6. NEW BUSINESS -
A. Adopt the Resolution to Change the day of the Regular Meetings of the Civil Service Commission from the second
Thursday of the month to the first Thursday of the month effective after adoption by the Civil Service Commission.
Chair Silva moved.to approve the'Resolution to change the meeting day of the Civil Service Commission to the first
Thursday of the month.

B. Fitness for Duty Physicians List - Update
MSC (STEVENSON/SILVA) 3-0 To approve the Fitness for Duty Physician List. (SAUCEDO/FLOROS
EXCUSED)
C. Appeal of Termination. (CSC.039)
Marcia Raskin, Director of Human Resources stated that City and the Appellant are working to resolve the issue that would
benefit both parties. Ms. Raskin stated that if staff does not contact the commission for available dates, the appeal has
been withdrawn. 3
7. OTHER BUSINESS -
A. Request for Exceptional Merit Increase for Elizabeth Aguilar, Accounting Assistant, submitted by
Maria Kachadoorian, Director of Finance.
Marcia Raskin, Director of Human Resources explained that no representative from the Department
is present. Ms. Raskin stated that the Commission could review the item and make a decision based
on the written submittal.
Chair Silva stated that he has read'the information and asked to approve the request.

Perry, Fire Chief.
0 C. Request for Exceptional Merit Increase for Ray Smith, Fire Engineer, submitted by Doug Perry,
Fire Chief.
Items B & C were taken out of order.
Doug Perry, Fire Chief stated that both individuals are special. He added that Mr. Czapinski has a wealth
of experience in wild land firefighting that is beneficial to the fire department in handling the eastern portion
of our city. Mr. Czapinski has formal training in this area and is assisting in training other fire staff. Chief
Perry said that he exemplifies what a firefighter should be.
Doug Perry, Fire Chief stated that Ray Smith has promoted very quickly in the organization. Mr. Smith has
expertise in Rapid Intervention Crew, which is a safety team whose sole responsibility is to rescue
firefighters during a fire. Mr. Smith also has experience in teaching auto extraction to the fire employees.
Doug Perry, Fire Chief concurs with his staff to approve the merit increases for both individuals.

C. Staff Comments
Marcia Raskin, Director of Human Resources provided a letter from a City Employee in regards to
internal testing process of the Police Department. Ms. Raskin stated that she has met with the
Attorney's Office and the Police Department and made a determination that there will be an internal
investigation conducted.
Commission Stevenson asked if the Commission would receive a report on the findings.
Marcia Raskin, Director of Human Resources stated the Police Department has the responsibility to
report back to the Commission.
Chair Silva stated that the allegations are very serious and asked if the Department will be conducting
an investigation.
Marcia Raskin reported yes.
Chair Silva asked'if they would be able to report back to the Commission.
Marcia Raskin, Director of Human Resources will check with the Attorney's Office to see if an internal
investigation by the Police Department results can be reported to the Commission.
Chair Silva asked if an Eligibility List from these interviews have been reviewed by the Commission.
Marcia Raskin, Director of Human Resources reported that yes, an Eligibility List has been created
and was not sure if the list has been provided to the Commission. On viewing the current agenda, the
list has been provided in the packet.
Time was taken to review the list.
Marcia Raskin, Director of Human Resources stated that it might have already been completed.
Discussion continued on the promulgation of the list.
Chair Silva asked when does the department expect to promote from the list.
Marcia Raskin, Director stated that the department may have already completed that process.
Commissioner Stevenson asked what would happen if for some reason the Commission did not
approve a list.
Marcia Raskin, Director of Human Resources stated that the Human Resources would need to
defend the testing process to the Commission. The issue submitted is not challenging Human
Resources process but comments made before or after the Agents process.
Chair Silva asked if its the oral interview.
Marcia Raskin, Director of Human Resources stated that it was the Internal Promotability Board
where her peers are interviewing the individuals.
Commissioner Marrufo asked if the allegations are found to be true, what does the HR do to remedy
the situation so that the employee can have a fair chance.
Marcia Raskin, Director of Human Resources stated that in general, if some in-house process
violated somebody's rights or due -process, the Human Resources could come back and make the list
null and void. Ms. Raskin stated that she would confer with the Attorney's Office. Ms. Raskin
mentioned that the Department has utilized the list.

stated that if an employee goes through the process and the interviewers have already made up their
mind of whether of not they will make it (on the list) then that's a problem. If the allegations in the
letter are true, it raises issues of the validity of the list. Chair Silva asked if there were any comments.
Marcia Raskin, Director of Human Resources stated that employees can come forward anytime and
claim some concerns that may or may not result in an eligibility list needing to be not validated, not
approved by the Commission.' It would slow the process if the candidates knew that they could
complain about some stuff aiong the way that may or may not have any foundation. In the future,
could prevent a list being approved and people being promoted. Ms. Raskin said that her preference
would be to allow the approval of the Eligibility List to stand and if the findings come back to approach
the Eligibility List at that time. Ms. Raskin feels that the list is not invalid but that an individual has
some concerns with her peers and people within the Police Department and comments made to her.
I asked that the Commission allow the Department to proceed with the valid testing process and let
the promotion stand and if there is some foundation to her complaint come back and handle it at that
time.
Commissioner Marrufo asked what recourse does the employee have.
Marcia Raskin, Director of Human Resources stated the department has proceeded to notify the
Police Department and the Attorney's Office regarding this issue and has started an investigation.
Ms. Raskin didn't believe this issue needed to be submitted to the Commission to make a decision to
not valid the Eligibility List. Ms. Raskin stated that most complaints do not rise to the level for the
Commission to review. Ms. Raskin stated that the individual is not challenging the process, but the
comments make to her.
Commissioner Stevenson stated that she has seen both sides and she also recognize that if there is
cause findings that there are ways to remedy that individual if warranted. Ms. Stevenson is
comfortable with moving forward with the list but would, if possible, see the findings of the
investigation. She feels that there might be some additional follow up by the Commission. Ms.
Stevenson also stated that staff needs to communicate back to the employee that the letter was
received.
Chair Silva feels that the issue was against the employee but does not want to take away from the
other employees that tested. Mr. Silva stated that he would like a motion to get a report regarding the
investigation at the next schedule meeting and that the employee be invited to attend. Mr. Silva also
stated that the commission could ask the City Attorney's office what options the Commission has from
the Commission's level.
Marcia Raskin, Director of Human Resources stated that the employee has been notified that her
letter will be forward to the Civil Service Commission and that her complaint, will be investigated.
Chair Silva motioned that regarding the complaint, that the Commission be provided a report of any
findings and if they cannot report back to the Commission, he asked for reasons why they cannot.
Also, that the employee be given notice that her complaint will be discussed at the next regular
meeting.

the investigation and if that is not possible, the reasons why it cannot be provided. Also, that the
employee be notified that her complaint will be discussed at the next regular meeting.

9. ADJOURNMENT—To adjourn to the next regular meeting of the Commission scheduled on January
