RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA ORDERING THE SUMMARY VACATION OF
CERTAIN SEWER EASEMENTS WITHIN CHULA VISTA
TRACT 77-10, HUDSON VALLEY ESTATES UNIT NO. 1
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, the sewer easements proposed to be vacated are
an easement from Second Avenue to Las Flores Drive for a sewer
main and an easement adjacent to Las Flores Drive for a sewer
pump station, and
WHEREAS, the main and the pump station were abandoned in
1980 when a gravity sewer main was extended to the Spring Valley
Sanitation District trunk sewer, and
WHEREAS, said easements were accepted by Resolutions
953, 1017, 1019 and 1020, and
WHEREAS, Section 8333 of the California Streets and
Highways Code states than an easement may be summarily vacated if
the easement has not been used for the purpose for which it was
dedicated for five consecutive years immediately preceding the
proposed vacation, and
WHEREAS, all of the utility companies were contacted
regarding the proposed vacation and have no objections, and
WHEREAS, pursuant to Section 8333 of the California
Streets and Highways Code, the City Council of the City of Chula
Vista must adopt a resolution of vacation.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Chula Vista does hereby order the summary vacation of
certain sewer easements within Chula Vista Tract 77-10, Hudson
Valley Estates Unit No. 1 as more particularly described in
Exhibit "A", attached hereto and incorporated herein by reference
as if set forth in full.

of San Diego, State of California as Doc. 37680, book 3186 page

103 O.R. and Book 2897 page 108 O.R.

DRAINAGE EASEMENT VACATION
That certain portion of a drainage easement granted to the City
of Chula vista and recorded as document 78-300703 (Recorded 7-18-
78) more particularly described as follows:
Beginning at the southwesterly corner of parcel one of parcel map
7618, as filed in the office of the County Recorded, County of
San Diego on July 20, 1978. Thence, along the westerly line of
said parcel 1 N18~ 36'08"E; a distance of 48.65 feet to the
beginning of said easement; thence along the centerline of said
easement S64~ 44'30"E a distance of 62.83 feet; thence N 71
15'30"E a distance of 85.00 feet to the TRUE POINT OF BEGINNING
OF SAID VACATED PORTION; Thence N38¢ 15'30"E a distance of 36.00
feet; thence N 62° 37'15"E a distance of 35.97 feet; thence N 71~
15'30"E a distance of 226.12 feet to the terminus of said
easement.
