NOTICE IS HEREBY GIVEN THAT THE AD HOC COMMITTEE OF THE
BOARD OF ETHICS OF THE CITY OF CHULA VISTA WILL MEET IN
SPECIAL SESSION ON THURSDAY, MARCH 24, 2011 AT 4:00 P.M. IN
THE EXECUTIVE CONFERENCE ROOM, LOCATED AT CITY HALL,
276 FOURTH AVENUE, CHULA VISTA, CALIFORNIA, TO CONSIDER

2.28.010 Establishment of code of ethics.
The respected operation of democratic government emphasizes that
public officials be independent, impartial, and responsible to the people.
The public judges its government by the way public officials conduct
themselves in the posts to which they are elected or appointed. All public
officials should conduct themselves in a manner that will tend to preserve
public confidence in, and respect for, the government represented. Such
confidence and respect can best be promoted if every official, whethet
paid or unpaid, and whether elected or appointed, will seek to carry out
these goals.
The purpose of this code is to establish ethical standards of conduct by
setting forth those acts or actions that are incompatible with the best
interests of the city and- by directing disclosure by such officials of private
financial or other conflict of interests in matters affecting the city. Further,
it is the purpose of this code to assist the aforementioned officials in the
task of judging themselves, so as to enable them to properly carryout
their responsibilities as trustees and fiduciaries of the public interest.

2.28.110 Organization,
A. The board shall be composed of seven members appointed by the
city council for a term of four years, as prescribed by the provisions of the
city Charter and the municipal code of the city of Chula Vista. Prior to
exercising their authority to appoint a person to membership, the city
council shall refer for recommendation the list and qualifications of
applicants to the presiding judge of the South County Division of the San
Diego Superior Court or his or her designee, who shall review the list of
applicants and their qualifications, and who should select not. less than
five for the purpose• of conducting in-person interviews and who shall
conduct such interviews. If said judge or designee declines or fails to
review such applicants, or conduct such interviews, or make such
recommendations, then the council shall interview such applicants
themselves personally, and may make an appointment jointly passed with
fouraffirmative votes. No such person maybe appointed as a member, or
shall be entitled to retain their membership, if he or she, within the past 10
years prior to the date of appointment, has been convicted of a crime
involving moral turpitude, or has been found to have committed a cHminal
violation of the Fair Political Practices. Act
B. The board shall elect from its membership a chair and a vice -chair.
The term of the chair and vice -chair shall be for the period of one year,
commencing on July 1st each year: The chair shall preside at all
meetings. In the absence of the chair at any meeting, the vice -chair shall
preside, and in the - absence_ of both chair and vice -chair, - the board-.

C. The city attorney or an appointed representative shall act as
secretary to the board. The secretary shall cause notice of the meetings
of the board to be kept and distributed. The secretary shall also give
appropriate and required written notice of all meetings to all members and
persons having business before the board. (Ord. 2778 § 1, 1999; Ord.
2630 § 1, 1995; Ord. 2297 § 1, 1989).
,2.28..115 Qualification of Members
Each member of the Board shall comply with the following qualification.6
during his or her tenure on the Board:
(a) Each Board member shall be a registered voter of the City of Chula
Vista, and
of high moral character and integrity.
(b) No member of the Board shall make a financial contribution to, or
publicly support or oppose, a candidate for City of Chula Vista elected or
appointed office.
(c) No member of the Board shall become a candidate for City of Chula
Vista elected office during his or her tenure on the Board, and for
twelve months thereafter. Each prospective Board member shall sign a
written declaration agreeing not to run for elective governmental office for
at least twelve months after completion of service on the Board, and
waiving the legal right to challenge this provision.

the Review, the Board of Ethics will vote in closed sessi
on whether or not to conduct a Preliminary Inves igation.
Please do not provide any additional information to
the Board at this time. During the Review process, the Board.
of Ethics will only consider information contained in the
complaint."
(b) The Board shall conduct the Preliminary Review in closed session,
pursuant to section 54956.9 of the California Government Code.
(c) The Board shall make reasonable efforts to complete a Review within
thirty calendar days of the receipt of each complaint.
(1) Failure of the Board to complete the Review within thirty calendar
days shall not preclude the Board from pursuing the complaint
against the Respondent in accordance with these procedures,

d) Notwithstandinq Section 2.28.150(c), a Review based on a formal
complaint received by the Board within ninety calendar days of a
municipal election and alleging violations by a candidate seeking office at
that election shall be completed by the Board of Ethics within fifteen
calendar.days of receipt of such complaint.
(e) After completing the Review, the Board of Ethics may determine that the
allegations in the complaint do not warrant a Preliminary Investigation for
any of the following reasons:
(1) The Board has no iurisdiction over the allegations made in
the complaint. A matter is outside the iu[isdiction of the.
Board if:
(A) The subject of the complaint is a,Person who is not --- Formatted. Bullets and Numbering
identified in Section 2.26.020 of the Chula Vista Formatted
Municipal Code as being within the scope of the Board's
investigative and enforcement authority: or
(B) The complaint does not allege a violation of the City
of Chula Vista's Ethics Ordinance.

2.28.152 Preliminary Investigation
Formatted: Bullets and Numbering
(a) The Board, in its discretion, may -- Formatted: Bullets and Numbering
(1) Conduct the.Preliminary Investigation;
(2) Assign an ad hoc sub committee (3 or less) comprised of
one to three Board members to conduct the Preliminary
Investigation; or
(3) Hire an individual selectedfrom a list of pre -qualified
investigators to condlact the Preliminary Investigation
(hired investigator.)
(b) The Board of Ethics, or its designee, shall make reasonable
attempts to complete a formal investigation into the allegations
contained in the complaint within 90 calendar days of the
Board's decision to commence the investigation, but in no event
shall the Preliminary Investigation take more than 180 calendar
days to complete.
(c) Failure of the Board, or its designee, to complete a formal
investigation within 180 calendar days shall not preclude the
Board from pursuing the complaint against the Respondent in
accordance with these procedures.
(d) As part of a Preliminary Investigation, the Board, or its designee .
may iriteiyibW pertohs-withIfb-W1e'd" bf tCie f cts,al}eged in the
complaint, and may seek the production of books, papers, "
records, and other items material to the investigation of a
complaint.
(e) The ad hoc subcommittee or the hired investigator shall
periodically report to the Board, in closed session, on the status
of all pending matters, both during and after a Preliminary
Investigation. Failure to report to the Board concerning the
status of an investigation shall not affect the validity of any
information or documentation obtained during the investigation.
2.28.153 Preliminary Determination
a) At the conclusion of the Preliminary Investigation, the Ad hoc
subcommittee or the hired investigator shall present to the
Board all relevant evidence obtained during the course of the
investigation. The presentation shall be made in closed session
pursuant to Section 54956.9 of the California Government
Code.
(b) Based on a review of the evidence presented, the Board shall,
by a concurring vote of at least four members, determine
whether there is cause to believe that the Respondent violated
Chula Vista's Ethics Ordinance; and, if so, whether to conduct a
Secondary Investigation.

the Board shall make a Final Determination
1) The determination shall be made in closed session
pursuant to California Government Code section 54956.9 by
a concurring vote of at least four Board members.
2) If an individual was .selected from a pre -qualified list to
serve as IrWestigator pursuant"to Section 2.28.151 (a)(3) the
Board may request that such individual attend the closed
session meeting to discuss any issue relevant to the
Secondary Investigation.
3) The Board shall find that an ethical violation occurred only
if it determines that the evidence is sufficient to lead a
person of ordinary caution and prudence to believe that
Respondent has committed a violation.
4) A Final Determination by the Board regarding the
existence of an ethical violation shall be based on the entire
record of the proceedings. Each Board Member who
participates in the determination shall state for the record
that he or she personally heard or read the testimony (either
in person or by listening to a recording or by reading a
transcript prepared by a court reporter) and reviewed the
evidence, or otherwise reviewed the entire record.
(b) If the Board's Final Determination is that there were no ethical
violations, the Board shall take no further action on the complaint and
shall notify each Complainant and Respondent in writing of the
Board's decision within five business days of the decision.
8._ If, after appropriate investigation or hearing, the board shall find that a
conflict of interest or a breach of ethics, as prohibited by the code of
ethics, did or continues to exist, the board shall forward its findings to the

Board makes a determination that it will take no further action on the
alleged violation by declining to pursue investigation or upon completion of the
investigation and the matter has been forwarded to the City Council
(i) Notwithstanding the disclosure provisions of this section individual items of
information in the following categories may be segregated and withheld if, on
the particular facts, the Board, or its designee determines that the public interest
in non -disclosure clearly and substantially outweighs the public interest in
disclosure:
(1) The names of iuvenile witnesses; or
(2) Personal or otherwise private information related or unrelated to the
investigation if the disclosure would constitute an unwarranted
invasion of privacy; or
(3) The identity of a confidential source: or
(4) The identity of the Complainant or
(5) Secret investigative techniques or procedures,• or
(6) Information, which if disclosed would create a credible risk of
endangering any individual; or
(7) Information, which, if disclosed would endanger the successful
completion of an investigation where the prospect of enforcement
proceedings is concrete and definite.
