MEETING CALL TO ORDER 5:15 p.m. 2. MEMBERS PRESENT Commissioners Veal P , Triplette P , Chidester P , Silva P ., Saucedo _P 3. APPROVAL OF MINUTES - The Minutes of the regular meeting of August 14th and September 11, 2003 were submitted for approval. MSC (SILVAISAUCEDO) 4.1 (TRIPLETTE ABSTAINED) - To approve the minutes as.submitted. 4. APPROVAL OF EXAMINATIOWANNOUNCEMENTS 03-196 Promotional, Engineering Technician 1/11 03-200 Open Plumber MSC (CHIDESTERITRIPLETTE) 5- 0 To approve the Examination Announcements. 5. NEW BUSINESS - A. Request to cancel November's regular meeting. Marcia Raskin, Director of Human Resources asked to postpone the November meeting. Staff will be attending the Calpelra Annual Conference in November. MSC (SILVAITRIPLETTE) 5-0 To postpone the November meeting until December. 7. OTHER BUSINESS - A. City Communication Brochures and Announcements. Information has been submitted for review. No comments. B. Staffing Reports. 0 Information has been submitted for review. No comments e .- `�• It.8. COMMUNICATIONS A. Chair's Comments is Chair Veal expressed his gratitude on his re-election as Chair. Chair Veal shared items discussed in his meeting with the Mayor. Chair Veal conveyed to the Mayor that the City is fortunate to have qualified members on this Commission. Chair Veal recommended that future members have experience in labor management relation issues since some items presented to the Commission are complex. Chair Veal also explained to the Mayor that the commission is not a rubber stamp commission and feels that the members deal with professionals in the Human Resources department as well as with department heads. Chair Veal asked, in the course of a hearing, whether it was proper for the Commission to inquire if attempts were made for a settlement. Sharon Marshal, Assistant City Attorney replied that it was not appropriate to discuss settlement negotiations prior to hearing an appeal because it may impact how the commission views the appeal. Commissioners C)hidester stated that his experience was to try to settle at every level. Sharon Marshal, Assistant City Attorney replied that the main purpose of the Skelly hearing is to give the employee and his or her representative the opportunity to try to reach a settlement. Once the issue comes before the commission it means that the department has made a decision that they cannot agree to anything less then what has been recommended. Commissioner Chidester asked that they try to get to the bottom of it before it comes to the Commission. Sharon Marshal, Assistant City Attorney replied that the Attorney's Office always listens to mitigating circumstances and is discussed with Ms. Raskin, Director of Human Resources. B. Commissioners' Comments None • C. Staff Comments Marcia Raskin explained why the pending hearing was cancelled at the last minute. Ms. Raskin explained that the City and the employee's Attorney reached a decision to allow the employee to return to work with a 4 -month suspension and a Last Chance Agreement. D.
