Mayor Casillas Salas explained the typical board and commission interview meeting timeline and announced that the City Clerk had distributed the timeline to the Council. Discussion ensued regarding the interview process and possible dates to conduct interviews. The motion carried by the following vote: ACTION: Yes:Aguilar, Diaz, McCann, Padilla and Casillas Salas5 - No:0 Abstain:0 Mayor Casillas Salas reported on the following recent events: a meeting with Southwestern Community College officials regarding work-based education and potential partnerships with the City, a San Diego Association of Governments (SANDAG) retreat, the Chula Vista Chamber of Commerce installation dinner, a meeting regarding the upcoming Holocaust Week display at the Civic Center Library, a Measure P groundbreaking event to repave Floyd Avenue. Mayor Casillas Salas spoke regarding the upcoming Sweetwater Union High School District art exhibit at the South Chula Vista Library and the Celebration of Champions event at the Chula Vista Elite Athlete Training Center. COUNCILMEMBERS’ COMMENTS Councilmember Diaz announced the upcoming community forum he would be hosting on the topics of public safety, the City's Homeless Outreach Team (HOT), and the ACT Chula Vista program to report and track issues in the City. He stated he would be teaching advanced manufacturing at Southwestern College. Councilmember Diaz spoke regarding the City's efforts to address illegal marijuana sales. Deputy Mayor McCann congratulated the new board members of the Chamber of Commerce. Councilmember Padilla spoke regarding his recent meeting with students and staff at Southwestern College regarding the SAGA organization. He congratulated the incoming members of the board of directors of the Chamber of Commerce. City Attorney Googins spoke regarding his recent trip to Africa. City Attorney Googins announced that the Council would convene in closed session to discuss the item listed below. Mayor Casillas Salas recessed the meeting at 6:41 p.m. The Council reconvened in Closed Session at 6:50 p.m., with all members present. SUMMARY California Code of Regulations, Title 2, Section 570.5 requires that, for purposes of determining a retiring employee's pension allowance, the pay rate be limited to the amount listed on a pay schedule that meets certain requirements and be approved by the governing body in accordance with the requirements of the applicable public meeting laws. Staff is requesting approval of the revised Compensation Schedule effective April 14, 2017 to reflect: (1) the scheduled salary adjustment for positions represented by Service Employees International Union Local 221/Chula Vista Employees' Association (SEIU/CVEA) and Western Council of Engineers (WCE) as negotiated in their Memorandum of Understanding and (2) the salary increases for Confidential Employees and Unclassified Hourly (UCHR) position titles that match a bargaining unit classification title as identified in the Fiscal Year 2016-2017 Compensation Summary for Unrepresented Employees. BOARD/COMMISSION RECOMMENDATION Not Applicable DISCUSSION California Code of Regulations, Title 2, Section 570.5 requires that, for purposes of determining a retiring employee's pension allowance, the pay rate be limited to the amount listed on a pay schedule that meets certain requirements and be approved by the governing body in accordance with the requirements of the applicable public meeting laws. The revised Fiscal Year 2016-2017 Compensation Schedule ("Compensation Schedule") was last approved by the City Council at their meeting of February 21, 2017. Staff is requesting approval of the revised Compensation Schedule effective April 14, 2017 to reflect (1) the scheduled salary adjustment for positions represented by the Service Employees International Union Local 221/Chula Vista Employees' Association (SEIU/CVEA) and Western Council of Engineers (WCE) as negotiated in their Memorandum of Understanding and (2) the salary increases for Confidential Employees and Unclassified Hourly (UCHR) position titles that match a bargaining unit classification title as identified in the Fiscal Year 2016-2017 Compensation Summary for Unrepresented Employees, which was approved by the City Council on June 16, 2015. DECISION-MAKER CONFLICT Staff has determined that the action contemplated by this item is ministerial, secretarial, manual, or clerical in nature and, as such, does not require the City Council members to make or participate in making a governmental decision, pursuant to California Code of Regulations Title 2, section 18702.4 (a). Consequently, this item does not present a conflict under the Political Reform Act (Cal. Gov't Code § 87100, et seq.). Staff is not independently aware, and has not been informed by any City Council member, of any other fact that may constitute a basis for a decision maker conflict of interest in this matter. LINK TO STRATEGIC GOALS The City’s Strategic Plan has five major goals: Operational Excellence, Economic Vitality, Healthy Community, Strong and Secure Neighborhoods and a Connected Community. Approval of the revised Fiscal Year 2016-2017 Compensation Schedule and its posting on the City's internet website supports the goal of Operational Excellence as it enhances disclosure and transparency of employee compensation and, as a result, fosters public trust through an open and ethical government. CURRENT YEAR FISCAL IMPACT All cost related to this item were included in the FY 2016-17 Council Adopted budget. There are no additional fiscal impacts related to this action. CALIFORNIA CODE OF REGULATIONS, TITLE 2, SECTION 570.5, REFLECTING (1) MOU REQUIRED SALARY INCREASES FOR POSITIONS REPRESENTED BY SERVICE EMPLOYEES INTERNATIONAL UNION LOCAL 221/CHULA VISTA EMPLOYEES’ ASSOCIATION (SEIU/CVEA) AND WESTERN COUNCIL OF CIVIL ENGINEERS (WCE) AND (2) SALARY INCREASES FOR CONFIDENTIAL EMPLOYEES AND UNCLASSIFIED HOURLY (UCHR) POSITION TITLES THAT MATCH A BARGAINING UNIT CLASSIFICATION TITLE AS IDENTIFIED IN THE FISCAL YEAR 2016-2017 COMPENSATION SUMMARY FOR UNREPRESENTED EMPLOYEES WHEREAS, California Code of Regulations, Title 2, Section 570.5 requires that, for purposes of determining a retiring employee's pension allowance, the pay rate be limited to the amount listed on a pay schedule that meets certain requirements and be approved by the governing body in accordance with the requirements of the applicable public meeting laws; and WHEREAS, the revised Fiscal Year 2016-2017 Compensation Schedule ("Compensation Schedule") was last approved by the City Council at their meeting of February 21, 2017; and WHEREAS, any changes including but not limited to, across-the-board increases, classification changes and salary adjustments approved subsequent to this date, will be reflected on a revised Compensation Schedule and submitted to Council approval; and WHEREAS, the Compensation Schedule will be revised to reflect the scheduled salary adjustment effective April 14, 2017, for positions represented by Service Employees International Union Local 221/Chula Vista Employees' Association (SEIU/CVEA) and Western Council of Engineers (WCE), as negotiated in their Memorandum of Understanding, and salary increases for Confidential Employees and Unclassified Hourly (UCHR) position titles that match a bargaining unit classification title as CONSIDERATION OF AN AMENDMENT TO CHULA VISTA’S PORTION OF THE 2016 REGIONAL TRANSPORTATION IMPROVEMENT PROGRAM RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ADOPTING AN AMENDMENT TO THE TRANSNET LOCAL STREET IMPROVEMENT PROGRAM OF PROJECTS FOR FISCAL YEARS 2016/2017 THROUGH 2020/2021, REDUCING THE TF327 CIP BUDGET BY $10,000 IN TRANSNET AND APPROPRIATING THE EQUIVALENT AMOUNT TO TF354, AND PROVIDING THE CERTIFICATION AND INDEMNITY STATEMENTS NECESSARY TO OBTAIN TRANSNET FUNDS (4/5 VOTE REQUIRED) RECOMMENDED ACTION Council conduct the public hearing and adopt the resolution. SUMMARY The San Diego Association of Governments (SANDAG) is accepting submittal of requests for the second amendment to the 2016 Regional Transportation Improvement Program (RTIP) beginning January 27, 2017. Signed resolutions must be submitted to SANDAG by March 24, 2017. Staff recommends several adjustments to the TransNet allocations adopted as part of the 2016 RTIP in order to include funding for projects to be recommended for the Fiscal Year 2017-18 Capital Improvement Program. ENVIRONMENTAL REVIEW Environmental Notice The activity is not a “Project” as defined under Section 15378 of the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15060(c)(3) no environmental review is required. Environmental Determination The Director of Development Services has reviewed the proposed activity for compliance with the California Environmental Quality Act (CEQA) and has determined that the activity is not a “Project” as defined under Section 15378 of the State CEQA Guidelines because the activity consists of governmental Regional Transportation Improvement Program/ TransNet funds activity, which does not involve any commitment to any specific project that may result in a potentially significant physical impact on the environment. Therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. Thus, no environmental review is required. BOARD/COMMISSION RECOMMENDATION Not applicable DISCUSSION The voters of San Diego County approved the TransNet Program as Proposition A in November 1987. This proposition enacted a half-cent increase in the countywide sales tax through 2008 to fund specified transportation programs and projects. One third of the revenues generated by the tax were allocated by SANDAG to the local agencies for local streets and roads purposes. In November 2004, 67 percent of County voters supported Proposition A, which extends TransNet from 2008 to 2048. The TransNet Extension Ordinance states that at least 70 percent of the TransNet funds allocated to local agencies for local road projects should be used to fund Congestion Relief (CR) projects. CR projects include the construction of new or expanded facilities, major rehabilitation and reconstruction of roadways, traffic signalization, transportation infrastructure to support smart growth, capital improvements for transit facilities, and operating support for local shuttle and circulator transit routes. Additionally, no more than 30 percent of TransNet funds allocated to local agencies for local road projects can be used for local street and road maintenance. On February 2, 2017, SANDAG provided the member agencies with the most recent version of the financial projection for Fiscal Years 2016-17 through 2021-22 (Attachment 1). This projection has been used to plan the City’s TransNet allocation program. The funds available for Fiscal Year 2016- 17 were reduced by $100,000 (1.7%) from the projections provided in the February 2, 2016 revenue projections of $5,914,000 to $5,814,000. Appropriation An appropriation of $10,000 is needed to provide sufficient funding for project TF354: Traffic Congestion Relief Program. These funds are being transferred from TF327: Neighborhood Safety Program in Fiscal Year 2016-17. FY2016/17 Additional LSI Carryover In July 2016, SANDAG provided the City with estimated available TransNet - Local Street Improvement (LSI) Carryover funds for the 2016 RTIP. Now that Fiscal Year 2015-16 has closed and all audits have been conducted, SANDAG provided the final available figures which are higher than the estimate. The updated balance for the City of Chula Vista is $45,000. These additional funds will be programmed into CHV48 (STM393) as part of the Fiscal Year 2017-18 CIP Program. Administrative Transfers This action is intended to either reallocate leftover funds allocated to Capital Improvement Program City of Chula Vista Printed on 3/2/2017Page 2 of 7 powered by Legistar™2017-03-07 Agenda Packet Page 31 File#:16-0544, Item#: 4. This action is intended to either reallocate leftover funds allocated to Capital Improvement Program (CIP) projects that have been completed or to transfer money from one CIP project to another within the same SANDAG project number (MPO ID). Leftover funds will be reallocated to a CIP project that needs additional funding under CHV48 (Major Pavement Rehabilitation). These transfers will not affect the balance between Congestion Relief and Maintenance projects. These transfers are strictly administrative to address SANDAG’s project accounting. These funds have already been budgeted in the current Capital Improvement Program so no appropriation is required. Attachment 2 provides details of these transfers. Congestion Relief (CR) Projects The following are the major projects proposed for amendment to the 2016 RTIP for Fiscal Years 2016-17 and 2017-18 (Attachment 3). Appropriation of these funds is not requested at this time - appropriation of these funds will be part of the budget approval process for the Fiscal Year 2017-18 Capital Improvement Program (CIP). This CIP Program will also address the $100,000 (1.7%) reduction in projected Fiscal Year 2016-17 revenues as indicated in SANDAG’s updated Fiscal Year 2017-18 TransNet Revenue Forecast. The following are the major projects that will be included under Congestion Relief for Fiscal Year 2017-18. Amounts shown for future fiscal years are estimated and will be revised in the future as revenues and specific locations are identified. CHV-30: I-5 Multi-Modal Corridor Improvement Study (STM361) This project funds a study to examine multi-modal improvements along the I-5 corridor between State Route 54 and the Main Street Interchange. Additional funding of $155,047 in TransNet will be included as part of the Fiscal Year 2017-18 CIP Program to complete the environmental document for the Palomar Street rail grade separation project at Industrial Blvd. CHV-39: Traffic Signal System Optimization (TF350) This is an ongoing annual project to upgrade the City’s technology for coordinating traffic signals and detecting bicycles and vehicles. This will improve traffic circulation and reduce intersection delays and traffic congestion throughout the City. An additional $184,500 in TransNet will be included as part of the Fiscal Year 2017-18 CIP Program, as well as the City’s annual allocation of $15,500 for the Regional Arterial Management System (RAMS). CHV48: Pavement Major Rehabilitation This is the City’s annual program for major pavement rehabilitation. A total of $2,505,116 in TransNet will be included as part of the Fiscal Year 2017-18 CIP Program. Additionally, $821,784.12 in existing funds will be reprogrammed into CHV48. The current candidate list for CHV48 is provided as Attachment 4. Various rehabilitation techniques appropriate for pavements in fair to poor condition will be used. The list will be revised, if needed, as design nears completion and the rehabilitation strategies are determined. CHV58: New Sidewalk Construction (STL426) Staff is applying for Community Development Block Grant (CDBG) funding for several locations in southwest Chula Vista with missing or noncompliant sidewalks. One of these locations is Third Avenue which has missing sidewalks on the east side between Avenida Rosa Street and Zenith Street and deteriorated asphalt sidewalks on the west side between Orange Avenue and Anita Street. A funding request of $193,100 in TransNet will be included as part of the Fiscal Year City of Chula Vista Printed on 3/2/2017Page 3 of 7 powered by Legistar™2017-03-07 Agenda Packet Page 32 File#:16-0544, Item#: 4. 2017-18 CIP Program to supplement CDBG funds to complete the project. CHV70: Bike Lanes on Broadway (STM384) (STM392) Staff presented the Bike Lanes on Broadway study to Council, which was adopted on February 16, 2016. This project was originally conceived of in three phases. The first phase included funding in Fiscal Year 2016-17 and consisted of modification of striping on Broadway between C Street and G Street, which will involve the reduction of travel lanes from four to two lanes and the installation of buffered bike lanes. The second phase includes a chip seal from G Street to L Street, along with revised striping and a buffered bike lane on each side. All lanes and parking on both sides will be retained. Funding of $460,000 in TransNet will be included as part of the Fiscal Year 2017-18 CIP Program for this second phase. CHV79: Raised Median Improvements (TF397) This project involves construction of new raised medians where motorists are making illegal turning movements and reconstructing medians that protrude into crosswalks. The locations included E Street between First and Second Avenues, E Street east of Third Avenue, Paseo Ranchero south of East J Street, and Eastlake Parkway south of Otay Lakes Road and the Chula Vista Community Park/ Eastlake High School driveway. An additional $80,000 in TransNet will be included as part of the Fiscal Year 2017-18 CIP Program. CHV-NEW: Retiming of Traffic Signals and Installation of Fiber (TF404) Caltrans requires all traffic signals to conform with the 2014 CA Manual of Uniform Traffic Control Devices (MUTCD). The City needs to re-time the traffic signals located between I-5 and I-805 freeways. Additionally, a fiber optic/Ethernet communication system will be installed along Main Street, Fourth Avenue, and H Street corridors. The City has received $661,550 in funding for this project from the Highway Safety Improvement Program (HSIP). An additional $623,384 in TransNet will be included for this project as part of the Fiscal Year 2017-18 CIP Program. Traffic Signal Fee funding of $38,216 will also be included in this project. Maintenance Projects CHV06: Minor Pavement Rehabilitation (OP219) Additional funding of $75,000 in TransNet will be included as part of the Fiscal Year 2017-18 CIP program to fund the operation of the City’s Pavement Management System. CHV22: Advance Planning Studies (OP219) A total of $63,353 in additional TransNet funding will be included as part of the Fiscal Year 2017-18 CIP Program. CHV33: School Zone Traffic Calming (TF345) Additional funding of $150,000 in TransNet will be included as part of the Fiscal Year 2017-18 CIP Program. CHV34: Neighborhood Traffic and Pedestrian Safety Program This project involves providing community outreach regarding traffic safety and constructing traffic calming and pedestrian safety measures. Additional funding of $370,000 in TransNet will be included for the following projects as part of the Fiscal Year 2017-18 CIP Program: ·TF:327: Neighborhood Traffic and Pedestrian Safety Program ($240,000) City of Chula Vista Printed on 3/2/2017Page 4 of 7 powered by Legistar™2017-03-07 Agenda Packet Page 33 File#:16-0544, Item#: 4. ·STM380: Sidewalk Replacement on East H Street Study ($130,000) CHV35: Traffic Signing, Studies & Signal Upgrade (TF332)(TF366) This is an ongoing program that provides funding for a variety of traffic-related studies, signing and striping, and other maintenance improvements. Additional funding of $250,000 in TransNet will be included for the following projects as part of the Fiscal Year 2017-18 CIP Program: ·TF332: Signing and Striping program ($50,000) ·TF366: Traffic Signal & Streetlight Systems Upgrade & Modification ($200,000) CHV35 / CHV45: Traffic Monitoring Program (STM369) The Bikeway Facilities Gap project (STM369) is being transferred from CHV45 to CHV35. A total of $75,000 in TransNet will be included as part of the Fiscal Year 2017-18 CIP program for STM369: Bikeway Facilities Gap Program. CHV45: Traffic Monitoring Program Additional funding of $100,000 in TransNet will be included for the following projects in the Fiscal Year 2017-18 CIP Program: ·TF274: Traffic Count Stations Program ($50,000) ·TF321: Citywide Traffic Count Program ($50,000) CHV50: Emergency Storm Drain and Bridge Culvert Repair Program This project includes the repair/replacement of storm drains that carry street drainage and need to be repaired in order to maintain safe driving conditions. An additional $382,000 in TransNet will be included for this project in the Fiscal Year 2017-18 CIP Program. CHV75: ADA Curb Ramps Program A total of $150,000 will be included as part of the Fiscal Year 2017-18 CIP Program, which will include the construction of new, ADA-complaint pedestrian ramps in areas where we have none. The City will construct the ramps in order of the priorities previously adopted by Council. CHV-NEW: Local Street Utility Undergrounding District (STM394) This project is for the design and construction of City facilities to accompany utility undergrounding, such as street lights. A total of $100,000 in TransNet will be included as part of the Fiscal Year 2017-18 CIP Program. DECISION-MAKER CONFLICTS For CHV48, CHV50 and CHV75:Staff has reviewed the property holdings of the City Council members and has found that Mayor Salas and Councilmembers McCann and Diaz have property holdings within 500 feet of the boundaries of the properties which are the subject of this action. However, the decision solely concerns repairs, replacement or maintenance of existing streets, water, sewer, storm drainage or similar facilities. Consequently, pursuant to California Code of Regulations Title 2, sections 18700 and 18702.2(c(1)), this item does not present a real property-related conflict of interest under the Political Reform Act (Cal. Gov't Code § 87100, et seq.). Consequently, pursuant to California Code of Regulations Title 2, sections 18700 and 18702.2(a)(11), this item presents a disqualifying real property-related financial conflict of interest under the Political Reform Act (Cal. Gov't Code § 87100, et seq.) for the above-identified member. Staff is not independently aware, and has not been informed by any City Council member, of any other fact that may constitute a basis for a decision maker conflict of interest in this matter. For CHV30, CHV34, CHV58, CHV70, CHV79 and CHV-NEW (STM394): Staff has reviewed the property holdings of the City Council members and has found no property holdings within 500 feet of the boundaries of the property which is the subject of this action. Consequently, this item does not present a disqualifying real property-related financial conflict of interest under California Code of Regulations Title 2, section 18702.2(a)(11), for purposes of the Political Reform Act (Cal. Gov’t Code §87100,et seq.). Staff is not independently aware, and has not been informed by any City Council member, of any other fact that may constitute a basis for a decision maker conflict of interest in this matter. For other projects:Staff has reviewed the decision contemplated by this action and has determined that it is not site- specific and consequently, the 500-foot rule found in California Code of Regulations Title 2, section 18702.2(a)(11), is not applicable to this decision for purposes of determining a disqualifying real property-related financial conflict of interest under the Political Reform Act (Cal. Gov't Code § 87100, et seq.). Staff is not independently aware, and has not been informed by any Council member, of any other fact that may constitute a basis for a decision maker conflict of interest in this matter. LINK TO STRATEGIC GOALS The City’s Strategic Plan has five major goals: Operational Excellence, Economic Vitality, Healthy Community, Strong and Secure Neighborhoods and a Connected Community. The TransNet Local Street Improvement Program supports the Strong and Secure Neighborhood strategy in the City’s Strategic Plan. It provides funding for the maintenance and rehabilitation of public infrastructure, which is a key City function in providing a safe and efficient transportation system for residents, businesses and visitors. CURRENT YEAR FISCAL IMPACT Approval of this resolution will result in the transfer of $10,000 in TransNet funds from TF327 to TF354. There is sufficient funding to perform this transfer. The remaining allocations will be budgeted as part of the Fiscal Year 2017-18 Capital Improvement Program. ADA compliant bus stop landings for existing service.191 SECTIONS CHV48 3 / 32017-03-07 Agenda Packet Page 44 RESOLUTION NO. 2017________ RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ADOPTING AN AMENDMENT TO THE TRANSNET LOCAL STREET IMPROVEMENT PROGRAM OF PROJECTS FOR FISCAL YEARS 2016/2017 THROUGH 2020/2021, REDUCING THE TF327 CIP BUDGET BY $10,000 IN TRANSNET AND APPROPRIATING THE EQUIVALENT AMOUNT TO TF354, AND PROVIDING THE CERTIFICATION AND INDEMNITY STATEMENTS NECESSARY TO OBTAIN TRANSNET FUNDS (4/5 VOTE REQUIRED) WHEREAS, on November 4, 2004, the voters of San Diego County approved the San Diego Transportation Improvement Program Ordinance and Expenditure Plan (TransNet Extension Ordinance); and WHEREAS,the TransNet Extension Ordinance provides that SANDAG, acting as the Regional Transportation Commission, shall approve on a biennial basis a multi-year program of projects submitted by local jurisdictions identifying those transportation projects eligible to use transportation sales tax (TransNet) funds; and WHEREAS, on February 2, 2017, the City of Chula Vista was provided with an estimate of annual TransNet local street improvement revenues for fiscal years 2017 through 2021; and WHEREAS, the City of Chula Vista approved its 2016 TransNet Local Street Improvement Program of Projects (POP) on March 8, 2016 and the City of Chula Vista desires to make adjustments to its Program of Projects; and WHEREAS, due to the need to add funding in Fiscal Year 2016-17 to TF354: Traffic Congestion Relief Program, staff recommends reducing the funding of TF327 by $10,000 and appropriating the equivalent amount to TF354; and WHEREAS, the City of Chula Vista has held a noticed public meeting with an agenda item that clearly identified the proposed amendment prior to approval of the projects by its authorized legislative body in accordance with Section 5(A) of the TransNet Extension Ordinance and Rule 7 of SANDAG Board Policy No. 31.
