HomeMy WebLinkAboutReso 1987-12953 RESOLUTION ~40. 12953 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ACKNOWLEDGING RECEIPT OF A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF CHULA VISTA RELATING TO THE PROPOSED AMENDED TOWN CENTRE II REDEVELOPMENT PLAN; CONSENTING TO HOLD A JOINT SPECIAL PUBLIC HEARING THEREON BY THE AGENCY AND THE CITY COUNCIL; SETTING A DATE FOR SUCH HEARING; AND PROVIDING FOR THE GIVING OF NOTICE THEREOF The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the Chula Vista Redevelopment Agency has prepared a proposed Amended Redevelopment Plan for the Town Centre II Redevelopment Project Area and transmitted said documents to the Planning Commission and Project Area Committee for their report and recommendation; WHEREAS, the City of Chula Vista has prepared a written report pursuant to the Environmental Quality Act of 1970, as amended, regarding environmental impact of the proposed Amended Redevelopment Plan, and WHEREAS, the proposed Amended Redevelopment Plan for the Town Centre II Redevelopment Project Area and the draft Environmental Impact Report have been submitted to the appropriate County and State agencies for review, comment, and report pursuant to the California Redevelopment Law and the California Environmental Quality Act of 1970, as amended; and WHEREAS, the California Community Redevelopment Law {Section 33355 and 33458 of the California Health and Safety Code) authorizes a joint public hearing on the proposed Amended Redevelopment Plan with the consent of the City Council of the City of Chula Vista and the Chula Vista Redevelopment Agency; and WHEREAS, the Chula Vista Redevelopment Agency on April 7, 1987, adopted Resolution No. 801 consenting to a joint special public hearing with this City Council and has requested the City Council to consent to a joint public hearing and set the time and place for same; and WHEREAS, the City Council of the City of Chula Vista has received from the Chula Vista Redevelopment Agency, Resolution No. 800 , the proposed Amended Town Centre II Redevelopment Plan, the Environmental Impact Report, and the Agency's Report to the City Council. NOW, THEREFORE, BE IT RESOLVED, DETERMINED, AND ORDERED BY THE CITY COUNCIL OF THE CITY OF CHULA VISTA AS FOLLOWS: Section 1. The City Council of the City of Chula Vista does hereby receive and file all resolutions, reports, and documents as are herein set forth. Section 2. The City Council of the City of Chula Vista hereby consents to a joint special public hearing with the Chula Vista Redevelopment AGency to consider adoption of the proposed Amended Town Centre II Redevelopment Plan and the approval and certification of the final Environmental Impact Report, and further, hereby establishes the time, date, and place for said public hearing at 7:00 p.m., on May 7, 1987, in the City Council Chambers located in the Chula Vista Civic Center, 276 Fourth Avenue, Chula Vista, California 92010. Section 3. The City Clerk of the City of Chula Vista in cooperation with the Executive Director of the Chula Vista Redevelopment Agency shall in accordance with Sections 33349, 33350 and 33361 of the Health and Safety Code: a) Publish the notice of said joint special public hearing once per week for four (4) consecutive weeks in the Star-News, said publication being a newspaper of general circulation withl~ula Vista community. b) Mail the notice of said joint public hearing to the last known assessee of each parcel of land in the area designated in the aforesaid redevelopment project plan at his last known address as shown on the last equalized assessment roll of the County of San Diego or to the owner of each parcel of land within such boundaries as such ownership is shown on the records of said County recorded thirty (30) days prior to the date the notice is published. Copies of the notices shall also be mailed to the governing body of each of the taxing agencies which levies taxes upon any property in the Project Area designated in the proposed Amended Redevelopment Plan for the Town Centre II Redevelopment Project Area. Section 4. The City Council of the City of Chula Vista does hereby invite the Planning Commission of the City of Chula Vista and the Town Centre II Redevelopment Project Area Committee to attend, and if necessary, participate in the meeting of the public hearing to consider, review and report upon any revisions, modifications or amendments to the proposed Amended Redevelopment Plan that might occur as a result of the public hearing. Section 5. The City Clerk of the City of Chula Vista shall forthwith transmit a copy of this Resolution to the Chula Vista Redevelopment Agency, the Planning Commission of the City of Chula Vista and the Town Centre II Redevelopment Project Area Committee.
