HomeMy WebLinkAboutRDA Reso 1998-1572 RESOLUTION NO. 1572 RESOLUTION OF THE REDEVELOPMENT AG ~ICY OF THE CITY OF CHULA VISTA AMENDING A SPECIAL LAND USE PERMIT FOR THE ESTABLISHMENT OF A MATERIALS RECO~ ERY FACILITY/TRASH TRANSFER STATION AT 1855 MAXWELl. ROAD WITHIN THE OTAY VALLEY REDEVELOPMENT PRO. IECT AREA DATED MARCH 19, 1996 TO EXTEND THE PERMI' WHEREAS, the Redevelopment Agency of ti City of Chula Vista (the "Agency") approved a Special Land Use Permit (the "Permit") for the ,~stablishment of a materials recovery facility/trash transfer station (the "Facility") at 1855 Max~ ell Road within the Otay Valley Road Redevelopment Project Area on March 19, 1996, and; WHEREAS, said Permit was amended on O(:tober 1, 1996 to extend the term of the Permit, and; WHEREAS, said amended Permit has an effe rive period of two years from the date of original approval within which building permits must be btained and development begun; and WHEREAS, the developer of the Facility, J hn Sexton Sand & Gravel Corp. (the "Developer"), has not been able to move forward with th,~ project and now desires to sell the project to another qualified developer which will require ad :litional processing time; and WHEREAS, the Developer has requested tha: the effective period of the Permit be extended until March 17, 2000 in order to accommodate :he time necessary to sell the project and obtain permits for development of the Facility and to cc ncide with the effective period of the Owner Participation Agreement for development of the Fac lity which was amended on March 3, 1998 to extend the effective period until March 17, 2000; and WHEREAS, Initial Environmental Study IS-95- 28, of possible adverse environmental impacts has been conducted by the Environmental Review ( :oordinator who concluded that there would be no significant environmental effects from devel 3merit of the Facility and Negative Declaration IS-95-28 was adopted by the Agency on Mar, 19, 1996, and no conditions have changed since the time of approval; therefore, no additional /ironmental documentation or action is necessary in connection with this action. NOW, THEREFORE, BE IT RESOLVED that ~ e Redevelopment Agency of the City of Chula Vista hereby amends the Special Land Use Permit (copy attached) for the development of a materials recovery facility/trash transfer station at 1855 Maxwell Road, within the Otay Valley Road Redevelopment Project Area approved on March 19, 1996 as follows: 1. The first sentence of the second paragraph )f Section 4 of the Special Land Use Permit is eliminated in its entirety and repla¢ ed with the following sentence; "This Special Land Use Permit shall become void and ineffective if not utilized by March 17, 2000 in acc(rdance with Section 19.14.260 of the Municipal Code." 2. Except as expressly amended herein, all othEr terms and conditions of the Special Use Permit shall remain in full force and effE ct.
