AGENCY RESOLUTION NO. 1787
RESOLUTION OF THE CITY COUNCIL AND THE
REDEVELOPMENT AGENCY OF THE CITY OF CHULA
VISTA ACCEPTING BIDS, APPROPRIATING ADDITIONAL
FUNDS, AND AWARDING CONTRACT FOR THE "H'
STREET RECONSTRUCTION, INTERSTATE 5 TO
BROADWAY, IN THE CITY OF CHULA VISTA (PROJECT
STM-334)
WHEREAS, on April 17, 2002, the Director of Public Works received the following six
sealed bids for the "H" Street Reconstruction, Interstate 5 to Broadway in the City of Chula
Vista, California (STM-334) Project:

3. Single Eagle - Poway, California $2,254,843.10
4. Heffier Company - National City, California $2,393,1300.60
5. Scheidel Contracting - La Mesa, California $2,415,467.00
6. Daley-CCAC, J.V. - San Diego, California $2,443,754.00
WHEREAS, the apparent low bid, submitted by Shiva Construction, Inc. is below the
engineer's estimate of $2,021,575.50 by $78,986.50; and
WHEREAS, Engineering staff has verified the references provided by the contractor and
their work has been satisfactory and is recommending awarding the contract, based upon the
base bid of $1,942,589, with two alternates, to Shiva Construction, Inc. of San Diego, California
for a total contract amount of $2,241,589.00; and
WHEREAS, the project is categorically exempt under Section 15301 Class 1 (Existing
Facilities) of the California Environmental Quality Act because it involves improvements to an
existing right-of-way and there will be negligible expansion of the right-of-way in certain
locations to allow for an improved landscape strip and irrigation lines; and
WHEREAS, the sources of funding for this project are Transportation Sales Tax and
General Fund, therefore, contractors bidding this project are not required to pay prevailing wages
to persons employed by them for the work under this project; and
WHEREAS, additional funds in the amount of $979,140 are requested from the
Transportation Sales Tax balance to cover the basic street and traffic improvements, plus
$210,000.00 from the General Fund balance to cover landscape and irrigation improvements,
color pattern median, and enhanced crosswalks for the project; and
WHEREAS, the award of this contact does not precommit the City to acquiring
right-of-way because City reserves the right, without penalty, to delete proposed portions of the
project on unacquired private property.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula
Vista does hereby accept the bids and award the contract for the "H" Street Reconstruction,
Interstate 5 to Broadway in the City of Chula Vista, California (STM-334) to Shiva Construction,
Inc. of San Diego, California, for $2,241,589.00.
BE IT FURTHER RESOLVED that the City Council does hereby authorize the
appropriation of additional fund in the amount of $979,140.00 from the Transportation Sales Tax
balance to fund the basic street and traffic improvements for the project.
BE IT FURTHER RESOLVED that the City Council does hereby authorize the
appropriation of additional funds in the amount of $210,000.00 from the General Fund balance to
fund landscape and irrigation improvements, color pattern median, and enhanced crosswalks for
the project.
BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista is hereby
authorized to execute the contract in a final form approved by the City Attorney.
