RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA APPROVING AGREEMENT BETWEEN THE CITY OF CHULA
VISTA AND THE CITY OF NATIONAL CITY FOR THE SWEETWATER
VALLEY TRAFFIC STUDY
AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT
The City Council of the City of Chula Vista does hereby
resolve as follows:
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Chula Vista that that certain agreement between THE
CITY OF CHULA VISTA, a municipal corporation, and THE CITY OF
NATIONAL CITY for the Sweetwater Valley Traffic Study
dated the 27th day of January , 1987, a copy of which is
attached hereto and incorporated herein, the same as though fully
set forth herein be, and the same is hereby approved.
BE IT FURTHER RESOLVED that the Mayor of the City of
Chula Vista be, and he is hereby authorized and directed to
execute said agreement for and on behalf of the City of Chula
Vista.

AND CITY OF CHULA VISTA
REGARDING SWEETWATER VALLEY TRAFFIC STUDY
THIS AGREEMENT, executed this 27th day of January , 1987, by
and between the City of Chula Vista, a municipal corporation, and the City of
National City, a municipal corporation.
WITNESSETH:
WHEREAS, the City of Chula Vista and City of National City wish to jointly
participate in a Traffic Study for the Sweetwater Valley; and
WHEREAS, the Study will be used to guide the City of Chula Vista and City
of National City in:
1. Establishing conditions for development of future projects;
2. Developing the Capital Improvement Program in the area; and
3. Preparing future General Plan amendments.
WHEREAS, the City of National City has approved the expenditure of ~20,000
for the Study; and
WHF~EAS, the City of Chula Vista has budgeted $50,000 for the Study; and
~EREAS, the County of San Diego has budgeted ~30,000 for the Study, and
has already entered into a participation agreement with the City of Chula
Vista who will act as lead agency; and
WHEREAS, the City of Chula Vista and City of National City desire to
specify herein the terms and conditions by which the Study will be
accomplished o
NC~;, THEREFORE, IT IS MUTUALLY AGREED by and between the City of Chula
Vista and the City of National City as foll¢~,s.~
1. ~ae City of Chula Vista will hire a traffic eng~ecr~r~g consultant to
prepare the Sweetwater Valley Traffic Study.
2. The boundaries of ~-the Sweetwater Valley Traffic Study Area are Route
54 on the north between 1-805 and proposed Route 125, 1-805 on the
west between Route 54 and East "H" Street, proposed Route 125 on the
east between Route 54 and approximately Blacksmith Road, and the
hills south of Bonita Road on the south (an approximate line between
the 1-805/East "H" Street, and the Route 125/Blacksmith Road
interchanges ).

3. The Study shall include, but not be limited to, the following
elements and considerations:
a. Existing traffic volumes
b. Future traffic projections
c. Capacity and levels of service for street segments and
intersections
d. Existing and proposed street classifications and master plan
alignments.
e. Existing and projected bottleneck areas
f. Accident and safety analysis
g. Innovative concepts to improve traffic flow and/or safety in the
study area
h. Environmental considerations
i. Project funding sources and limitations
j. Cost vs. benefit analysis
k. Signal, signal systems and signal timing improvements

4. The City of National City will be given the opportunity to provide
representatives to participate in the policy co~ittee, staff
technical committee and the consultant selection process.
5. The cost of the proposed study, estimated at ~100,000, will be shared
by the City of Chula Vista, the County of San Diego, and the City of
National City. The County will contribute up to a maximum of
930,000, the City of Chula Vista will contribute up to a maximum of
$50,000, and the City of National City will contribute the remainder,
up to a maximum of ~20,000.
6. If the total cost of the study is less than ~100,000, the City of
National City will contribute 20% of the total project costs.
7. The City of National City will pay to the City of Chula Vista
one-half of City of National City's share at such time as City of
Chula Vista executes Agreement with consultant and one-half when City
of Chula Vista accepts final report from consultant.
8. A. The City of National City, its agents, officers and employees
shall not be held liable for any claims, liabilities, penalties,
fines, or for damage to any goods, properties or effects or any
person whatsoever, nor for personal injuries to, or death of
anyone, caused by or resulting from any negligent acts or
omissions of City of Chula Vista, or its agents, employees, or
representatives including liability resulting from the acts or
omissions of ~the City of Chula Vista, its agents, employees, or
representatives, which may occur by reason of any work specified
in this Agreement.

B. The City of Chula Vista further agrees to defend and indemnify,
and save free and harmless City of National City and its
authorized agents, officers and employees against negligent acts
or omissions of the City of Chula Vista, its agents or
employees, alleged to have occurred by reason of any work
specified in this Agreement, and any cost and expenses incurred
by the City of Chula Vista on account of any claim therefor.
9. This Indemnity Agreement is not limited in any way by the extent of
any insurance policy currently in force and held by either party.
10. This Agreement may not be modified, amended or otherwise changed
unless by an amendment, in writing, executed by both parties.
11. This Agreement shall terminate after the Sweetwater Valley Traffic
Study has been completed and the City of National City has
contributed $20,000 or 20% of total project cost whichever is less to
the City of Chula Vista for its share of the costs.
IN ~TNESS WHEREOF, this Agreement is executed by the City of National
City pursuant to action taken by the City Council, and by the City of Chula
Vista pursuant to action taken by the City Council.

known as the Bonita Bead Corridor Study and approved by the City Council on
July 1, 1986.

In 1985, the City Council approved the expenditure of $50,000 in the FY
1985-86 CIP as the City's share to conduct a traffic study in the Sweetwater
Valley. This study will be a joint effort by Chula Vista, the City of
National City, the County of San Diego, and CalTrans and will be done through
a traffic and transportation consultant. This agreement specifies the terms
and conditions for the study between Chula Vista, acting as the lead agency,
and National City.
RECOMMENDATION: That Council adopt the attached resolution approving an
agreement between the City of National City and the City of Chula Vista for
the Sweetwater Valley Traffic Study.
BOARDS/COMMISSIONS RECOMMENDATION: Not applicable
DISCUSSION:
The attached agreement is being submitted to the City Council of National City
concurrent with our action. The agreement is necessary to outline the terms
and conditions between Chula Vista and National City for the conduct of thestudy
and should be accomplished beforea consultant contract can be awarded.
In June 1986, a similar agreement between the County of San Diego and the City
of Chula Vista was approved by the City Council and the Board of Supervisors.
CalTrans will be participating in the study with staff resources but not
funding. Therefore, no agreement is necessary.
The City of Chula Vista is the lead agency for this project. A policy
Committee, a staff technical committee and a consultant selection committee
have been established. Requests for proposals were sent to qualified traffic
engineering consulting firms and a total of eight proposals were submitted.
The four best qualified firms were interviewed by the selection committee on
January 22, 1987, and a consultant was approved by the Policy Committee on
January 26, 1987. A contract with this consultant will be prepared and
submitted to the Council for award within the next two weeks. It is estimated
that the study will be completed in approximately 6 months, or August 1987.

FISCAL IMPACT: The total estimated cost of the study is not to exceed
$100,000 and will be shared by the City of Chula Vista ($50,000), the County
of San Diego ($30,000), and the City of National City ($20,000). The City's
share ($50,000) is budgeted in the FY 1985-86 Capital Improvement Budget.
