RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA
APPROVING THE SPENDING AUTHORIZATIONS FOR “PARKWAY AQUATIC
CENTER POOL IMPROVEMENTS PROJECT” WITH MISSION POOLS OF
ESCONDIDO INC. UP TO $595,000 AND “PARKWAY COMMUNITY CENTER
IMPROVEMENTS PROJECT” WITH MARK W. FOGLE UP TO $375,000; AND
MAKING AMENDMENTS TO THE FISCAL YEAR 2016/17 MEASURE P SALES TAX

SUMMARY
On November 8, 2017, City Council approved Resolution No. 2016-224 creating CIP
GG228 for improvements to the Parkway Community Center and Memorial Park and
allocating $775,925 of Housing-Related Parks (HRP) Program grant funding to the
project. On January 10, 2017, City Council approved Resolution No. 2017-006 awarding
contracts to Mark W. Fogle and Mission Pools of Escondido Inc. for the “Parkway
Community Center Improvements Project (CIP GG228)” and “Parkway Aquatic Center
Pool Improvements Project (CIP GG228)” respectively. Due to higher than anticipated
project costs, items were deleted from the scope of work to bring the projects within
budget. This proposed action would appropriate an additional $250,000 above the
amount originally approved by Council Resolution No. 2016-224. Funding has been
identified in the fiscal year 2017 Measure P allocation for CIP GG228. This action
would also increase the spending authorization limits for Mark W. Fogle and Mission
Pools of Escondido Inc. for the “Parkway Community Center Improvements Project (CIP
GG228)” and “Parkway Aquatic Center Pool Improvements Project (CIP GG228 )”
respectively, in order to complete the project.

(Existing Facilities) of the California Environmental Quality Act State Guidelines.

Environmental Determination
The Director of Development Services has reviewed the proposed project for
compliance with the California Environmental Quality Act (CEQA) and has determined
that the project qualifies for a Class 1 Categorical Exemption pursuant to Section 15301
(Existing Facilities) of the State CEQA Guidelines because the projects consist of
improvements to the existing Parkway Community Center building, and Parkway Pool.
Thus, no further environmental review is required.
BOARD/COMMISSION RECOMMENDATION
Measure P funds were allocated by City Council FY for 2016/2017 so no action is
needed by the Citizens Oversight Committee.
DISCUSSION
The Parkway Gymnasium and Aquatic Center are aging facilities built in the 1950s.
Many areas of the facilities are in need of rehabilitation and major maintenance or do
not comply with current building codes. A State of California Housing-Related Parks
(HRP) Program Grant was received to complete improvements to these Parkway
facilities.
The scope of the work to be done was developed collaboratively by City staff from
Recreation, Public Works, and Development Services with input from Architectural and
Pool Consultants. The facility needs were prioritized to provide the greatest benefit to
the community from the available HRP grant funds as well as meet code requirements.
The scope includes refinishing the gymnasium floor, refinishing the pool and pool deck,
ADA retrofits and improvements in the path of travel, bathrooms, and pool areas, and
painting the selected portions of the facility.
Engineering staff determined that two separate contracts, one for the building work and
one for the pool work, would be appropriate due to the diverse nature of the work of CIP
GG228. A general building contractor, Mark W. Fogle, and a commercial pool
contractor, Mission Pools of Escondido Inc., were awarded contracts for the “Parkway
Community Center Improvements Project (CIP GG228)” and “Parkway Aquatic Center
Pool Improvements Project (CIP GG228)” respectively.
The low bids exceeded the total grant funding amount. In order to bring the project
within budget and allow adequate contingency funds, optional additive bid items were
not executed and Contract Change Orders were executed for each contract eliminating
items of work. The decisions on which specific items of work would be eliminated were
made in conjunction with staff from the Recreation Department.
The work began on both projects on January 31 , 2017, and is currently underway with a
contract completion date of June 8, 2017. On April 27, 2017, a construction progress
tour was held and staff from Recreation and the City Manager’s office expressed
support to add to the project the repair of the pool deck to address safety concerns and
painting of the Center. As a result, the following improvements were identified as
priorities to be completed as part of this project using reallocated fiscal year 2016-17

The addition of the proposed improvements would rectify existing safety concerns
associated with the pool deck as well address peeling paint and cracked stucco
throughout the building and perform deferred facility maintenance.
The cost of the additional work including contingency funds is estimated to be $250,000.
Wage Statement
The Contractor and its subcontractors are required by bid specifications to pay
prevailing wage (“Prevailing Wage Rates”) to persons employed by them for work under
this Contract. In accordance with the provisions of Section 1773 of the Labor Code of
the State of California, the City of Chula Vista has ascertained the general prevailing
wage scales applicable to the work to be done. The prevailing wage scales are those
determined by the Director of Industrial Relations, State of California.

Measure P Budget Adjustments
On December 6, 2016 City Council approved the first allocation of $3.2 million in
projected Measure P Sales Tax revenues toward eligible items that were approved as
part of the Expenditure Plan. On February 7, 2017 as part of second quarter budge t
adjustments, City Council approved amendments to the original allocation to redistribute
funds based on the required funding needs. At this time, staff is requesting budget
adjustments to the approved fiscal year 2016-17 allocation as summarized by the table
below, in order to fund additional improvements at the Parkway Recreation facility.
These requests do not modify the estimated $3.2 million in projected revenues.
Sufficient Measure P funds are available in the fiscal year 2016 -17 for the budget
adjustments. The requested adjustments in the table above reflect a reallocation of
funds from the Public Safety Regional Communications System Portable Radios
(Police) in the amount of $185,000 and Fire Station Design in the amount of $65,000.
The reallocations will not result in delays in deploying radios or design of the fire
stations. The reallocation will fund repairs needed in order to meet the goal of opening
Parkway Aquatic Center in time for the summer season.
DECISION-MAKER CONFLICT
Staff has reviewed the property holdings of the City Council members and has found no
property holdings within 500 feet of the boundaries of the property which is the subject
of this action. Consequently, this item does not present a disqualifying real property -
related financial conflict of interest under California Code of Regulations Title 2, section
18702.2(a)(11), for purposes of the Political Reform Act (Cal. Gov’t Code §87100,et
seq.).
Staff is not independently aware, and has not been informed by any City Co uncil
member, of any other fact that may constitute a basis for a decision maker conflict of
interest in this matter.
LINK TO STRATEGIC GOALS
The City’s Strategic Plan has five major goals: Operational Excellence, Economic
Vitality, Healthy Community, Strong and Secure Neighborhoods and a Connected
Community. The Parkway Community Center and Pool Improvements project supports
the Healthy Community goal as it seeks to improve physical education and recreation
opportunities.
CURRENT YEAR FISCAL IMPACT
Approval of the resolution will increase the spending authorization limits for Mark W.
Fogle and Mission Pools of Escondido Inc. associated with CIP GG228. Staff is also
requesting budget adjustments in the 2016 Measure P Sales Tax Fund to support
additional improvements to the Parkway Recreation facility. Sufficient Measure P funds
are available in fiscal year 2016-17 for the budget adjustments. The requested
adjustments in the table above reflect a reallocation of funds from the Public Safety

and Fire Station Design in the amount of $65,000. The reallocations will not result in
delays in deploying radios or design of the fire stations. Funding will be replenished in
fiscal year 2017-18.
ONGOING FISCAL IMPACT
Upon completion, the improvements will require only routine City maintenance.
