QUICK FOR CONSULTANT SERVICES TO PERFORM FINGERPRINT EXAMINATION AND CLASSIFICATION AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT The City Council of the City of Chula Vista does hereby resolve as follows: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista that that certain agreement between THE CITY OF CHULA VISTA, a municipal corporation, and RICHARD L. QUICK for consultant services to perform fingerprint examination and classification dated the ]6th day of December , 198 6, a copy of which is attached hereto and incorporated herein, the same as though fully set forth herein be, and the same is hereby approved. BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista be, and he is hereby authorize~ and directed to execute said agreement for and on behalf of the City of Chula Vista. DATED City Clerk CITY OF FHULA VISTA CC-660 CONSULTING SERVICES AGREEMENT THIS AGREEMENT is made at Chula Vista, California as of January 1, 1987, by and between the CITY OF CHULA VISTA, a municipal corporation ("City") and RICHARD L. QUICK ('Contractor"), who agree as follows: 1. Subject to the terms and conditions set forth in this Agreement, Contractor shall provide to the City the services described in Exhibit A1 which is, by this reference, incorporated herein. Contractor shall provide said services at the time, place, and in the manner specified in Exhibit Al. 2. Payment. City shall pay contractor at the rate of ~25.00 per hour for services rendered pursuant to this Agreement. Said amount shall be the total compensation paid for work performed under this Agreement. The total compensation for this agreement shall not exceed ~18,000. Contractor shall provide City with a bi-%~eekly statement of the total hours worked, on the day following the end of each pay period as defined by the City. Compensation for these services should be paid bi-weekly. 3. Exemption from Civil Service. It is expressly agreed and understood by City and Contractor that this Agreement and the rendition of services hereunder is specifically exempted from Civil Service of the City of Chula Vista. The parties to this Agreement agree that Contractor is a professional person, in business for himself, and that the relation created by this contract is that of employer-independent contractor. Contractor is not an agent or employee of the City and is not entitled to benefits provided by the City to its employees, including but not limited to health insurance and unemployment insurance. 4. General Provisions. (a) Except as otherwise provided in Exhibit Al, this contract shall be based on the performance of the Contractor to the satisfaction of the Director of Public Safety. (O) This Agreement shall commence on the date first stated above and shall continue thereafter through December 31, 1987. -1- (c) This Agreement may be terminated by City or by Contractor upon 15 days written notice to the other party. Quick Approved as to form by Date December 26. 1986 I L' / ~ ,s ty'AttorM, EXHIBIT A1 SCOPE OF WORK ASSIGNMENT It is intended that the Contractor shall apply his full time, during the hours of employment to the technical and professional processes of Fingerprint Examination and Classification and, as may be required by judicial process, the appearance in Court for the purpose of testifying as a recognized expert in such matters. 1. Work shall be of the type and quality usually performed by a court recognized expert in the art of fingerprint examination and classification in identifying from fingerprint cards and latent prints the points of comparison to make legal identification of criminal suspects, to prepare the court exhibits for use in courtroom presentation of evidence, to testify to the methods used and the processes used for comparison and to do other related work as may be required. 2. The hours of work and the time spent shall be at the discretion of the Contractor unless otherwise directed by the required response to a criminal subpoena. The number of hours to be devoted to the examination and comparison of fingerprints or latent print evidence shall not exceed Fifteen (15) hours per week unless specific approval of the Director of Public Safety or his designee be obtained prior to the performance of said work and in such event the extended hours shall be directly related to articulable high priority matters. Response to and performance of assigned duties as a court witness shall not be a part of the fifteen (15) hour weekly work limit but may be considered in possibly reducing the number of hours to be worked in subsequent pay periods. 3. The place of employment, except for court ordered appearances, shall be the Chula Vista Police Dep~rtment. 1067a COUNCIL AGENDA STATEMENT Item 8 Meeting Date 12/i6/86 ITEM TITLE: Resolution/~-Approving Agreement for Consultant Services to Perform Fingerprint Examination and Classification SUBMITTED BY: Director of Public Safety (4/Sths Vote: Yes No XX) REVIEWED BY: City Manage~ On December 17, 1985, the Council passed Resolution 12314, which was a Contractual Agreement with Richard Quick for consultant services to perform fingerprint examination and classification. This agreement terminates December 31, 1986. RECOMMENDATION: That Council adopt Resolution approving the agreement and authorize the Mayor to sign on behalf of the City Council BOARDS/COMMISSIONS RECOMMENDATION: N/A DISCUSSION: During 1986, Richard Quick's fingerprint analysis work has identified suspects in eight-eight (88) cases. Also, Quick is teaching techniques of court testimony to civilian Evidence Technicians Rodrigo Viesca and Mary Kay Roberg, who are not court qualified and have not testified in court. The primary justification for this agreement with Quick was to provide the Police Department with his expert fingerprint services until we trained his civilian replacements. His successors, Evidence Technician Rodrigo Viesca, was hired March 22, 1985, and Mary Kay Roberg, was hired May 12, 1986. Prior to that time neither of them had any fingerprint classification experience. Both have been receiving training and experience since their respective hire dates, but neither is a skilled fingerprint examiner/classifier. During 1986 the Police Department has experienced a significant increase in work load due to the Montgomery Annexation and the increase in the crime rate. This has placed a heavy burden on our Evidence Technicians and minimized opportunities for them to receive training to improve their fingerprint examination and classification skills. Additional training, not originally anticipated, concerns the statewide CAL I.D. System which provides latent fingerprint search capabilities. It employs a high speed, computerized scan and comparison of latent prints, having no known suspect, against a data base of known offenders. Roberg is assigned this responsibility, requiring weekly trips to the San Diego Police Department based computer for CAL I.D. tracings, photographing and data entry. This system will enhance our latent fingerprint identifications immensely and has already identified seven suspects. Form A-113 (Rev. 11/79) 8 Page 2~ Item Meeting Date 12/16/86 When this contract was approved last year, staff advised Council that 1986 would be the last year for this service. Due to the significant increases in crime and work load in 1986, staff has reconsidered our position and we feel that we should extend this contract through 1987. This extension will enable staff to maintain our high level of fingerprint service with the clear understanding that 1987 will be the final year. This contract will provide for a maximum of 720 hours annually at $25. per hour. FISCAL IMPACT: Annual cost for the program is $18,000. For fiscal year 1986-87 the $9,000 is available in the police budget from salary savings.
