RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA APPROVING THE APPLICATION FOR LAND
USE AND WATER CONSERVATION FUNDS FOR EL RANCHO
DEL REY #6 PARK
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, the Congress under Public Law 88-578 has
authorized the establishment of a Federal Land and Water
Conservation Fund Grant-In-Aid Program, providing matching funds
to the State of California and its political subdivisions for
acquiring lands and developing facilities for public outdoor
recreation purposes; and
WHEREAS, the State Department of Parks and Recreation is
responsible for the administration of the program within the
State, setting up necessary rules and procedures governing
application by local agencies under the program; and
WHEREAS, said adopted procedures established by the
State Department of Parks and Recreation require the applicant to
certify by resolution the approval of applications and the
availability of local matching funds prior to submission of said
applications to the State; and
WHEREAS, the proposed E1 Rancho del Rey #6 Park project
is consistent with the Statewide Comprehensive Recreation
Resources Pla~: Recreation in California, Issues and Actions:
1981-1985; and
WHEREAS, the project must be compatible with the land
use plans of those jurisdictions immediately surrounding the
project.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Chula Vista hereby:
1. Approves the filing of an application for Land and
Water Conservation Fund assistance; and
2. Certifies that said agency has matching funds from
Parkland Acquisition and Development (PAD) fees and Residential
Construction Tax (RCT) fees and can finance 100 percent of the
project, half of which will be reimbursed, and
3. Certifies that the project is compatible with the
la,id use plans of those jurisdictions immediately surrounding the
project; and

4. Appoints the Parks and Recreation Director as agent
of the City to conduct all negotiations, execute and submit all
documents including but not limited to applications, agreements,
amendments, billing statements, and so on which may be necessary
for the completion of the aforementioned project.

PART IV - Program Narrative
1. Objectives and Need
This project is in accord with the Statewide Comprehensive Recreation
Resources Plan in that the result will be a neighborhood park for a new
development in the City, which will offer green space and passive and
active recreational activities for the surrounding community.
2. Results or Benefits Expected
The park will be used by residents surrounding the site, who are mainly
families. The site will offer green space and open space to the community,
as well as provide recreational activities for the residents. Parents will
be able to walk to the park with their children and provide them with play
opportunities.
3. Approach
This project involves the design and initial development of a 6.5 acre
neighborhood park. The development will include picnic tables and benches,
walkway, drainage channel, play equipment, trash receptacles, turf and
other plant material, drinking fountain and an irrigation system.
4. Geographic location
The project is located in the eastern section of the City of Chula Vista,
which is located in San Diego County. The park site is located at the
intersection of East "J" Street and Beechglen Drive. The project will
serve the surrounding housing development, comprised of approximately
300 homes within a one-half mile radius. Site plans and location maps
are included in the application.
5. Relationship with other Federally Funded Work
This project does not have any relationship with projects involving other
federal assistance.
6. A~reements
The park will be operated and maintained by the City of Chula Vista Parks
and Recreation Department. There are no agreements with outside agencies
for operation and maintenance of this site.

10. Overhead Utilit~ Lines
The San Diego Gas and Electric (SDG&E) Company has a 250 foot easement
across the site and has a transmission tower with overhead power lines
on site. SDG&E has certain height restrictions and building restriction
i~ its easememt$,i The City will comply with these restrictions, while
at the same time, planting sufficient landscaping and installing amenities
to lessen the impact. These lines may not be removed, as they are SDG&E
property and are active.

ENVIRONMENTAL ASSESSMENT
1. The project involves the development of a 6.5 acre neighborhood park on
land dedicated to the City by the developer of the surrounding housing
development. An Environmental Impact Report (EIR) was prepared for the
entire development of the subdivision.
The development of the park is in the design phase. The park will include
a walkway, turf, landscaping, picnic tables and benches, trash
receptacles, drinking fountain, irrigation system, drainage channel, and a
tot lot with play equipment. Actual construction is estimated to begin at
the end of calendar year 1987.
Care will be taken to ensure that adequate screening is provided for
surrounding residences that does not block views from these residences.
The plant material will be native and drought tolerant, where
appropriate. Current planted slopes will not be touched. Noise impacts
will be considered when locating and designing fields and play equipment.
Development of the park should not increase vehicular traffic, as the park
is within walking distance of the residents it is intended to serve, and
there will be no on-site parking.
2. As noted in the photographs attached to the oversize plan of the site,
there is no current land use on the site. The developer graded the site
and dedicated the property to the City to be used as a park. The San
Diego Gas and Electric (SDG&E) Company has a 250 foot wide easement
running through the site and a transmission tower on-site and the Otay
Water District has a l0 foot wide easement running parallel to the SDG&E
easement. The La Nacion Fault runs through the northeast section of the
property.
There are single family homes to the east and west of the site and open
space to the north and south. The park is adjacent to a major street
(East "J" Street) and is served by the local bus system.
As a condition of approval of the tentative subdivision map for the E1
Rancho Del Rey Unit 6 development, the developer was required to
transplant all substantial individual plants of snake cholla and coast
barrel cactus to open space, under the supervision of a qualified
botanist, prior to any clearing or grading of the entire subdivision
site. The developer was also required to have a paleontologist monitor
present during grading of the entire subdivision site to recover any
fossil remains that might have been found.
The air quality is good, with ocean breezes coming in daily from the
west. Water will be brought in for irrigation. There is some water
runoff from the surrounding area which enters the existing channel. The
channel is above ground on the park, lined with fossil rock brought to the
site.
3. The proposed project will change the site from a disturbed natural site to
parkland, with introduced plant material, turf, play equipment and park
fixtures. The park will increase the acreage of parkland in the City,
which is beneficial to the community. No significant natural or cultural
resources are present due to previous action by the developer.
The aesthetics of the site will be improved. Traffic should not increase
substantially since the park is within walking distance of the affected
residents. The park will use a large amount of water, however, drought
tolerant landscaping material will be used wherever possible. Air quality
should not be affected. Noise levels will increase, but with strategic
placement of shrubs and play equipment, the impact should not be
substantial.

CERTIFICATION OF COMPLIANCE
with PL 91-646 (For Development Projects)
The City of Chula Vista hereby assures and certifies that the provisions
of PL 91-646 were complied with in the acquisition of property identified
in the Land and Water Conservation fund application for E1 Rancho del Rey
#6 Park.
The park site was dedicated to the City by the developer, E1 Rancho del
Rey Corporation, for the surrounding housing development, Chula Vista
Tract 80-5 E1 Rancho del Rey 6, in May 1983.
The park property was not subject to the relocation assistance act as
there were no persons living on the property or businesses being con-
ducted.

I have determined that the Applicant's I/4CF acquisition and/or development
project(s) will not adversely affect cultural properties included in or
eligible for inclusion in the National Register of Historic Places. %his
determination is contingent upon the Applicant's concurrence that any plans
for development, not to exclude minor improvements involving ground
disturbance, will be submitted to the State Historic Preservation Officer for ·
review and comment at the earliest opportunity. In the event that development
plans will not be formulated and/or implemented by the Applicant but by
another agency or group, the Applicant will assume the responsbility for
ensuring that all provisions and stipulations contained herein are excuted,
as needed, jointly with that agency or group or independently by that agency
or group. This determination is further contingent upon the Applicant's
commitment to implement in good faith the following program of compliance with
36 CFR 800, Executive Order 11593, and Section 106 of the National Historic
Preservation Act of 1966 as amended:
1. The Applicant accepts the premise that proper cultural resource
identification, evaluation, and management will be an integral part
of the planning process for the project(s).
2. Accordingly, prior to the commencement of any physical development
activity, the Applicant or his designee will arrange to have appropriately
qualified professionals perform such investigations as may be necessary to:
a. Identify, evaluate, and manage any cultural values located wi~lin
the project's potential area of environmental impact that are
included in or may be eligible for inclusion in the National
Register or Historic Places.
(1) If, after consultation with the State Historic Preservation
Officer, any values not already included in the National
Register are determined to be eligible for inclusion in
the National Register, the Applicant or his designee will
nominate them to the Register according to established
procedures. Nominations shall be submitted to the State
Historic Preservation Officer no later than six mon~ls after
the adoption of a final development plan.
b. Determine, in consultation with the State Historic Preservation
Officer, if and to what extent these values may be adversely affected
by planning, development, operation, and maintenance activity.

C. Develop and implement prudent and feasible measures, acceptable to
the Applicant or his designee and the State Historic Preservation
Officer, capable of either effectively mitigating or avoiding adverse
effects on National Register and National Register eligible values.
Avoidance and protection will be preferred objectives. However,
should discussions indicate that only something less is achievable,
that course of action which is likely to cause the least unnecessary
damage to these values will proceed.
Documentation of compliance with each of these stipulations as needed will be
submitted to the State Historic Preservation Officer for review and comment in
timely fashion.
The Applicant or his designee will unilaterally determine the time most
suitable for the commencement of cultural resource investigations
acknowledging, however, that:
1. They will constitute a part of the planning process providing data for
sound, advance planning decisions.
2. They will be completed before a final development plan is adopted and any
physical activity begins.
Failure to comply with any of the provisions and stipulations herein contained
shall constitute grounds for revocation of a no adverse effect determination
and shall require full Application compliance with the Advisory Council
procedures.
