RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA APPROVING A CONTRACT WITH GERALD S.
KIBBEY & ASSOCIATES, INC. FOR THE APPRAISAL OF
PROPERTY AT 626 SECOND AVENUE
The City Council of the City of Chula Vista does hereby resolve as
follows:
WHEREAS, the City Council is desirous of obtaining an appraisal for a
property located at 626 Second Avenue; and
WHEREAS, Kibbey & Associates has submitted a contract for appraising
the subject parcel for the sum of $1,O00; and
WHEREAS, Gerald S.
appraisal of properties.
Kibbey & Associates is a firm experienced in the
NOW, THEREFORE BE IT RESOLVED by %he City Council of the City of
Chula Vista that a contract with Gerald S. Kibbey & Associates for the
appraisal of property located at 626 Second Avenue for the sum of $1,000,
attached hereto and incorporated herein as though fully set forth, is hereby
approved.
BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista is
hereby authorized to execute said contract on behalf of the City.
BE IT FURTHER RESOLVED that funds are available in Account
~6O0-6000-GF34.

I~ consideration of this employment agreement, the appraiser agrees to r<*ke a study
of the following property: 626 Second Avenue, Chula Vista, California.
The purpose of this appraisal is to serve as a guide for purchase negotiations.
Appraiser agrees to deliver 3 copies of said report to client within 60 days after
receipt of authorization and retainer; however, the appraiser has the right to extend
the delivery date in the event that unforseen difficulties are encountered in obtain-
ing comparable market data or for other reasons that may delay report delivery. The
extension of said delivery date shall be mutually agreed upon. If not mutually agreed
upon, the provisions of paragraph 9 shall apply.
Shouid additional services of the appraiser be requested by the client, his agent,
his attorney, or the court, such as pre-trial conferences, court appearances, court
preparation, etc., the client agrees to compensate the appraiser at the rate of $1,2~0
per day for Gerald S. Kibbey and $800 to $1,200 per day for associates, provided such
additional services are performed within one year after deli very of said report. In
the event that such services shall be required more than one year after delivery of
said report, the compensation shall beat the customary per diem rate charged by said
appraiser as of that date.
The cost of preparing exhibits for court, photo enlargements, maps, etc., shall be
borne by the client, and the appraiser shall, in addition to his compensation, be
reimbursed by the client for such costs advanced by the appraiser.
Payment for such additional services shall become due upon receipt of statement ren-
dered by the appraiser.
It is further understood and agreed that if any portion of the above compensation or
costs due to the appraiser become delinquent, the client agrees to pay interest
thereof at the rate of 18% per annum on said account from the due date until paid, and
further agrees to pay all costs of collection thereof, including reasonable attorney's
fees, court costs, etc..
In return for said services, the client hereby agrees to compensate the appraiser in
the amount of $1,000, payable as follows: the balance of $1,000 upon delivery of said
report.
In the event that the client desires to cancel this authorization, written notice
thereof shall be delivered to the appraiser, and it is agreed that the appraiser shall
receive compensation from the client for all services rendered at the rate of $800 to
$12~0 per day for the time actually spent prior to receipt of written notice to stop
work, plus all costs incurred in connection with said appraisal prior to receipt of
such written notice (not to exceed original fee).
It is further understood that neither the contract to make this appraisal nor the
sation therefore is contingent upon the amount nor the purpose of the valuation.
