RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA APPROVING A CONTRACT WITH MURRAY
ALLISON & ASSOCIATES FOR THE APPRAISAL OF
PROPERTY LOCATED AT 281 AND 285 LANDIS AVENUE
AND APPROPRIATING FUNDS THEREFOR
The City Council of the City of Chula Vista does hereby resolve as
fol 1 ows:
WHEREAS, the Town Centre Project Area Committee has determined that
it is necessary to provide more off-street parking places for shoppers and
employees in the downtown area; and,
WHEREAS, in order to provide more off-street parking spaces it is
necessary to acquire additional parcels for conversion to off-street parking
lots within the Downtown Parking District; and,
WHEREAS, the parcels located at 281 and 285 Landis Avenue have been
identified as potential acquisition sites for additional parking; and,
WHEREAS, the Town Centre Project Area Committee has requested that
the City Council authorize appraisals for these two properties; and,
WHEREAS, Murray Allison & Associates has proposed to appraise the
subject parcels for a sum not to exceed $1,125; and,
WHEREAS, Murray Allison & Associates is qualified to appraise the
subject properties.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Chula Vista that a contract with Murray Allison & Associates for the appraisal
of properties located at 281 and 285 Landis Avenue for the sum not to exceed
$1,125, attached hereto and incorporated herein as though fully set forth, is
hereby approved.
BE IT FURTHER RESOLVED that funds are hereby appropriated from the
unappropriated reserve of the Parking Meter Fund and transferred to Account
600-6000-PM03 (Capital Improvements Fund).
BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista is
hereby authorized to execute said agreement on behalf of the City.

PURPOSE OF THE APPRAISAL

In return for said services and appraisal report, employer hereby agrees to compensate appraiser at the rate of $ _7 5 o 0 0 per hour
payable as follows: $ -- '~ ~ upon the signing of this agreement and the balance upon completion of said report
Should additional services of the appraiser be requested by the employer, his agent, his attorney, or the court, such as pretrial conferences, court appear-
ances, court preparation, etc., the employer agrees to compensate the appraiser at the rate of $ 250 . 00
day or any part of provided such additional services are performed within one year after delivery of said report, n the event that such services shall be required
more than one year after delivery of said report, the compensation shal~ be the customary rate charged by the appraiser as of that date.
The cost of preparing exhibits for court, photo enlargements, maps, etc., shall be borne by the employer, and the appraiser shall, in addition to his
compensation, be reimbursed by the employer for such cost advanced by the appraiser.
Payment for such additional services shall become due upon receipt of statement rendered by the appraiser
It is further understood and agreed that if any portion of the above compensation or costs due to the appraiser become delinquent, the employer agrees to pay
interest at the rate of 18% XXX~ % per annum on said account from the due date until paid, and any controversy or claim out of or relating
to this contract, or the breach thereof, shall be settled by arbitration in accordance with the Ru~es of the American Arbitration Association, and judgment upon
the award rendered by the Arbitrator(s) may be entered in any Court having jurisdiction thereof and further agrees to pay all costs of collection thereof,
including reasonable attorney's fees, court costs, etc
In the event that em ployer desires to cancel this au ho ization, written notice thereof shall be delivered to the appraiser, and it is agreed that the appraiser shall
receive compensation from the employer for all services rendered at the rate of $ _ 7 5 . 0 0
per hour for the time actually spent
prior to receipt of written notice to stop work, plus all costs advanced in connection with said appraisal prior to receipt of such written notice.
