HomeMy WebLinkAboutReso 1987-13010 RESOLUTION NO. 1SOLO RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ORDERING THE SUMMARY VACATION OF PORTIONS OF SEWER AND DRAINAGE EASEMENTS WITHIN LOTS 142, 143, 161 AND 170 OF BONITA LONG CANYON UNIT ~3 AND AUTHORIZING THE MAYOR TO EXECUTE A QUITCLAIM DEED FOR SAID EASEMENTS The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, on June 17, 1986, by Resolution 12530, the City Council accepted certain offsite easements for drainage and sewer purposes in conjunction with approval of Bonita Long Canyon No. 2 Subdivision, and WHEREAS, portions of these easements are located within Lots 142, 143, 161 and 170 of Bonita Long Canyon Unit No. 3, and WHEREAS, McMillin Development Company, the current owner of the lots has requested that portions of said easements located within Lots 142, 143, 161 and 170 be vacated in order to eliminate unnecessary easements from title reports for the subject properties, and WHEREAS, the Engineering staff has determined that the easements are no longer necessary in that the portions of the easements within Lots 142, 143 and 161 were for access only and contain no utilities and access is now provided through the street system in Bonita Long Canyon and the portion of the easement within Lot 170 was for installation of a temporary storm drain which has been relocated outside Lot 170 in conjunction with Unit 3, and WHEREAS, Streets and Highways Code Section 8333 permits the summary vacation of an easement if the easement has been superseded by relocation and there are no other public facilities located within the easement. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby order the summary vacation of portions of sewer and drainage easements within Lots 142, 143, 161 and 170 of Bonita Long Canyon Unit 3. BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista be, and he is hereby authorized and directed to execute a quitclaim deed for said easements, a copy of which is attached hereto and incorporated herein by reference as if set forth in full.
