RESOLUTION NO. 2017-054
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA ORDERING A SUMMARY VACATION OF A
PORTION OF AN EXISTING SLOPE EASEMENT LOCATED
WITHIN THE SDG&E SALT CREEK SUBSTATION LAND
WHEREAS, San Diego Gas and Electric (SDG&E) is currently completing construction
of the Salt Creek Substation located south of Hunte Parkway and east Exploration Falls Drive
(SDG&E Land); and
WHEREAS, this construction has eliminated the need for a portion of a slope easement
held by the City within the SDG&E Land; and
WHEREAS, SDG&E has requested that the City of Chula Vista (City) vacate this portion
of the easement, as legally described in a legal description designated as Exhibit A and more
particularly shown on a map designated as Exhibit Al both of which are attached hereto and by
this reference made a part hereof; and
WHEREAS, Division 9, Part 3, Chapter 4, Section 8333(a) of the California Streets and
Highways Code states that the legislative body of a local agency may summarily vacate a public
service easement if the easement has not been used for the purpose for which it was dedicated or
acquired for five consecutive years preceding the proposed vacation; and
WHEREAS, the subject slope easement was granted to the City in 2010 and has never
been maintained by the City or used for the purpose for which it was dedicated or acquired; and
WHEREAS, there are no other easements in the area affected by this vacation and City
will retain all other existing rights and easements.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula
Vista, that it orders the summary vacation of a portion of an existing slope easement as described
and depicted in Exhibits A and Al attached hereto; and
BE IT FURTHER RESOLVED that the City Clerk is authorized and directed to cause a
certified copy of this resolution to be recorded in the Official Records of the Office of the
County Recorder, San Diego County, in accordance with Section 8336 of the California Streets
and Highways Code, and upon such recordation the vacation of the portion of the existing slope
easement shall be complete.

That portion of land within Lot 9 of Otay Rancho, in the City of Chula Vista, County of San :Diego, State of
California, according to Map thereof No. 862 filed in the Office of the San Diego County Recorder;
February 7, 1900, and as shown on Record of Survey No. 21941, recorded February 19, 2015 in said
Office of the San Diego County Recorder, designated and set aside as an easement for slope purposes
described as "Parcel C: Slope" by the City of Chula Vista, Resolution No. 2005-402 of the City Council, a
certified copy of which was recorded April 11, 2011 as Instrument No. 2011-0186630 of Official Records,
in said Office of the San•Diego County Recorder, being more particularly described as follows:
COMMENCING at a found 3/4 inch iron pipe with disc stamped "LS 6703" marking the most Northerly
corner of said Record of Survey No. 21941, said 3/4 inch iron pipe also rnadcing the most Northerly
corner of Grant Deed recorded June 28, 2011 as Instrument No. 2011-0326939 of Official Records, said
point bears North 49°37'03" West, 737.56 feet from a found 3/4.inch iron pipe with disc stamped "LS
6703" marking the most Easterly corner of said Record of Survey No. 21941; thence from said point of
commencement along the Northeasterly line of said Record.of Survey No. 21941 South 49`37'03" East,
365.70 feet; .thence leaving said Northeasterly Iine.South 53"12'00" West, 40.58; thence North
