This obvious language conflict needs to be resolved as soon as possible, since it makes it impossible to generate an accurate map of the impact of this proposal. Remove Residential Buffer Secondly, we propose removing the buffer from residential uses completely, since it effectively eliminates the vast majority of viable commercial zones, and a number of council districts. The issues people have experienced regarding dispensaries near residents can be addresses by some simple building restrictions - only allow public entrances on public thorough fares, lighting that only eliminates within the parcel and ensure adequate parking. Storefront dispensaries would be prohibited from selling Medicinal Marijuana - Why? Recommendation - Allow storefronts to sell medicinal and recreational marijuana, same as deliveries. Only a maximum of two storefront dispensaries would be allowed per district, but could be less since these licenses could be taken by delivery services. We are concerned, given the extremely limited availability of commercial zoning, and the condition that storefront retailers would be required to have a conditional use permit in industrial zones, while delivery services would not, that this cap will lead to all licenses being taken by delivery and none being reserved for commercial storefront retailers. Recommendation - Reserve at least two licenses per district for storefront dispensaries and allow up to three The language states "Storefront Retailers shall not be located within 600 feet of any Treatment Facili Youth Center Youth -Oriented Business, or any public or private park or facility with recreational or playground equipment intended for use by minors, including tot -lots, swings, or similar equipment. • Youth Oriented businesses is wildly broadly defined and would include shoe stores. children's clothing stores, or movie theaters. • A private facility with recreational or playground equipment would mean any in-home daycare with a swingset or slide, any gym that has a children's area, any restaurant with a slide or ball pit, and, theoretically, a private home with a swingset. Recommendation - Remove Youth Oriented Businesses and private facility with playground equipment from the list of sensitive uses. Measurements shall be made without regard to natural or constructed physical barriers or impediments. This means that even if the sensitive use is completely inaccessible and cannot possibly be affected by the dispensary, they will considered. Even if there is a freeway between the sensitive use and the dispensary, a lake or a river. Recommendation - Take into account natural and constructed barriers and impediments when taking measurements. -171, 1,W11 - I j, .77 i ' 1 ' ' w T• 1 / - • - %tet Ml+( .ate+•, " ✓.. aj 40- :' 't?c }4y _•..iY MaTy i/Y 'P Chula Vista MJ staff (Proposal-'liliith Residential Buffers - Mop of proposal o IW12rA T for rmar a buskrness .'zoNr q in ChkAa'{l'ista, ncWhg ;cdI s,earnsifive uses,, iiirnclludiiing residenfia9 zone 3rSer Iv , . '.`1. •/ 'rf'' +pit•:• i r +' . . fl i •, R . 1147 'l r1yw• j,,y, 'i`" ..
