CITY OF CHULA VISTA
CHARTER REVIEW COMMISSION
March 3, 1997 City Attorney's Conference Room 4:30 p.m.

MEMBERS PRESENT: John Dorso, Sharon Reid, Jack Blakely,
Rosie Bystrak, and Deric Prescott
(arrived at 4:50 p.m. )
MEMBERS ABSENT: Bob Campbell
STAFF PRESENT: City Attorney John M. Kaheny
The meeting was called to order at 4:30 p.m.
1. Roll Call.
The roll was called and all members were present except Member
Campbell who was excused due to illness and Janet Lawry who
resigned today.
2. Approval of Minutes.
MSUC (Reid/Bystrak) to approve the minutes of January 20, 1997 as
presented..
3. Report by City Attorney John M. Kaheny.
John Kaheny distributed a memo providing comments on the measures
outlined in Sections A and B of Glen Googins memorandum of August
19, 1996. The Chair requested the City Attorney to draft language
regarding Measures 2 and 3.
The City Attorney discussed the Council Goal Setting Workshop on
March 1, 1997 wherein Council raised issues relating to the City's
growth. Mr. Kaheny suggested the Commission might want to get
further direction from Council and Chair Dorso stated he would like
to have a joint workshop. After the Commission completes its
consideration of the various measures, it was suggested a packet be
forwarded to Council seeking its priorities. The next election is
November, 1998 for the election of Mayor and two Council seats
which may be a good time to add Charter propositions.
Member Reid requested the Secretary obtain copies of the Charter
from the Cities of Escondido and San Marcos.
4. Continued Review of Pending Measures.
Measure No. 1: Mayoral Salary Adjustment.
Attorney Kaheny noted Mayor does not wish to bring forward the
salary issue. Discussion ensued regarding automatic triggering

mechanisms and accumulation of the increase if not taken in a
particular year.
MSUC (Reid/Blakely) to drop consideration of Measure No. 1. MSUC
(Reid/Blakely) to have an workshop issue dealing with salaries and
it should include salary increases, annual increases and a salary
setting commission.
Measure No. 2 : Duties of the Vice Mayor.
This is a clarifying measure and the word "death" could be added to
Section 303A because neither Section 304 (d) nor Section 303C
specifically address what occurs in the case of the death of the
Mayor.
It was decided the present section could be interpreted to include
"death" and ' in order to avoid additional costs for technical
cleanup, MSUC (Blakely/Reid) to table Measure No. 2 .
Measure No. 3 : Expenditure of Money by Council.
Section 311 prohibits the spending of funds at a special meeting of
the Council as that term is used in Section 308 of the Charter.
The greater difficulty is that the term "special meeting" is
defined differently in §54956 of the Government Code (Brown Act)
than it is in Section 308 of the Charter. The Commission requested
the City Attorney to draft language to have the Charter conform
with the Brown Act.
Measure No. 4 : Duplicative language in Sections 500 and 701.
The Commission agreed there was no contradiction in having the
language in two sections, therefore, it was MSUC (Blakely/Reid) to
table Measure No. 4 .
Measure No. 13 : Term of Youth Commissioners.
Member Prescott stated there was nothing vital from the Youth
Commission.'s standpoint and the members further discussed the ages
of the youths serving and whether there should be an age limit on
a second term appointment. MSUC (Prescott/Reid) to table Measure
No. 13 at the present time, but to put it on a list of workshop
issues.
Measure No. 15 : Role of the Civil Service Commission.
This measure explains the role of the Civil Service Commission and
it was the consensus the measure should go forward.

Measure No. 6: Control of Number and Compensation of all Positions
by budget action of Council.
Attorney Kaheny would like to take a look at this measure and
analyze it further.
Measures Nos. 8-12 : various Changes to the Committee System
John Kaheny advised there can be confusion when you mix advisory
boards and commissions because some are Charter created commissions
and others are established by ordinance. This measure will need
further review.
Measure No. 16: Departmental Trust Funds.
Although the language in Section 1014 appears to be outdated, the
City Attorney would like to investigate the provisions of the
section further because there might be certain accounting
procedures that need to be considered.

MSUC (Blakely/Prescott) to adjourn the meeting at 5:30 p.m. to the
next meeting scheduled for May 19, 1997 at 4:30 p.m.
