I. Call Meetinq To Order

III. Appeal Hearing of City Employee (CSC.021)
The Civil Service Commission heard testimony and examined the evidence offered by the parties. The Appellant does
admit that he did work in a trench without proper shoring and that he instructed another employee to assist him. The
Appellant stated his actions were not proper and that it would not happen again. The Appellant is appealing the
degree of discipline imposed as oppose to another similar type of incident in the department.
is The department's position is, since the prior incident, a Safety Manager has been hire, training specifically on trench
shoring has been conducted, specific guidelines have been communicated to employees, and a very strong emphasis
on safety in trench shoring has been a key issue. The department believes that a one -day suspension was warranted
considering the severity of the action, the fact that another employee was instructed to go into the trench while it was
unshored, and amount of training this employee has received.
The Appellant stated that the other emplgyee did have prior training and was given a written warning. The Appellant
feels that the one -day suspension was tl harsh considering this was his first offensive. The Appellant also stated that
he made a mistake and that it would not happen again.
The Commission continued to ask questions of the Appellant, the Department representative, and the Human
Resources Director regarding current procedures and the amount of training in the Public Works department.
After the Appellant agreed to be notified by mail of the decision, the Appellant was excused and the cause was
submitted for decision. The final findings will be submitted in writing within 10 days to the Appellant.
The Commission adjourned to a Close Hearing for deliberations.
