HomeMy WebLinkAboutRDA Reso 1999-1653 AGENCY RESOLUTION NO.1653 (COUNCIL RESOLUTION NO. 19671 JOINT RESOLUTION OF THE CITY CC JNCIL AND THE REDEVELOPMENT AGENCY OF THE CITY OF CHULA VISTA AUTHORIZING THE ISSUANCE OF COAST~,L DEVELOPMENT PERMIT NO. 73 FOR REMOVAL OF ABOVE' ;ROUND FUEL OIL STORAGE TANKS AT THE SOUTH BAY POWER PLANT WHEREAS, the City of Chula Vista Local Coastal Program (LCP) has been certified by the California Coastal Commission; and, WHEREAS, said LCP includes Coastal Development procEdures determined by the Commission to be legally adequate for the issuance of Coastal Development P~ ~rmits and the City of Chula Vista has assumed permit authority of the Chula Vista Coastal Zone; and, WHEREAS, a public hearing was duly noticed and conducted on November 16, 1999 in accordance with said procedures; and, WHEREAS, the City Council and the Redevelopment A ]ency of the City of Chula Vista, as "approving authority", have reviewed the project proposal to remc de three aboveground oil fuel storage tanks and appurtenant equipment at the South Bay Power Plant. WHEREAS, the San Diego Unified Port District considere, and adopted a Negative Declaration for the proposed project in accordance with CEQA. NOW, THEREFORE, BE IT RESOLVED the City Council ~ md the Redevelopment Agency of the City of Chula Vista do hereby find, order, determine and resolve as follows: 1. The Negative Declaration/Finding of No Significant Impact for the proposed project prepared and issued by the San Diego Unified Port District, dated November, 1999 has been independently considered by the City of Chula Vista in its rD as responsible agency, and is in conformance with the certified Local Coastal Program. 2. The proposal will enhance the visual quality of le Bayfront and not impact coastal resources. 3. The proposal will be consistent with the goals ar d objectives of the Bayfront Plan and Implementation Plan which call for the "elimination of blight in the 'oject area.." BE IT FURTHER RESOLVED that the Redevelopm~ t Agency hereby approves Coastal Development Permit No. 73 for the above described fuel oil stc,rage tank removal project subject to attached conditions. Dated: November 17, 1999 ~_~.~"- ~ Chris Salomone Executive Secretary ATTACHMENT 1 COASTAL DEVELOPMENT PERMIT NO. 73 CONDITIONS OF APPR(~VAL 1. Applicant shall obtain the required demolition permit from the City of Chula Vista Planning and Building Department. 2. The applicant may be required to obtain a grading permit as determined by the City of Chula Vista Engineering Division upon further 'eview of the applicant's detailed work plan. 3. The applicant shall be responsible for the cleanup and proper disposal of any debris deposited on any city street, public right-of-way or i~ublic/private properties. 4. The applicant shall comply with all applicable mitig~ltion measures, as determined by the Community Development Planning and Enviro~lmental Manager, as found in the previous environmental document entitled "California Public Utilities Commission's Mitigated Negative Declaration and Initial Study I:or San Diego Gas and Electric company's Application No. 97-12-039 Proposal for Divestiture." 5. If the demolition work has not commenced withir one year from the date of final approval of the application for a coastal developm~ nt permit, the permit shall expire. 6. All demolition work must occur in strict complianc(, with the proposed project as set forth in the application for the coastal developmEnt permit, subject to any special conditions required by the City of Chula Vista or ~e California Coastal Commission if the final action on the application is made by it ~ appeal. Any deviation from the approved application must be reviewed by the D ~ctor of Community Development and may require additional City approval or approval by the California Coastal Commission if final action on the permit applicatio~ was made by it on appeal. 7. ApplicantJoperator shall indemnify, protect, defen(I and hold harmless the City and Agency, its Council members, Board members, ~fficers, employees, agents, and representatives, from and against any and all liabi ities, losses, damages, demands, claims and cost, including court costs and attorn(ys' approval and issuance of the Special Land Use Permit, (b) City's approval or issuance of any other or action, whether discretionary or non-discretionary, in conr ~ection with the use contemplated herein and (c) Applicant's installation and operati( n of the facility permitted hereby. Applicant's/operator's compliance with the provisi,)n is an express condition of this Special Land Use Permit and this provision shall be binding on any and all of the Application's/operator's successors and assigns.
