RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA ACCEPTING GRANT OF EASEMENT FROM
MASCOT REALTY, INC. FOR STREET PURPOSES
The City Council of the City of Chula Vista does hereby
resolve as follows:
N0%4, THEREFORE, BE IT RESOLVED by the City Council of
the City of Chula Vista that that certain grant of easement
for street purposes
executed by Mascot Realtyr Inc., a California corporation
dated the 6th day of April , 1987 , a
copy of which is attached hereto and by this reference made a
part hereof as though fully set forth herein, be and the same is
hereby accepted by the City of Chula Vista.
BE IT FURTHER RESOLVED that the City Clerk of the City
of Chula Vista be, and she is hereby authorized and directed to
record said easement in the office of the San Diego County
Recorder.

do(es) hereby grant, convey and dedicate to the CITY OF CHULA VISTA, State of
California, the right-of-way and incidents thereto for a public street upon, over and
across that certain real property in the City of Chula Vista, County of San Diego, State
of California, described as follows:
That portion of Lot 12, E1 Rancho Villas, in the City of Chula Vista, County of
San Diego, State of California according to Map thereof No. 2376, filed in the
Office of the Recorder of San Diego County February 11, 1947, and of the West
half of 80 acre Lot 1 of Quarter Section 125 Rancho de la Nacion according to
the Nap thereof No. 166 by Morrill, filed in said County Recorder's Office May
11, 1869, more particularly described as follows:
Beginning at the Southwest corner of said Lot 12, E1 Rancho Villas, said point
also being in the Easterly line of that land conveyed to Clarence W. Hensel et
ux by Deed recorded March 22, 1923, in Book 931, Page 246 of Deeds; thence
along said Easterly line [lorth 20°11'33'' West (record North 19°48'12" West)
60.00 feet, said point also being the southwest corner of that parcel of land
conveyed to Security Pacific National Bank, as Trustee of Trust #08-5-07635-0
by Deed dated March 25, 1981, filed in said Recorder's Office in Book 1981,
File/Page No. 81-158629 on May 21, 1981; thence along the Westerly line of
said parcel of land conveyed to Security Pacific National Bank, as Trustee of
Trust #08-5-07635-0, North 20°11'33" West 527.10 feet the True Point of
Beginning, said point being on the Northerly line of said 80 acre Lot 1; thence
easterly along said Northerly line North 71°12'10'' East a distance of 28.01
feet; thence South 20°11'33'' East a distance of 45.28 feet to a point on a
non-tangent 50 foot radius curve, concave southerly, the radial of said curve
bears South 13°51'56'' West; thence westerly along said curve through a central
angle of 34°03'29'' an arc length of 29.72 feet to the Westerly line of said
parcel of land conveyed to Security Pacific National Bank; thence along said
Westerly line North 20°11'33'' West a distance of 37.39 feet to the True Point
of Beginning.

The Grantor hereby further grants to the City of Chula Vista the privilege and right to
~!iiii~tend drainage structures and excavation and embankment slopes beyond the limits of the
lilY'rein described right-of-way where required for the construction and maintenance of
said public street. RESERVING unto grantor of the above described parcel of land, his
successors or assigns, the right to eliminate such slopes and/or drainage structures or
portions thereof, when in the written opinion of the City Engineer of Grantee, the
necessity therefore is removed by substituting other protection, support and/or drainage
facility, provided such substitution is first approved in writing by said City Engineer.
The Grantor hereby further grants to Grantee all trees, growths (growing or that may
hereafter grow), and road building materials within said right-of-way, including the
right to take water, together with the right to use the same in such manner and at such
locations as said Grantee may deem proper, needful or necessary, in the construction,
reconstruction, improvement or maintenance of said public street.
The Grantor, for himself, his successors and assigns, hereby waives any claim for any
and all damages to Grantor's remaining property contiguous to the right-of-way hereby
conveyed by reason of the location, construction, landscaping or maintenance of said
public street.
