MEETING CALL TO ORDER 5:20 p.m. 2. MEMBERS PRESENT Commissioners Turner P , David P , Monaghan E Noble P Chidester P MSC (DAVID/NOBLE) 4-0 to approve roll call. 3. APPROVAL OF MINUTES - Hearing no objections, the Minutes of June 11, 1998 were approved. MSC (DAVID/NOBLE) 4 -0 to approve the Minutes of June 11, 1998 4. APPROVAL OF EXAMINATION ANNOUNCEMENTS 8698 Open Administrative Office Assistant III 9898 Open Confidential Secretary MSC (DAVID/NOBLE) 4-0 To approve the Examination Announcements. 5. APPROVAL OF ELIGIBLE LIST 6098 Prom Parks Supervisor 7590 Open Principal Community Development Specialist MSC (DAVID/NOBLE) 4-0 To approve the Eligible List. 6. NEW BUSINESS - A. Memo requesting to approve time served in a temporary capacity toward probationary period submitted by Melody Kessler, Assistant Director of Human Resources. Commissioner Chidester moves that Item 6A to be approved. MSC(CHIDESTER/DAVID) 4-0 to approve the request to incorporate time served in a temporary capacity toward employees probationary period. B. Request for Double Merit Increase from Step "D" to Step "E" for John Llamas, Senior Maintenance Worker submitted by Bill Ullrich, Senior Civil Engineer/Public Works Maintenance. 4-0 to approve the request for a Double Merit Increase from Step "D" to "E" for John Llamas, Senior Maintenance Worker effective July 17, 1998. C. Appeal of Examination process of Senior Gardener. This item was tabled until the next regular meeting of the Civil Service Commission in August for the final findings of the complaint. 7. OTHER BUSINESS - 8. COMMUNICATIONS A. Chair's Comments The issue of delegating the authority from the Commission to someone within the city was discussed. This will allow placement of additional names on the Physician List in an urgent situation. The designee can then bring the changes to the Commission after the fact for confirmation by the Commission. Chair Turner asked what is the procedure to amend this process or change the Civil Service rule. Melody Kessler stated that the Human Resources Department will initiate a letter via the City Attorney's office for the Commission to review and approve. B. Commissioners' Comments C. Staff Comments D. Public Comments ADJOURNMENT - Motioned to adjourn to the Special meeting immediately following to hear an employee's appeal of discipline. Appeal Hearing of City Employe (CSC.015) -Closed The Civil Service Commission heard testimony and examined the evidence offered by the parties. Melody Kessler stated that the appellant is not appealing the discipline but is appealing the level of discipline he received. This is an informal process and the appellant wished to represent himself. Mr. Byers and Mr. Ullrich are available for any questions regarding the discipline. Chair Turner asked the appellant if he would like the hearing closed or open to the public. Appellant requested that it be closed. The appellant stated the reason for the discipline. The discipline issued was a 30 day suspension without pay and a demotion in rank. The appellant stated that miscommunication between himself and his counselor resulted in noncompliance with the program. This incident resulted in the appellant assigned to a different counselor and he (appellant) was brought back to compliance. During this time, an additional 30 days passed that the appellant was not able to return to work. The appellant stated that the additional 30 days were a hardship on him and his family. The appellant felt that the demotion from his previous job was excessive. He stated that he received good evaluations and that his problem did not effect his ability to do his job. He also stated that he worked very hard for his previous position and has complied and continues to comply with the program mandated by the City. The appellant is requesting that he be reinstated to this former position. Commissioners asked several more questions pertaining to work performance, attendance, work history and salary levels. After final testimony, Tamara Smith, Counsel for the Commission stated that the process for decision would be the same as a regular hearing. The Commission met in a closed session to deliberate. The final findings will be submitted in writing within 10 days to the appellant. This meeting was recorded. IV. Adjournment - To the next regular meeting of the Civil Service Commission meeting on August 13, 1998 at 5:15 p.m., at City Hall, 276 Fourth Avenue, Chula Vista, CA 91910. Anna Kemery, Secretary 8/3/98
