ROLL CALL: Present: Councilmember -Aguilar, Councilmember Diaz, Deputy Mayor McCann, Councilmember Padilla and Mayor Casillas Salas Also Present. Deputy City Manager Kachadoonan, City Attorney Googins, City Clerk Norris, and Assistant City Clerk Bigelow PLEDGE OF ALLEGIANCE TO THE FLAG AND MOMENT OF SILENCE Councilmember Padilla led the Pledge of Allegiance. SPECIAL ORDERS OF THE DAY A. 17-0092 OATHS OF OFFICE Newly appointed members to the Citizens' Oversight Committee Newly appointed member to the Cultural Arts Commission City Clerk Norris administered the oath of office to Commissioners Gray, Whitsell, Redo, Prater, Sheridan, Maldonado, Ziomek, Hunter, Firsht, Doyle, Garcias, Voorhees, and Vigilante, and Deputy Mayor McCann and Councilmember Diaz presented them with certificates of appointment. CONSENT CALENDAR (Items 1 - 3) 1. 17-0095 APPROVAL OF MINUTES of February 21, 2017. Recommended Action: Council approve the minutes. 2. 17-0091 WRITTEN COMMUNICATIONS Letter of resignation from Julie Danielson, Historic Preservation Commission Recommended Action: Council accept the resignation. City of Chula Vista Page 1 City Council Meeting Minutes - Final March 7, 2017 3. 17-0016 RESOLUTION NO. 2017-040 OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING THE REVISED FISCAL YEAR 2016-2017 COMPENSATION SCHEDULE EFFECTIVE APRIL 14, 2017, AS REQUIRED BY CALIFORNIA CODE OF REGULATIONS, TITLE 2, SECTION 570.5, REFLECTING (1) MOU REQUIRED SALARY INCREASES FOR POSITIONS REPRESENTED BY SERVICE EMPLOYEES INTERNATIONAL UNION LOCAL 221/CHULA VISTA EMPLOYEES' ASSOCIATION (SEIU/CVEA) AND WESTERN COUNCIL OF CIVIL ENGINEERS (WCE) AND (2) SALARY INCREASES FOR CONFIDENTIAL EMPLOYEES AND UNCLASSIFIED HOURLY (UCHR) POSITION TITLES THAT MATCH A BARGAINING UNIT CLASSIFICATION TITLE AS IDENTIFIED IN THE FISCAL YEAR 2016-2017 COMPENSATION SUMMARY FOR UNREPRESENTED EMPLOYEES Recommended Action: Council adopt the resolution. Approval of.the Consent Calendar ACTION: A motion was made by Deputy Mayor McCann, seconded by Councilmember Padilla, to approve staffs recommendations on the above Consent Calendar items, headings read, text waived. The motion carried by the following vote: Yes: 5 - Aguilar, Diaz, McCann, Padilla and Casillas Salas No: 0 Abstain: 0 ITEMS REMOVED FROM THE CONSENT CALENDAR There were none. PUBLIC COMMENTS The following members of the public expressed concern regarding derogatory comments made by Hector Gastelum and requested the Council's support in calling for his resignation from the Otay Water Board: Mona Dibas, Bonita resident - James Elia, Chula Vista resident - Kovu, San Diego resident - Jorge Del Castillo, Chula Vista resident PUBLIC HEARINGS 4. 16-0544 CONSIDERATION OF AN AMENDMENT TO CHULA VISTA'S PORTION OF THE 2016 REGIONAL TRANSPORTATION IMPROVEMENT PROGRAM City of Chula Visfa Page 2 City Council Meeting Minutes - Final March 7, 2017 RESOLUTION NOS. 2017-041 and 2017-042 OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ADOPTING AN AMENDMENT TO THE TRANSNET LOCAL STREET IMPROVEMENT PROGRAM OF PROJECTS FOR FISCAL YEARS 2016/2017 THROUGH 2020/2021, REDUCING THE TF327 CIP BUDGET BY $10,000 IN TRANSNET AND APPROPRIATING THE EQUIVALENT AMOUNT TO TF354, AND PROVIDING THE CERTIFICATION AND INDEMNITY STATEMENTS NECESSARY TO OBTAIN TRANSNET FUNDS (4/5 VOTE REQUIRED) Notice of the hearing was given in accordance with legal requirements, and the hearing was held on the date and no earlier than the time specified in the notice. City Attomey Googins advised Deputy Mayor McCann to abstain from voting on the portion of the item related to the project known as TF404 due to a potential property -related conflict of interest. Principal Civil Engineer Rivera stated that a revised attachment had been distributed to the Council. Mayor Casillas Sales opened the public hearing. There being no members of the public who wished to speak, Mayor Casillas Salas closed the public hearing. ACTION: A motion was made by Mayor Casillas Salas, seconded by Councilmember Aguilar, that Resolution No. 2017-041 be adopted as amended to exclude project TF404, heading read, text waived. The motion carried by the following vote: Yes: 5 - Aguilar, Diaz, McCann, Padilla and Casillas Salas No: 0 Abstain: 0 Deputy Mayor McCann left the dais at 5:31 p.m. ACTION: A motion was made by Mayor Casillas Salas, seconded by Councilmember Diaz, that Resolution No. 2017-042, which included project TF404, be adopted, heading read, text waived. The motion carried by the following vote: Yes: 4 - Aguilar, Diaz, Padilla and Casillas Salas No: 0 Abstain: 1 - McCann Deputy Mayor McCann returned to the dais at 5:32 p.m. CITY MANAGER'S REPORTS There were none. City of Chula Vista Page 3 City Council Meeting Minutes - Final March 7, 2017 MAYOR'S REPORTS Mayor Casillas Salas spoke regarding the following recent events: a visit by the new Mayor of Rosarito, Mima Rincon; the recent Council workshop on the City's long-term financial plan; the First Friday Breakfast on the topic of the new marketing campaign, "This is Chula'; the Woman of the Year breakfast, at which Chief Roxana Kennedy was honored; and a meeting with Assemblymember Shirley Weber regarding a report on California's public university systems. Mayor Casillas Salas thanked the Council for its participation in the interviews of applicants for the Measure P Citizens' Oversight Committee and the Cultural Arts Commission. She spoke regarding the upcoming Taste of Third Avenue event. COU NCI LMEMBERS' COMMENTS Councilmember Aguilar announced the following upcoming events: International Women's Day, and community workshops regarding development on D and F Streets. 5. 17-0093 Councilmember Aguilar: RECONSIDERATION OF APPOINTMENT OF CITY COUNCILMEMBERS TO THE FOLLOWING OUTSIDE AGENCIES: - Otay Valley Regional Park (OVRP) Policy Committee - Member - Otay Valley Regional Park (OVRP) Policy Committee - Alternate - Otay Ranch Preserve Owner Manager (POM) Policy Committee - Member - Otay Ranch Preserve Owner Manager (POM) Policy Committee - Alternate ACTION: A motion was made by Councilmember Aguilar, seconded by Deputy Mayor McCann, that the following appointments to outside agencies be made: Councilmember Aguilar: Otay Valley Regional Park (OVRP) Policy Committee Alternate and Otay Ranch Preserve Owner Manager (POM) Policy Committee - Member Councilmember Diaz: Otay Valley Regional Park (OVRP) Policy Committee - Member and Otay Ranch Preserve Owner Manager (POM) Policy Committee - Alternate The motion carried by the following vote: Yes: 5 - Aguilar, Diaz, McCann, Padilla and Casillas Salas No: 0 Abstain: 0 Councilmember Padilla congratulated staff and consultants on the launch of the "This is Chula" advertising campaign. Deputy Mayor McCann spoke regarding the following recent events: a book reading with. Read Across America in honor of Dr. Seuss's birthday and the naming of the Eastlake Post Office in honor of J.D. De - Guzman. City Attorney Googins announced that the Council would convene in closed session to discuss the items listed below. City of Chula Vista Page 4 City Council Meeting Minutes - Final March 7, 2017 Mayor Casillas Sales recessed the meeting at 5:47 p.m. The Council reconvened in Closed Session at 5:52 p.m., with all members present. CLOSED SESSION Pursuant to Resolution No. 13706 and Council Policy No. 346-03, Official Minutes and records of action taken during Closed Sessions are maintained by the City Attorney. 6. 17-0088 CONFERENCE WITH LEGAL COUNSEL REGARDING EXISTING LITIGATION PURSUANT TO GOVERNMENT CODE SECTION 54956.9 (d)(1) Name of case: James Garcia v. City of Chula Vista, San Diego Superior Court, Case No. 37 -2015 -00016408 -CU -OE -CTL ACTION: There was no reportable action.
