IN CONFERENCE ROOM C101, LOCATED AT CITY HALL, 276 FOURTH AVENUE, CHULA VISTA, CALIFORNIA, TO CONSIDER THE FOLLOWING: 1. Roll Call. 2. Discussion and Action Regarding Complaint BOE 10-16-12B. 3. Public Comments — This is an opportunity for the general public to address the Board of Ethics on any subject matter that is not an agenda item. 4. Members' Comments 5. A copy of this complaint is attached. My deliberation and decision in the matter of rezoning property across the street from the Olympic Training Center was based on information presented by City staff and the applicant. As part of the complaint, it is stated that I likened concerned homeowners to "children afraid of the bogieman [sic]." I did not say this. My comments were in respect to people fearing what they do not understand; therefore it is incumbent that accurate information be appropriately provided in a timely manner, giving as an example that children fear monsters under their beds because they don't know what's there. A second part of the complaint alleges that I could be taking a kickback from the developers. If the complainant has information to support his/her allegations, that information should be brought forward. I have received nothing from Integral Communities that could possibly be even remotely considered a kickback. This is a serious allegation that is nothing short of being libelous speculation. At no time did I engage in wrongdoing and offer for your consideration that the complaint does not demonstrate any probable cause that an ethical violation has occurred and therefore it should be summarily dismissed.
