APPROVAL OF MINUTES - Hearing no objections, the Minutes of 9/13/95, Regular & S pecial meeting of 9/14/95, Special meeting of 9/27/95 were approved. 4• APPROVAL OF EXAMINATION ANNOUNCEMENTS k 1626 OPEN ADMINISTRATIVE SECRETARY 1625 OPEN SENIOR LIBRARIAN 1629 OPEN COMMUNICATIONS OPERATOR I MSC (DAVIDITURNER) 5-0 to approve the Examination Announcements. 5. APPROVAL OF ELIGIBLE LIST UC270 OPEN SENIOR LIBRARIAN (PT) 1621 OPEN SECRETARY i 1624 PROM POLICE SERGEANT 1626 OPEN ADMINISTRATIVE SECRETARY MSC (DAVID/MONAGHAN) 5-0 to approve the Eligible's List. 6. NEW BUSINESS - a. Request for Extension of Probation Period for Tina Tumeo - Administrative Secretary until September 28, 1995. Chair Villa requested that Ms. Emerson better explain the procedures of this termination. Specifically, why did the department extend the probation period. MSC (VILLAIDAVID) 5-0 Commission would like, information as to the rational for the 3 -day extend considering current Civil Services rules provides that notice is required. b. Request for an Exceptional Merit Increase for Jennifer Blocker, Custodian from Step B to Step C effective October 13, 1995. Item Pulled C. Fitness for Duty Physicians List - Update MSC (MONAGHANIDAVID) 5-0 to approve the Fitness for Duty Physicians List. 7. OTHER BUSINESS - Items were taken out of order. The entire discussion is on tape (dated 11/9/95) for review. Commission called a recess to try to contact Ms. Smith to include her in this discussion. ;f The Commission reconvened at 6:00 p.m. Chair Villa requested that Item 7b. be considered first. Mr.Turner abstained from this discussion and decision. is b. Letter of Request for Reconsideration. The Letter of Request for Reconsideration was discussed and all documentation was reviewed. The Commission took into consideration the information and recommendation of Counsel (Ms. Smith). Mr. Monaghan motioned that the request for reconsideration be denied. Mr. Winters seconded for discussion. Mr. Winters stated that he would not vote on this motion considering the that issue of conflict has to do with him. Ms. David would that the Commission should vote to re -open the appeal. Mr. Villa is comfortable with the outcome of the appeal and stated that it should not be reconsidered. Mr. Winters requested to abstain from this motion. MSC (MONAGHANMLLA) 2-1-1 Motion to deny the Request for Reconsideration. (David -no; Winters -abstaining) a. Appeal Decision - Final Findings The Commission announces it's decision as follows: The Civil Service Commission considered testimony and evidence presented by Thomas A. Brown and his Attorney during the appeal hearing. After careful consideration, the information presented and evaluated was not sufficient to mitigate the behavior of Brown. The Civil Service Commission determined the information presented and the Appellant's behavior was not sufficient to uphold the City's recommendation for termination. The appeal of termination by Thomas A. Brown is granted. Instead, the Commission finds the appropriate discipline to be a six (6) month suspension without pay commencing June 2, 1995 through December 2, 1995. This decision was made by the following vote of the Commission: Commissioner Villa Yes Commissioner Winters Yes Commissioner Monaghan Yes Commissioner David No The Commission now will go into Close Session to hear the Appeal by a City Employee. Mr. Monaghan would like to be excused from this appeal. Roll Call - Present: Villa, David, Winters, Turner with Monaghan excused. Chair Villa asked employee if the appeal would be a closed or open hearing. Employee requested that it be open. Appeal was recorded by a court reporter.
