HomeMy WebLinkAboutReso 2017-124RESOLUTION NO. 2017-124 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING THE THIRD AMENDMENT TO A MEMORANDUM OF UNDERSTANDING WITH THE SAN DIEGO ASSOCIATION OF GOVERNMENTS (SANDAG) REGARDING AN ENVIRONMENTAL DOCUMENT FOR GRADE SEPARATIONS AND STATIONS TO THE LIGHT RAIL TROLLEY'S (LRT) BLUE LINE, AUTHORIZING THE CITY ATTORNEY TO MAKE SUCH NON -SUBSTANTIVE CHANGES DEEMED NECESSARY FOR THE BENEFIT OF THE CITY, AND AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE THE AGREEMENT WHEREAS, the City of Chula Vista (City) desires to work with the San Diego Association of Governments (SANDAG) in order to make rail corridor improvements through Chula Vista; and WHEREAS, the City and SANDAG each have projects in the RTIP related to making these rail corridor improvements; and WHEREAS, on June 19, 2012, the City Council approved Resolution No. 2012-118 approving the initial Memorandum of Understanding (MOU) for STM -361, SANDAG Contract Number 5004169, for the purposes of preparing an environmental document that will consider project alternatives for grade -separating the Blue Line Light Rail Trolley crossing at Palomar Street and commensurate station improvements; and WHEREAS, as of June 2014, the Palomar Street rail crossing is ranked as the County of San Diego's highest priority location for grade -separation; and WHEREAS, on December 16, 2014, the City Council approved Resolution No. 2014-253 extending the initial MOU expiration date from December 31, 2014 to June 30, 2016 in order to complete the environmental document, the final project invoicing, accounting and close out documentation to Caltrans and Federal Highway Administration; and WHEREAS, on November 3, 2015, the City Council approved Resolution No. 2015-248 amending the MOU in order to perform additional tasks related to the Project Report and Environmental Document (PR/ED) such as additional public outreach, photo simulations and traffic analysis of the various alternatives being considered and extended the expiration date from June 30, 2016 to June 30, 2020, in order to coincide with the reversion date of the federal funds; and WHEREAS, approving the third amendment to the MOU will provide for additional consultant services such as, groundwater monitoring and technical analysis needed for the traffic analysis of the various geometric alternatives for the alternative that lowers Palomar Street under all rail lines prior to determining it as the preferred alternative; and Resolution No. 2017-124 Page No. 2 WHEREAS, approving the third amendment to the MOU will amend the SANDAG budget by $52,000 from $982,000 to $1,034,000 for its efforts related to the PR/ED. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby approve the third amendment to the Memoranda of Understanding with the San Diego Association of Governments for contract Number 5004169 regarding an environmental document for grade separations and stations to the Blue Line Light Rail crossing at Palomar Street, authorize the City Attorney to make such non -substantive changes deemed necessary for the benefit of the City, and authorize and direct the Mayor to execute the agreement.
