Motion carried. PLEDGE OF ALLEGIANCE/SILENT PRAYER INTRODUCTORY REMARKS: Read into the record by Chair Davis APPROVAL OF MINUTES: May 6 and May 13, 1998 MSC (Ray/Thomas) (4-0-1-2) to approve minutes of May 6 with correction that the motion to excuse absent members reflect that Commissioner Ray was present. Motion carried with Commissioners Tarantino and O'Neill abstaining. MSC (Ray/Thomas) (6-0-1) to approve minutes of May 13 as submitted. Motion carried. ORAL (:OMMUNICATIONS: None PUBLIC HEARING'. PCM 98-29; Amendment to the Rancho del Rey Specific Planning Area I Plan to change the General Development Plan from SFD to CF; the Site Utilization Plan from R-4 to CF-4; and the Land Use District Map from RS to CPF for the parcel located at 1256 Camino Catalonia in order to provide preschool care services in the existing house - First United Methodist Church of Chula Vista. Due to issues related to SPA Plan conformance and a recently enacted amendment to CPF land uses, staff recommends that this item be continued to July 8, 1998. Planning Commission Minutes - 2 - Wednesday, June 24, 1998 MSC (Ray/Thomas) (6-0-1) to continue public hearing to July, 1998. Motion carried. o PUBLIC HEARING: PCZ 98-01; request to rezone from R1 (Residential Single Family) to CT (Commercial Thoroughfare) to bring the property located at 619 East Manor Drive, into conformance with Zoning Ordinance prior to the processing of Adiustment Plat No. 97-08. Background: Maria Muett, Assistant Planner, reported that the applicant submitted a lot line adjustment application, and after review, staff recommended that the applicant apply for a rezone from R-1 to CT to bring this property into conformance with the zoning ordinance. The property was zoned R-1 until 1989 when it was split zoned as R-1 along East Manor Drive and CT on the Broadway frontage. The land use has for many years been a combination parking lot for Discount Tires at the corner of Broadway Avenue and I Street as well as a single family residence, which faces East Manor Drive, with approximately 80% of the parcel being in the R-1 zone and the remainder in the CT zone. Staff Recommendation: That the Planning Commission adopt Resolution PCZ-98-01 recommending that the City Council approve the rezoning in accordance with the draft City Council Ordinance. Public Hearing Opened 7:14 Don Baker, 837 East J Street, representing applicant stated he was there to answer any questions. Commissioner Thomas asked if there was any indication that there might be a change in land use from Discount Tires to another commercial use. The representative responded that he had no knowledge of change in land use. Public Hearing Closed 7:17 MSC (Ra¥/Willett) (5-0-1-1) to adopt Resolution PCZ 98-01 recommending the City Council approve the rezoning in accordance with the draft City Council Ordinance. Motion carried. Planning Commission Minutes - 3 - Wednesday, June 24, 1998 PUBLIC HEARING: PCA-98-06; application to amend Chula Vista Municipal Code Section 19.62.100 to change "Temporary" parking from 6 months to 12 months and include parking pavement standards for private vehicular areas into the Zoning Text. Background: Nearly a decade ago, the City developed temporary and permanent paving requirements for private parking lots. After adoption as policy by the Planning Commission, it was made into an information handout for public distribution, which included pavement standards for the Private Vehicular Areas and Parking Table: The handout was an accessory to the Zoning Ordinance, Chapter 19.62.100. In November 1997, the Engineering Division updated the paving standards to bring them into conformance with environmental requirement. Some of the issues that precipitated the update were: the materials (cut-back asphalt) were environmentally undesirable and have been replaced with an emulsion composite, the local design standards were outdated; and because of problems related to the time frame for "temporary parking", which is currently set at six months, staff is proposing that it be extended to 1 year. This would allow temporary parking standards to coincide with the minimum Conditional Use Permit of 1 year. Staff recommendation: That the Planning Commission adopt Reso. PCA-98-06 recommending that the City Council approve the amended text to Chapter 19.62 - Off-Street parking and Loading, of the Zoning Ordinance, in accordance with the draft City Council ordinance. Commission discussion: Commissioner O'Neill asked if a tickler system is in place that allows staff to review at the end of the 1 year term those cases where temporary parking has been permitted, in order to ensures against temporary parking becoming permanent, non-conforming if it is overlooked. Ken Lee responded that there is a system in place in which the permittee is notified via a letter a few months prior to expiration of the permit, which informs them that they are required to either cease the business operation or install permanent parking. The temporary parking standards are in place for those instances where an applicant is proposing a temporary use for a one year period or less, not the pumpkin patch and Christmas Tree sale lots, which typically do not exceed one month of operation. Planning Commission Minutes - 4 - Wednesday, June 24, 1998 Commissioner Ray asked what precipitated the review to amend this section of the Municipal Code. Ken Lee responded that this review came about as a result of the temporary parking condition that was included in the Conditional Use Permit for the swap-meet on L Street. Public Hearing opened 7:23 No public input. Public Hearing closed 7:23. MSC (Ray/Willett) (6-0-1) that the Planning Commission adopt Reso. PCA-98-06 recommending that the City Council approve the amended text to Chapter 19.62 - Off-Street parking and Loading, of the Zoning Ordinance, in accordance with the draft City Council ordinance. Motion carried. DIRECTOR'S REPORT Ken Lee reviewed the calendar and stated that the next Planning Commission meeting is July 8, and a dinner workshop with a presentation by the Redevelopment Agency on July 15th. The Commission consensus is to have the workshop dinner begin at 6:00 and the meeting at 6:30. OTHER BUSINESS 4. Ken Lee reviewed the Summary of Activities Report for 1997-98. Commissioner Tarantino offered a comment to be added under "Comments and Recommendations" stating that the Commission appreciates the City Council's support, via the budget, of their work-effort and service, because it provides training to the Commission through various conferences. Commissioner Ray stated he wished to add a statement indicating that since the existing CUP process does not have in place a mechanism by which to follow-up or check that the conditions of approval have been complied with, except through responding to a formal outside complaint; he is recommending that the City Council draft a letter to the City Manager on behalf of the Planning Commission, requesting that serious consideration be given to look at ways to set up a program using interns or volunteers, to review all of the CUP's, and that annual or bi-annual reviews be conducted to ensure that the conditions of approval are being complied with. Planning Commission Minutes - 5 - Wednesday, June 24, 1998 5. Election of Chair/Vice Chair for FY 1998-99. MSC (Tarantino/Thomas) (6-0-1) that Commissioner Davis remain as Chair and Cmr. Willett as Vice Chair for the upcoming FY 1998-99. Motion carried. COMMISSION ER COMMENTS Commissioner Ray stated he has received numerous inquiries and complaints as to the activities that take Fflace on the parking lot of the abandoned property located on Bay Blvd. and F Street which attract semi-trailer trucks and use the lot (approximately four day out of the week) to change the oil or work on the vehicle. Can anyone who witnesses this type of activity taking place have the right to call it in to have code enforcement check it out and demand that the activities cease. Director Lee stated that this is a legitimate complaint and it is something that code enforcement can look into. In addition, the site seems to attract undesirable activity which can potentially create a liability for someone. Ann More, Assistant City Attorney responded that the City does have the ability to declare the property a nuisance if the findings warrant it, and can compel the owner to tear down the building.
