Signed: Date: lec" /I Ms. Aguilar has been the "face and voice" of Crossroads for at least the last six years. Ms. Aguilar has not stepped down from that position. Peter Watry was acting president of Crossroads during her campaign but he informs me that he resigned from that position the day after the election. As a charter member of Crossroads, I can attest that there has been no notice of her resignation from her position as president nor a call to elect her replacement. 1. On December 14, 2010 Ms. Aguilar opposed a condominium project even though it had met all the requirements imposed on it by the City. 2. At the Crossroads breakfast on December 16, 2010 her position was lauded as a "David v. Goliath" victory. 3. Having insisted upon referring this project back to the Design Review Board, on December 20, 2010 Ms. Aguilar attended that meeting sitting in front of the Board and taking notes leading to the perception of intimidation. 2.25.130 Code of Ethics. "Voting... members... are public officials and therefore, act as agents for the public's purpose and hold office for the public benefit. As public officials, they are bound to uphold the law, observe in their official acts a high standard of morality and discharge faithfully the duties of their office, recognizing that the public interest must be a primary concern..." It is hard to believe that Ms. Aguilar put the public interest before that of her group. Her actions undermined the authority of our City Manager and the Director of Planning. The applicant had conformed with all the requirements and trusted that assurances given to them by these men would hold true. Those who would invest in Chula Vista now have.to wonder who to negotiate with. The public interest is increased revenue to the City and jobs; -in fact both were,key planks in her campaign. She chose to ignore the $10-$12 million in fees to the City, the approximately 200 full time construction jobs for a year and the increased property tax revenue this project would bring because she and her sponsor did not like the architecture. The damage to the credibility of the City done by her actions will not be easily undone. It is clear to me that she put her own interests before the best interests of our community. January 18, 2011 TO: Board of Ethics, City of Chula Vista FROM: Peter Watry I wish to correct many of the mistakes made in the complaint. Pat Aguilar was selected as President of Crossroads II at its founding in 2003. In 2009, when she declared as a candidate for City Council, she took a Leave of Absence as President. I had been Vice -President since about 2005, so I became "Acting President" for the duration of the election process. Pat was on a Leave of Absence and could not vote at our meetings. On November 3, 2010, the day after the election, I cancelled her Leave of Absence. Pat then became President again. The first business Crossroads Board meeting after the election was on January 9, 2011. At that meeting, Pat submitted her resignation as President and David Danciu was elected as our new President. I am still Vice -President. Pat is now a non-voting member of the Board. The condition of her participation in her letter of resignation reads as follows: "I would neither participate in deliberations nor vote on matters before the Board that may eventually go to the City Council for a decision. However, I am willing to provide facts and information on items that may go to the Council, if the Board desires." I have been an active community activist in Chula Vista since the early 1970s, and I kind of resent the implication that I do not know the rules of what Council members can do and cannot do. Pat has not been a community activist that long, but she is equally well aware of the rules. We have all been most careful of all our actions. As to the statement in the complaint that says: "I can attest that there has been no notice of her resignation from her position as president nor a call to elect her replacement," that is patently false. On January 13 I sent out an email to over 250 Crossroads II member households, to over 100 "Friends of CII" households, and to about 18 City Staff members. A copy of the email is attached, with many of the addresses deleted. The email reads in part, "As you know, our founding President, Pat Aguilar. was elected to the Chula Vista City Council in November. As such, she does not feel comfortable trying to continue being President of Crossroads II, although she will stay on the Board of Directors as a non-voting member. The Board has unaminously elected David Danciu as our new President of Crossroads II.... I have now returned to my post of Vice President." The Complaint also mentions that Ms. Aguilar voted "no" on a proposal before the Council "even though it had met all the requirements imposed on it by the City." There was once a vote on the Planning Commission where each Commissioner in turn was talking as if they "had" to vote yes. The City Attorney interrupted them and pointed out that no one HAS to vote yes or no. If that were so, they would not need to vote. A Council person does NOT have to vote "yes" or "no" on any issue. That is why they have votes. This particular proposal was so bad it deserved 5 "no" votes! The gist of the Complaint is silly. I have been witness to the fact that Ms. Aguilar has been very careful to do every action in a most correct fashion -- there have been no exceptions. During the last several years, the Otay Water District and the City of Chula Vista have enjoyed a positive relationship, which has allowed both public agencies to work together to better serve their mutual constituents in the South Bay. The Board of Directors of the District appreciates and values this positive relationship. As such, the Otay Water District's Board of Directors is compelled to bring to your attention the disturbing conduct of Chris Schilling, a member of the City's Board of Ethics, during the recent election cycle. Mr. Schilling ran for the seat on the Otay Water District Board vacated by former Director Larry Breitfelder. Mr. Schilling's campaign tactics included inflating his work as a member of the City Board of Ethics for his personal benefit and publicly lodging false accusations of misconduct and mismanagement against the Otay Water District, its Board and employees. Mr. Schilling's statements about the District are patently false, and are so egregious in nature that Mr. Schilling had to either know that his statements were false or recklessly disregarded their veracity. However Mr. Schilling came to crafting his false accusations, he continued to repeat such accusations throughout his campaign, during speaking engagements, in interviews, in campaign materials and on his campaign websites. Examples of the statements made by Mr. Schilling are set forth in the attachments to this complaint. As a public official for the City of Chula Vista, his conduct is simply unacceptable, flying in the face of the very Code he purports to uphold as a member of the City's Board of Ethics. Public officials for the City of Chula Vista are held to a high standard of conduct that is intended to protect the public and advance public purposes. CVMC §2.25.130. "All public officials should conduct themselves in a manner that will tend to preserve public confidence in, and respect for, the government represented." CVMC §2.28.010. "One of the highest callings is that of public service. With that service comes a requirement to conduct oneself in a manner above reproach, since the citizens of the community expect and deserve a high standard of conduct and performance." CVMC §2.28.050(A). The tenets of the City's Code of Ethics are doubly true for members of the City's Board of Ethics, such as Mr. Schilling, who are tasked with enforcing the City's ethical standards of conduct. It is a hypocrisy that Mr. Schilling on the one hand would brag about his fight for good government as an Ethics Board member and on the other hand commit the very violations he is supposedly fighting against. We trust that Mr. Schilling's false accusations do not reflect the true position of the City towards the District. However, Mr. Schilling's one-two punch campaign strategy (touting his service on the Board of Ethics and then lodging false accusations against the Otay Water District) gives the public a very strong impression that he is speaking not only as a candidate for the District Board but also as a representative of the City. Such strategy and conduct by Mr. Schilling reflects poorly on the City, is an abuse of Mr. Schilling's position with the City, and should not be tolerated. We request that the City investigate Mr. Schilling's improper conduct and actions during his campaign for office, as summarized above, and take appropriate action, including and up to removing Mr. Schilling from his position for cause. El Foro Publico The True Color of Gray Page 1 of 2 Gray Davis Tuesday announced that his state faces a record budget deficit of $24 billion, mostly because the relatively few wealthy citizens who pay most of the state's taxes lost money on their investments last year. A report in Wednesday's Washington Post says, "The budget crunch shows how deeply California has come to rely on a relatively small number of its most affluent citizens to pay the state's bills." The wealthiest 5 percent pay 70 percent of the state's personal income taxes, the newspaper said. Davis has proposed what he called "extremely painful" cuts in state services, at a time when a growing number of poor people are demanding more state services. Governor. Davis is trying to blame everyone except himself for the budget shortfall. His new budget makes everyone but himself pay, when the taxpayers know it was his gross mismanagement that put the state in this position. Since he caused the red ink, I say we give him the pink slip this fall. Democrats always accuse Republicans of not funding Education properly. Note that it is a Democratic Governor that is cutting K-12 funding by over $113. Our schools are doing so poorly I guess Davis just wants to cut bait. Another brilliant idea from Davis is to heap more taxes on cigarettes. Past experience has shown that this does not reduce smoking. Instead, milk money and rent money goes for cigarettes. Far more low income than high income folks smoke. So, Davis is proposing a tax on the poor. Jane Dupont Spring Valley The Other Side of the Sherman Story I have been reading your paper the last year since I work at Sherman elementary. It is apparent to me that your reporting is biased against the administration of this school. Your one-sided support of SABER and "the community" is laughable. Although 50% of teachers signed the petition 50% did not (and 2 people took their signature off the petition). There is quite a number of people who legitimately disapprove of the charter. As far as the ugly signs posted, the accusation that it was administration is the most laughable, anybody in the community has access to those colors. I may even look to that very parent who made the claim. A member of the charter committee claimed "this is war". It is not about children anymore it is about saving face. I know it is hard for them to realize that not all of the community believes in their "vision". Many people see the progress our students are making and want to continue. Did they forget to tell you they did not get the $450,000 grant they said was in the bag. HUMMMM that might make a difference. One more thing, our administration has not backed any movement. One IS a parent who has a right to a voice but surprisingly so our principal has stayed out of it. These people want to live in the past where no one was held accountable and THEY ran the school. Chula Vista Municipal Code section 2.28.090, subdivision (A), sets forth the requirements of a complaint brought before the Board, including the requirement that a complaint must contain "a full allegations of facts which would constitute a violation of the code." Chula Vista Municipal Code section 2.28.050, subdivision (B)(1)-(7) sets forth the specific prohibitions on which the Board may act. The complaint that was filed had allegations of misconduct generally involving two types of conduct, including (1) that Mr. Schilling, while running for elected office for the Otay Water District Board, identified himself as a Board member on his website; and (2) that Mr. Schilling made derogatory comments against the Otay Water District Board and Mr. David Gonzalez, the incumbent Otay Water District board member running for re-election. After review of the allegations in the complaint, the Board has determined that neither allegation of misconduct fall within the prohibitions listed in Section 2.28.050, subdivision (13)(1)-(7). With regard to the claim that Mr. Schilling identified himself as a Board member during his campaign, the Board found that such conduct did not fall within Section 2.28.050(B)(1) because such identification was not done for "personal gain" within the meaning of that section. Instead, it was done for the purpose of informing the electorate of his qualifications. Such identifications are not unusual and not prohibited. With regard with to the claim that that Mr. Schilling made derogatory comments about the Otay Water District Board and Mr. David Gonzalez, Jr., the incumbent Otay Water District board member running for re-election, such comments do not fall within any of the prohibitions listed in Section 2.28.050(B)(1)-(7).
