HomeMy WebLinkAboutRDA Reso 1999-1632 RESOLUTION NO. 1632 RESOLUTION OF THE REDEVELOPMENT AGE ~ICY OF THE CITY QF CHULA VISTA APPROVING A DEFERRAL AGREE MENT BETWEEN THE CITY OF CHULA VISTA AND THE OTAY W.~TER DISTRICT FOR DEVELOPER IMPACT FEES FOR THE VETERAi' rs HOME PROJECT WHEREAS, on October 8, 1996 Council resolution 18448 and Agency resolution 1520 was approved adopting the Disposition and Development Agreement b( tween the Redevelopment Agency, the City of Chula Vista and the State Department of Veterans Affairs for he development of the Veterans Home; and WHEREAS, section 1.2 of the Disposition and DevEIopment Agreement ("DDA") states that "at no cost to the State, the City/Agency agrees to pay, waive, or othErwise arrange for the payment or waiver of [a] any and all City development impact fees and permit processing fees imposed against the Veterans Home Project, [b] any and all Otay Water District and San Diego Cou~nty Water Author ty development impact and permit processing fees lawfully imposed against the .V,,eterans ~ome Project, and lc] any and all school fees lawfully imposed against the Veterans Home Project; and / .I WHEREAS, the State Department of Veterans Affair ~ has requested the City/Agency to pay $420,000 for annexation f~es imposed by the Otay Water District t¢ the Veterans Home Project for twelve water meters to be installed on the site. The development impact fE es include the following: 1) installation fees; 2) water meter fees; 3)capacity fees; 4) San Diego County Ware Authority fees; and 5) annexation fees; and WHEREAS, the City has already reimbursed the St ~te $156,674 for fees paid to the Otay Water District; and WHEREAS, the Otay Water District has agreed to < efer the outstanding $264,000 in fees over 10 years plus interest pursuant to the terms of a deferral agreel nent. NOW, THEREFORE, BE IT RESOLVED the Rede~ elopment Agency of the City of Chula Vista does hereby approve the deferral agreement between the City of Chula Vista and the Otay Water District for Developer Impact Fees for the Veterans Home Project in the ,tm attached hereto as Exhibit A and authorizes and directs the Chairman to execute same.
