COSTS AND REIMBURSEMENT AGREEMENT FOR / ~_ CONSTRUCTION OF STREET AND DRAINAGEI nn~,~v L ~,~-~ q~.gZOI~MPROVEMENTS IN LAS FLORES DRIVE AND D L STREET BETWEEN SECOND AVENUE AND MINOT AVENUE The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the City Council of the City of Chula Vista has directed its staff to proceed with the formation of the Las Flores Drive/D Street reimbursement district, and WHEREAS, the City Engineer has notified the property owners within the Las Flores Drive/D Street reimbursement district boundaries of the proposed areas of benefit, of the costs to be reimbursed from such property owners, the basis for the cost of public improvements and the estimates of the assessments which the owners of each parcel must pay upon its development, and WHEREAS, the City Council of the City of Chula Vista has held a public hearing following written notice to the property owners within the proposed Las Flores Drive/D Street reimbursement district boundaries, all in the form prescribed by Chapter 15.50 of the Chula Vista Municipal Code, and WHEREAS, the City Council of the City of Chula Vista has considered all objections, protests and testimony presented at such public hearing by and on behalf of affected property owners, and WHEREAS, following due deliberation upon the recommendations of the City Engineer, and the consideration of all protests to the reimbursement charges, the City Council of the City of Chula Vista has directed the City Engineer to proceed with the formation of the Las Flores Drive/D Street reimbursement district of the final allocation of costs constituting the statement of reimbursement charges to be paid by the owners of each benefited property within the reimbursement district upon the issuance of a building permit or an application for subdivision of land and has directed the City Engineer to prepare for Council consideration a reimbursement agreement. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista that: 1. The Las Flores Drive/D Street reimbursement district is hereby established encompassing the real property more particularly described in Exhibit "A", which exhibit is incorporated herein by reference. -1- 441 2. The final allocation of costs is $345,259.20, which sum shall constitute for all purposes the reimbursement charges established against the owners of the properties described. 3. The City Clerk is authorized an~ hereby directed to record this resolution and the attached final allocation of costs with the office of the County Recorder of San Diego County pursuant to the ownership of record of the affected parcels within the area of benefit as shown on the last equalized assessment roll for the purposes of providing notice of the charges assessed against the parcels to the owners, their heirs, successors and assigns. 4. Of the $345,259.20 total costs for construction, the city deems that its contribution shall be $78,133.38. The City is therefore entitled to recover $267,125.82 which was advanced to install the improvements in D Street and Las Flores Drive. 5. The Director of Building and Housing is hereby authorized and directed to collect prior to the issuance of building permits $267,125.82 plus seven percent (7%) simple interest per annum from July 1, 1986 from the owners of the parcels included within the district or their heirs, successors and assigns. 6. The Director of Public Works is hereby authorized and directed to collect said reimbursement charge at such time as the land is subdivided and/or developed. I-~ft I i IJi I: ;1 !i jl If u , '3 o (l <: COUNCIL AGENDA STATEMENT Item 29 Meeting Date 12/16/86 ITEM TITLE: Public hearing on formation of a reimbursement district for construction of street and drainage improvements in Las Flores Drive and "D" Street between Second Avenue and Minot Avenue in the City of Chula Vista, CA Resolution /~ Establishing a reimbursement district for construction of street and drainage improvements in Las Flores Drive and "D" Street between Second Avenue and Minot Avenue SUBMITTED BY: Director of Public Works/City Engineer ,~ REVIEWED BY: City Manager~ 14/5th$ Vote: Yes__No X ) On November 25, 1986, the City Council by Resolution 12833 ordered a public hearing to be held December 16, 1986, on the formation of a reimbursement district for construction of street and drainage improvements in Las Flores Driw and "D" Street between Second Avenue and Minot Avenue. The reimbursement district is necessary so that the City will be reimbursed $267,125.82 advanced for the construction of public improvements adjacent to various parcels along Las Flores Drive and "D" Street. RECOMMENDATION: That the Council: a. Conduct the public hearing, and b. Adopt the resolution establishing the reimbursement district. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: On July 16, 1985, the City Council by Resolution 12102 awarded a contract to R.E. Hazard Contracting Co. for construction of street and drainage improvements in Las Flores Drive and "D" Street between Second Avenue and Minot Avenue. The project included the construction of a 20 ft. wide ribbon pavement, storm drain, curb, gutter, sidewalk ramps, and masonry retaining wall. Funds for this project were approved in the FY 1984-85 Capital Improvement Program budget with the understanding that the cost for those portions of the improvements installed adjacent to properties would be reimbursed to the C~tv through a reimbursement district when the land is subdivided and/or developed. Chapter 15.50 of the City Code contains the procedures for establishment of a reimbursement district which assures that a benefited property owner reimburses the City for the cost incurred when providing public improvements benefiting their property. Page 2, Item 29 Meeting Date-T2-/1-671)6 The attached drawings show the boundary of the district and the estimated reimbursement cost to the City for each parcel therein. These drawings are considered a part of this resolution. Once the allocation of cost has been approved by the City Council, the City Clerk shall record a copy of the Council's resolution with the County Recorder. The resolution shall include the ownership of record, the legal description, and the amount of charges for each lot or parcel within the district. The reimbursement shall be collectable by the City at either the time the property is to be subdivided or upon a request for a building permit for development of the property. In addition to the cost levied, simple interest in the amount of 7% per year is to be paid to the City up to a period of 20 years. Interest to start from July 1, 1986. Seven of the parcels within this reimbursement district had deferrals with the City for the construction of various public improvements. These property owners entered into agreements with the City to have their deferred improvements installed by the contractor. After formation of the reimbursement district, formal agreements will be prepared for Council approval with these property owners to pay the City back over the next ten years for monies advanced for installation of the deferred improvements. The balance of charges against the seven parcels with deferrals will be collected under the reimbursement district. The City Clerk has duly notified the property owners and published the required notices for this public hearing. In addition to the public hearing notice, a copy of the reimbursement district drawings consisting of three sheets and a letter explaining the reimbursement district and their individual cost was sent to each property owner. The first sheet of the drawings shows the boundary of the assessment district, the second shows the cost for construction of the improvements, and the third shows the cost for the various improvements attributed to each of the owners. Subsequent to Council's establishment of the reimbursement district, the City Clerk will record a copy of the Council's resolution along with the attached drawings with the County Recorder. The total cost for the construction of the improvements in the area was $345,259.20. The City is contributing $78,133.38 towards these improvements. The City's contribution generally covers the construction of the improvements in "D" Street from Second Avenue easterly to Las Flores Drive {south). In addition, the City is paying for relocation of street light facilities and the improvements adjacent to Assessor's Parcel No. 566-251-24, which is an existing improved parcel which has no access to Las Flores Drive. FISCAL IMPACT: The City will recover $267,125.82 which was advanced to install the improvements in "D" Street and Las Flores Drive. The funds will be repaid as property within the reimbursement district develops.
