HomeMy WebLinkAboutcc min 1969/01/07 MINUTES OF A BEGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA~ CALIFORNIA Held Tuesday January 7, 1969 A regular meeting of the City Council of the City of Chula Vista was held in the Council Chamber on the above date at 7:00 P.M., with the following Council- men present: Councilmen Sylvester, Hamilton, McCorquodale, McAllister, Scott Absent: None Also present: City Attorney Lindberg, Administrative Officer Ross, City Engineer Cole, Planning Director Warren Mayor McCorquodale led the pledge of allegiance to the Flag. The invocation was given by Rev. Lauren Egdahl of St. Marks Lutheran Church. APPROVAL OF COUNCIL MINUTES It was moved by Councilman Sylvester, seconded by Councilman Scott, and carried that the minutes for the meeting of December 30, 1968, be approved, copies having been sent to each of the Councilmen. REPORT FROM PORT CO~4ISSIONER Port Cormnissioner C. R. Campbell gave his monthly surmnary report on Port District activity. PUBLIC HEARING (continued) - Appeal of Mrs. Charles Smith and Alvin May of Plan- ning Co~nission action granting conditional use permit to Willard Layton for mobile home park This being the time and place designated for continuation of the hearing on the appeal of Mrs. Charles Smith and AlvinMay of Planning Commission action granting a conditional use permit to Willard Layton for a mobile home park on property located on the north side of Otay Lakes Road approximately 600 feet south of Acacia Avenue, Mayor McCorquodale declared the hearing reopened. Mr. Cliff Burford, representing the owner of the property, stated they wish to with- draw their application for a conditional use permit for a mobile home park on this property. No others wishing to be heard, the Mayor declared the hearing closed. It was moved by Councilman Hamilton, seconded by Councilman Sylvester, and carried that the offer of withdrawal be accepted. Proceedings were terminated upon the request of the applicant and no further action will be taken on this request. PUBLIC HEARING (continued) - Appeal of John Holz of Planning Commission action denying him~permit to convert garage at 972 Nolan Way from a two- car to a one-and-one-half-car garage This being the time and place designated for the continuation of the hearing on the appeal of John Holz of Planning Cormmission action denying him a permit to convert garage at 972 Nolan Way from a two-car to a one-and-one-half- car garage, Mayor McCorquodale declared the hearing reopened. Mr. Steve Picard, representing National Housing Company and the owner, and Mr. John Holz, 972 Nolan Way, spoke in support of the appeal and urged the Council to grant the permit. No others wishing to be heard, the Mayor declared the hearing closed. Findings of the Planning Commission were read to the Council. It was moved by Councilman Sylvester, seconded by Councilman Scott, and carried that the appeal be granted and the City Attorney directed to prepare for the next meeting the necessary resolution. It was moved by Councilman Scott, seconded by Councilman McAllister, and carried that the Planning Commission be directed to study the ordinance pertain- ing to the requirement for two-car garages in an attempt to make the requirements more flexible. PUBLIC HEARING - Prezoning and rezoning of Layton's Otay Lakes Road Annexation This being the time and place, as advertised, for a hearing on the pro- posed rezoning and prezoning of Layton's Otay Lakes Road Annexation, Mayor Mc- Corquodale declared the hearing open. Mr. Cliff Burford, representing the owner and applicant of the property, stated they wished to withdraw their application for prezoning of this property and also to withdraw the tentative map. Mr. Frank Serras, 4375 Acacia Avenue, requested that the zoning be left as it now is. No others wishimg to be heard, the Mayor declared the hearing closed. It was moved by Councilman McAllister, seconded by Councilman Sylvester, and carried that the applicant's request that all proceedings be terminated on the prezoning application be §ranted° PUBLIC HEARING - Rezoning property south of San Diego Gas & Electric Company right-of-way approximately 630 feet west of Hilltop Drive This being the time and place, as advertised, for a hearing on the pro- posed rezoning fromM-1 to R-2 of property south of San Diego Gas & Electric Company right-of-way approximately 630 feet west of Hilltop Drive, Mayor McCor- quodale declared the hearing open. Mr. J. H. Olds, 3730 Festival Court, asked that the request for rezoning to R-2 be denied and that separate action be taken to rezone the property from M-1 to R-i, as requested in that certain petition presemted at the Planning Com- mission hearimg and bearing 75 signatures. Mr. Roy Huntington, 3746 Holiday Court, also spoke in opposition to the rezoning. Mr. Jack Gardner~ one of the developers of the property, spoke in favor of the application for rezoning. The findings of the Planning Co~m~ission were read to the Council. No others wishing to be heard, the Mayor declared the hearing closed. It was moved by Councilman Hamilton, seconded by Councilman Scott, and carried that the City Attorney be directed to prepare for the next meeting an ordinance rezoning to R-2-D that portion of the property mow covered by a condi- tional use permit and that the Planning Commission give further study to the zon- ing of the balance of the property and make recommendations to the Council. ORDINANCE NO. 1162 - Ordering, callimg, providing for and giving notice of special election to be held on March 18, 1969 for drainage facilities - First reading It was moved by Councilman McAllister that this ordinance be placed on its first reading and that reading of the text be waived by unanimous consent. The motion was carried by the following vote, to-wit: AYES: Councilmen McAllister, Scott, Sylvester, H~nilton, McCorquodale Noes: None Absent: None ORDINANCE NO. 1161 - Rezoming certain property on north side of "L" Street, east of Third Avenue - Second reading and adoption It was,~moved by Councilman Sylvester that this ordinance be placed on its second reading and that reading of the text be waived by unanimous consent. The ordinance was adopted by the following vote, to-wit: AYES: Councilmen Sylvester, Hamilton, McCorquodale, McAllister, Scott Noes: None Absent: None RESOLUTION NO. 5016 - Accepting grant of easement for drainage purposes at River- lawn Avenue and Sierra Way Offered by Councilman McAllister, the reading of the text was waived by unanimous consent, passed and adopted by the following votes to-wit: AYES: Councilmen McAllister, Scott, Sylvester, Hamilton, McCorquodale Noes: None Absent: None ~ COMPLAINT ON DRAINAGE PROBLEM Mrs. R. W. Bastido, 843 Riverlawn Avenue, stated that nothing has been done to alleviate the drainage problem in the 800 block of RiverlawnAvenue as recommended at the meeting of November 5, 1968. City Engineer Cole stated bids have been accepted on the complete relining of the channel and that work should start immediately. RESOLUTION NO. 5017 - Waiving bidding requirements for locker room remodeling at Chula Vista Recreation Center Offered by Councilman Hamilton, the reading of the text was waived by unanimous consent, passed and adopted by the following vote, to-wit: AYES: Councilmen Hamilton, McCorquodale, McAllister, Scott, Sylvester Noes: None Absent: None RESOLUTION NO. 5018 - Approving agreement with First Christian Church for storm drain installation at 430 Second Avenue Offered by Councilman Scott, the reading of the text was waived by unani- mous consent, passed and adopted by the following vote, to-wit: AYES: Councilmen Scott, Sylvester, Hamilton, McCorquodale, McAtlister Noes: None Absent: None CONSIDERATION OF TENTATIVE MAP OF PRINCESS MANOR SUBDIVISION, UNIT NO. 6 Upon the request of the subdividers~ it was moved by Councilman Scott, seconded by Councilman Sylvester, and carried that this item be held over one week. ~,~ WAIVER OF SWIMMING POOL FENCE REQUIREMENTS GRANTED - 210 Quintard Street Administrative Officer Ross stated a request has been received from John C. Noble Company requesting modification of the pool fencing ordinance for the apartment complex at 210 Quintard Street. Subject to certain conditions, the Building and Housing Department has recommended approval. It was moved by Councilman McAllister, seconded by Councilman Scott, and carried that the request be granted, subject to all recommendations of the Department of Building and Housing. APPLICATION FOR DANCE PERMIT - Christie's Administrative Officer Ross stated an application for a license for danc- ing at Christie's Restaurant has been received from Mr. William Whitehead. A repot from the Police Department and one from the Fire Department indicated that all requirements of the code have been met. The Mayor questioned issuing a license to the establishment because a dance had been held on New Year's Eve without a license to do so. Mr. Whitehead stated he considered the dance a private party, did not know a license was needed for this type of a dance, and went ahead and held the dance even though told by City authorities that he should not do so. After discussion, it was moved by Councilman Scott, seconded by Council- man Hamilton, and carried that the matter be tabled for 30 days. Councilmen Sylvester and McAllister voted no. ~ MAYOR'S REPORT Mayor McCorquodale reviewed his written report on projections for 1969, dated January 7, 1969. MOVE OF PBX OPERATOR TO CENTER OF BUILDING REQUESTED Mayor McCorquodale moved that the Council establish the policy of moving the PBX operator from the Police Department to the center part of the bU~ilding, to be available for an information center for people coming into the Civic Center. Motion died for lack of a second. It was moved by Councilman Scott, seconded by Councilman Hamilton, and carried that the staff be directed to look into the feasibility of moving the PBX board to the center of the building and report back to the Council in one month. Councilmen Sylvester and McCorquodale voted no. ~,/'LETTER OF RESIGNATION A letter was read from Dan Putnam tendering his resignation as a member of the Library Board. It was moved by Councilman Sylvester, seconded by Council- man Hamilton, and carried that the letter be accepted with regret and a letter written to Mr. Putnam expressing appreciation for his service on the Board. REQUEST FOR STUDY ON THE CITY'S ETHNIC PATTERN A letter was read fmom the Human Relations Commission recommending that the Council direct the staff to make a study of why the City has such an extremely low percentage of minority groups living within its boundaries. Referred to staff. ~. REqUEST FOR FUNDING IN CIC A letter was read from the Human Relations Commission urging the Council to consider participating in the funding of CIC on a matching basis with the County of San Diego and with other cities in the County. Referred to staff. WARNING GIVEN ON SAN DIEGO PLANS A letter was read from W. F. Latham, Box 5, Imperial Beach, warning the City that the City of San Diego has long range plans to encircle the City of Chula Vista in order to cut off the future growth of the City. Letter filed. ~. ZONING COMMISSION SUGGESTED Mr. Fred Gelsomini~ 615 Gretchen Road, suggested that consideration be given to the forming of a Zoning Commission in order to free the Planning Commis- sion for matters pertaining to planning only. REqUEST FOR MOD/JfICATION OF ORDINANCE PERTAINING TO PARKING OF COMMERCtAL VEHICLES Mr. Ernest Arnold, 807 Beech Avenue, suggested that consideration be given to modifying the traffic code relative to the parking of commercial trucks in residential zones. He was of the opinion these trucks should not be allowed to park in these zones for more than one hour. ADJOUItNMENT Mayor McCorquodale adjourned the meeting at 10:25 P.M., sine die. City Cler~
