MEETING CALL TO ORDER 5:15 p.m. 2. MEMBERS PRESENT Commissioners Veal P , Triplette E , Chidester P , Silva P , Saucedo P . Commissioner Saucedo arrived a few minutes late. 3. APPROVAL OF MINUTES - The Minutes of the regular meeting of July 10, 2003 were approved Request to take Item 7 a. out of order. Commissioners agree to hear item�7 a. A. Training Session —Review of Appeal Process for Commissioners. Sharon Marshall, Assistant City Attorney conducted the workshop. Items discussed were: Modifying Discipline and Lying Issues. On the subject of modifying discipline, Ms. Marshall, Assistant City Attorney stated that the Commission has the authority to increase or decrease the level of discipline except for changing the type of discipline. Commissioner Veal asked if it was appropriate to go into closed session during an appeal process. Assistant City Attorney Marshall stated that it is appropriate to go into closed session as part of the deliberative process. Commissioner Veal asked if the City carried Professional Liability Insurance in case the members were sued in their professional capacity. Assistant City Attorney Marshall replied that the members would be indemnify and defended by the . City assuming what they were doing was in the scope and course of their authority. Assistant City Attorney Marshall also discussed the subject of lying and the level of discipline issued to employees of the Police Department compared to other departments. She stated that the reason it is important for Police Officers to be honest in the course of their work is due to two main functions which Police Officers perform, which are arresting people and serving as witnesses. Creditability issue can also be discovered in court. Further discussion continued on this subject with case citing that discussed the subject on general terms. Commissioner Veal suggested that integrity issues training be provided to newly appointed members of the commission since this subject is a distinguishing,aspect of employment for law enforcement. Chair Veal thanked Ms. Marshall for her edification. 4. APPROVAL OF ELIGIBLE LIST 1103-085 Promotional Lead Communications Operator 03-104 Open Land Surveyor 03-112 Promotional Sr. Business License Representative • MSC (CHIDESTERISAUCEDO) 4-0 To approve the Eligible List. (TRIPLETTE EXCUSE) 6. NEW BUSINESS - A. Update: Appeal of Discipline by City Employee (CSC.021) Closed Ms. Raskin, Director of Human Resources confirmed that dates and times of the appeal hearing. B. Election of New Chair and Vice -Chair Commissioner Chidester asked to tabled the election until the next meeting. Motion by Commissioner Silva to have the Chair and Vice Chair remain the same until the next meeting. MSC (SILVAISAUCEDO) 4-0 To continue with the current members as Chair and Vice Chair until the next meeting. 4-0 (Triplette Excused) C. Brochures and Weekly Communique The information provide includes the Volunteer Newsletter, City News brochure and copies of the Weekly communique sent to all employee. General discussed followed and Commissioners thanked staff for the information. 7. OTHER BUSINESS - Item 7a was taken out of order. 8. COMMUNICATIONS A. Chair's Comments — None B. Commissioners' Comments - None C. Staff Comments — Marcia Raskin, Director of Human Resources announced that another appeal has been submitted. Staff will calendar this . appeal as soon as possible. Chair Veal asked if in the course of a hearing, could Commission members ask if attempts have been made to reach a settlement agreement prior to the appeal. Chair Veal stated that he could not recollect the answer. He asked if any members could recall that issue. No comments by the members. Chair Veal asked to have Counsel response to whether it was appropriate for the Commission to inquire, in the course of a hearing, as to whether an attempt had been made to settle the matter. Marcia Raskin, Director of Human Resources will follow up on the request. D. Public Comments - None g.
