Blakely) to approve the minutes of March 3, 1997 as
presented.
3. Introduction of New Member Barbara McAllister.
Barbara McAllister was introduced and welcomed by the Commission.
4. Report by City Attorney John M. Kaheny.
John Kaheny included a memo in the packet providing suggested
amendments to Section 308 Place of Meetings in order to make the
term "special meeting" as used in the Charter consistent with that
term as it is defined in Section 54956 of the Government Code (the
Brown Act). MSUC (Reid/Campbell) to approve the amendment as
drafted.
Attorney Kaheny reported he reviewed Measure No. 6 - Control of
Number and Compensation of all Positions by Budget Action of the
Council and finds it needs no further changes.
Mr. Kaheny stated he needed additional time to review Measure Nos..
8-12 and Measure No. 16.
The City Attorney briefly discussed a new case that could affect
cities contracting out for public services.
The secretary was requested to obtain Charters from Escondido, San
Marcos, and San Diego. It was discovered Escondido is not a
Charter city. A copy of San Marcos one-page Charter was included
in the packet. Their Charter was designed primarily to attempt to

stop the state from taking money as a general law city through
subvention formulas.
San Diego's Charter is on file in the Attorney's Library if anyone
wishes to review it. John Kaheny gave a history of their Charter
from its inception in 1927 to the late 1980's when district
elections were added thereby changing the entire structure.
5. Continued Review of Pending Measures.
(Discussed under previous item).
6. Public Comments.
None
7. Member's Comments
Rosie Bystrak announced she is resigning from the Commission due to
a full-time day care business she is operating in her home. She
stated she learned a lot during her service.
Bob Campbell asked if there were projects .where the County and
City overlap in their responsibilities? Attorney Kaheny noted the
800 MHz system. With the adoption of Proposition 218, it was
mentioned at a recent League of California Cities Conference that
welfare reform could have an impact on the cities as more people
are taken off the welfare system.
Barbara McAllister inquired if Proposition 208 would impact Chula
Vista. Attorney Kaheny stated he has an intern presently reviewing
the matter.
8. Adjournment.
MSUC (Reid/Blakely) to adjourn the meeting at 5:05 p.m. to the next
meeting scheduled for June 16, 1997 at 4:30 p.m.
