JOINT RESOLJTION OF THE CITY C~)UNCIL AND THE
REDEVELOPM ~IT AGENCY OF THE CITY OF CHULA VISTA
AUTHORIZING ILING AN APPLICATION FOR {~P, ANT FUNDS FROM
THE SOLID W,~ ]'E DISPOSAL SITE CLEAN UP ' {UST FUND FOR THE
CLEAN UP OF HE HOLDING SITE LOCATED ~ I' 4075 OTAY VALLEY
ROAD WITHIN 'HE OTAY VALLEY ROAD REDI /ELOPMENT PROJECT
AREA; AND CER' FYING THE APPLICANT WILL H/ /E MATCHING FUNDS
FOR THE PROJE(;T; AND DESIGNATING THE EX CUTIVE DIRECTOR AS
AGENT FOR THE PROJECT
WHEREAS, there exis s in the Otay Valley Road i:',edevelopment Area a stockpile of
contaminated waste which the ;ity/Agency has a potential op 3ortunity to remediate in November,
2000 due to the anticipated clos Jre of the Gray Valley Landfill; nd
WHEREAS, Assembly E ill 2136 that authorizes the Cai ornia Integrated Waste Management
Board (the Board) to initiate an( administer a program for clear up of solid waste disposal sites and
for clean up of solid waste a co-disposal sites where the responsible party either cannot be
identified or is unable or unwill ng to pay for timely remediati( and where clean up is needed to
protect public health and safety )rthe environment; and
WHEREAS, said proce(ure established by the Board r uires the City/Agency to certify by
resolution the approval of applic ~tion before submission of said application to the State of California;
and
WHEREAS, if a grant is awarded the City/Agency will e~ ~ter into an agreement with the State
of California as required by the ;alifornia Integrated Waste Ma~ agement Board;
NOW, THEREFORE, BI IT RESOLVED that the City C uncil and Redevelopment Agency of
the City of Chula Vista do hereb,
1) Approve the filing ol m application for the clean u~ of solid waste using grant
funds from the Solid Waste Disposal Site Clean up Trust Fund for the stockpile
site at 4075 Otay Mai !ey Road;
2) Certify that said appl cant will have matching funds fl ,r the project;
3) Certify that said app icant will have sufficient funds lo operate and maintain the
project; and
4) Appoint the ExecutN e Director as agent of the Cib of Chula Vista City Council
and Redevelopment Agency to conduct all negotia' ons, execute and submit ail
documents includin, l, but not limited to applications, grant agreements,
amendments, paymE nt requests, which may be nec ~ssary for the completion of
the project.
