RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA CONDITIONALLY REVOKING CONDITIONAL
USE PERMIT ?CC-84-23 FOR THE OPERATION OF THE
CABRILLO SCHOOL OF NURSING AT 713 BROADWAY
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, on December 2, 1986, the City Council by
Resolution No. 12836 granted the appeal of the Cabrillo School of
Nursing from the Planning Commission's revocation of a
conditional use permit, and approved an increase in enrollment
for the Cabrillo School of Nursing at 713 Broadway subject to the
condition proposed by the school to maintain an off-site parking
area on "J" Street, some 300 feet walking distance from the
school, and
WHEREAS, the matter was scheduled for a public hearing
before the City Council on March 3, 1987 to reconsider revocation
of the conditional use permit due to new circumstances.
WHEREAS, the Council further finds that operation of a
school of nursing at said location is a desirable use which will
contribute to the general well being of the neighborhood; will
not, so long as it does not exceed 30 students, be detrimental to
the health, safety or general welfare of persons residing or
working in the vicinity, nor be injurious to property or
improvements in the vicinity; such use, if so limited, will
comply with the regulations and conditions specified in the Chula
Vista Municipal Code for such use; and that the granting of the
conditional use permit, so long as limited to 30 students, will
not adversely affect the general plan, and
WHEREAS, the Council further finds, pursuant to said
public hearing that as of January, 1987, Cabrillo no longer has
the use of this parking area and students are again parking
on-street, and are in violation of the condition imposed on the
granting of the appeal, and
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Chula Vista does hereby deny the appeal of the school
and revoke PCC-84-23, effective on April 30, 1987 and direct the
Cabrillo School of Nursing to cease operations at 713 Broadway as
of that date.

BE IT FURTHER RESOLVED that the Zoning Administrator is
hereby authorized to "stay" the revocation if it is shown that
enrollment has been reduced to the 30-student limit by the
effective revocation date. The Zoning Administrator may grant a
maximum of four 90-day "stays" based upon a showing of compliance
with the 30-student limit evidenced by an enrollment report filed
with the City by the school and subject to on-site inspection and
confirmation by City staff.
