HomeMy WebLinkAboutcc min 1968/09/03 MINUTES OF A REGULAR MEETING OF T~E CITY COUNCIL OF THE CITY OF CHULA VISTA, CALIFORNIA Held Tuesday September 3, 1968 A regular meeting of the City Council of the City of Chula Vista was held in the Council Chambers on the above date at 7:00 P.M., with the following Councilmen present: Councilmen Sylvester, Hamilton, McCorquodale, McAllister, Scott Absent: None Also present: City Attorney Lindberg, Administrative Officer Ross, City Engineer Cole, Planning Director Warren Mayor M~Corquodale led the pledge of allegiance to the Flag, followed by a moment of silent prayer. APPROVAL OF COUNCIL MINUTES It was moved by Councilman Sylvester, seconded by Councilman Scott, and carried that the minutes for the meeting of August 27, 1968, be approved, copies having been sent to each of the Councilmen. REPORT FROM PORT COMMISSIONER Port Co~uissioner C. R. Campbell gave a summary report on the highlights of those projects now under way and those contemplated in the near future by the Unified Port District. Mayor McCorquodale suggested that reports be given on a quarterly basis in the future. PUBLIC HEARING - Considering the appeal of K. F. Augustine from Planning Commis- sion action denying zone change This being the time and place, as advertised, for a hearing on the appeal of K. F. and R. J. Augustine from Planning Corm~ission action denying a zone change from R-1-B-20-D to R-3-B-2-D for property located on Sweetwater Road west of the intersection with Central Avenue, Mayor McCorquodale declared the hearing open. Mr. K. F. Augustine and Mr. R. J. Augustine, 3608 Valley Vista Road, Bonita, spoke in support of their appeal and urged the Council to override the action of the Planning Commission, Mr. Augustiae read a letter from Merle Palmer supporting the rezoning. Mr. Robert Keyes~ 1015 Melrose Avenue~ representing the owner of the property in question, spoke in favor of the rezoning. Admiral Kyle Bull, speaking for himself and residents of Bonita Woods, spoke in opposition to the rezoning and requested that Planning Commission action be upheld. General Lara P. Good, 4610 Swectwater Road, spoke in opposition to the rezoning. No others wishing to be heard and the Clerk having received no written communications, thc MAyor declared the hearing closed. It was moved by Councilman Sylvester, seconded by Councilman Scott, and carried that the action of the Planning Commission be sustained and the appeal denied. ORDINANCE NO. 1144 - Prezoning of Layton Annexation - First reading It was moved by Councilman McAllister that this ordinance be placed on its first reading and that reading of the text be waived by unanimous consent. The motion carried by the following vote, to-wit; AYES: Councilmen McAllister, Scott, Sylvester Noes: Councilmen Hamilton, McCorquodale Absent: None ORDINANCE N~Rezoning property at 70 East "J" Street - First reading It was moved by Councilman Scott that this ordinance be placed on its first reading and that reading of the text be waived by unanimous consent. The motion failed to carry by the following vote, to-wit: AYES: Councilman Scott Noes: Councilmen Sylvester, Hamilton, McCorquodale, McAllister Absent: None City Attorney Lindberg stated that no further action is required at this time by the Council concerning abatement proceedings on the present non-conforming use of the property. ORDINANCE NO. 1140 - Approving change in setbacks on Del Mar Avenue - Second reading and adoption It was moved by Councilman Sylvester that this ordinance be placed on its second reading and that reading of the text be waived by nnanimous consent. The ordinance was adopted by the following vote, to-wit: AYES: Councilmen Sylvester, Hamilton, McCorquodale, McAllister, Scott Noes: None Absent: None ORDINANCE NO. 1141 - Approving zone change for property west of 772 Third Avenue and north of "K" Street It was moved by Councilman Scott, seconded by Councilman Sylvester, and carried that action on this ordinance be held over one week. ORDINANCE NO. 1142 - Approving Trusty's Frontage Road Annexation - Second reading and adoption It was moved by Couucilman Sylvester that this ordinance be placed on its second reading and that reading of the text be waived by unanimous consent. The ordinance was adopted by the following vote, to-wit: AYES: Councilmen Sylvester, Hamilton, McCorquodale, McAllister, Scott Noes: None Absent: None RESOLUTION NO. 4895 - Authorizing negotiation and condemnation proceedings for Rienstza property Offered by Councilman McAllister~ the reading of the text was waived by unanimous consent, passed and adopted by the following vote, to-wit; AYES: Councilmen McAllister, Scott, Sylvester, Hamilton, McCorquodale Noes: None Absent: None RESOLUTION NO. 4896 - Accepting bids and awarding contract for purchase of fire truck Offered by Councilman MeAllistar, the reading of the text was waived by unanimous consent, passed and adopted by the following vote, to-wit: AYES: Councilmen McAltister, Scott, Sylvestcr, Hamiltoa, McCorquodale Noes: None Absent: None It was suggested by Councilman Sylvester that the staff contact Fire Districts in the County to determine if one might be interested in purchasing t the fire truck to be traded in. The Mayor asked for a report on this. RESOLUTION NO. 4897 - Accepting bids and awarding contract for a lined drainage channel between "J" Street and Sierra Way Offered by Councilman Scott, the reading of the text was waived by unan- imous consent, passed and adopted by the following vote, to-wit: AYES: Councilmen Scott, Sylvester, Hamilton, McCorquodale, McAllister Noes: None Absent: None RESOLUTION - Opposing proposed tax exemption bill - Household furnishings and personal effects Offered by Councilman Mc~lllster~ the reading of the text was waived by unanimous consent, the resolution failed to carry by thc following vote~ to-wit: AYES: Councilman McAllister Noes: Councilmen Scott, Sylvester, Hamilton, McCorquodale Absent: None /DATE SET FOR HEARING ON APPEAL OF PLANNING CO~ISSION ACTION DENYING TENTATIVE MAP OF PRINCESS MANOR SUBDIVISION UNIT NO. 6 A letter was submitted from the Planning Commission setting forth reasons why the Cor~nission denied the tentative map of Princess Manor Unit No. 6 Subdivi- sion. Administrative Officer Ross stated an appeal has been received from Mr. Robert L. Bergen~ Attorney representing Princess Park Estates, Inc., and recom- mended that the matter be set for public hearing. It was moved by Councilman McAllister, seconded by Councilman Hamilton, and carried that the Clerk be directed to set the matter for hearing on Septembe~ 17, 1968 at 7:00 P.M. P~ESOLUTION NO. 4898 - Proclaiming the week of September 8 through 14 as Pop Warner Week Offered by Councilman Scott, the reading of the text was waived by unan- imous consent, passed and adopted by the following vote, to-wit: AYES: Councilmen Scott, Sylvester, Hamilton, McCorquodale, McAllister ~oes: None Absent: None 'REQUEST FOR BLOCK PARTY A letter was read from Mrs. Don Sipes, 543 Berland Way, requesting per- mission to use the eastern end of Berland Way for a block party to be held Sep- tember 21, 1968. It was moved by Councilman Sylvester, seconded by Councilman Scott, and carried that the matter be referred to Administrative Officer Ross for report. ~ REQUEST FOR SUPPORT FOR PARTICIPATION IN COUNTY-WIDE FIRE COMMUNICATIONS NETWORK A letter was read from Fire Chief Lee requesting that the Council submit a favorable statement to the County Board of Supervisors affirming the City of Chula Vista's support to participate in a County-wide fire communications net- work. Referred to staff together with letter from the San Diego County Fire Chiefs' Association letter of August 16, copies having been sent to each Council- LETTER OF COMMENDATION A letter was read from Eleanor Kinney and Pat Schneeman commending the Chamber of Commerce for their part in their active participation in the "Remember the Pueblo Day" boat parade held Sunday~ August 25, 1968. ~//REQUEST FOR FUNDS TO REFURBISH FLOWER BASKETS ON THIRD AVENUE A letter was read from the Downtown Association requesting that the Council appropriate the necessary funds to refurbish the flower baskets along Third Avenue and a portion of '~" Street. Referred to Administrative Officer Ross for report back at the next meeting. INVITATION TO SWIM MEET FOR PRESENTATION OF AWARDS Mr. Gene Martin, President of the Chula Vista Aquatic Association, invited Councilmen to attend the open swim meet to be held at the Chula Vista Plunge on September 14~ and 15~ to help with the presentation of awards.
