Council adopt the resolution.
SUMMARY
OnoraboutJanuary20,2017,theCountyofSanDiego,includingtheCityofChulaVista,
experiencedaseriesofsevereandprolongedwindandrainstorms.Asaresultofthestorms,about
twohundredtreesweredownedintheCityofChulaVista(blockingroadwaysandcrashinginto
homes),poweroutagesoccurred,therewasflooding,anddamagetoCityfacilitiesandequipment.
Asaresult,theCityactivateditsemergencyoperationscenterandtookactioninresponsetothe
emergency.OnJanuary20,2017,theEmergencyServicesDirector(CityManager)fortheCityof
ChulaVistadeclaredalocalstateofemergency.OnJanuary23,2017,theStateofCaliforniaalso
declaredastateofemergency.Thisresolutionseeksto(1)ratifytheDirectorofEmergency
Services’DeclarationofLocalEmergency;(2)toextendandsetFebruary19,2017at5:00pmasthe
enddateforDeclarationoftheLocalEmergency,unlessadditionalactionistakenbyCityCouncilor
theDirectorofEmergencyServices;and(3)directtheDirectorofEmergencyServicestoseekany
and all aid to assist in recovery and to address the impacts of the declared local emergency.

DISCUSSION
OnoraboutJanuary20,2017,theCountyofSanDiego,includingtheCityofChulaVista,
experiencedaseriesofsevereandprolongedwindandrainstorms.Asaresultofthestorms,about
twohundredtreesweredownedintheCity(blockingroadwaysandcrashingintohomes),power
outagesoccurred,therewerecaraccidents,multipleinstancesofflooding,anddamagetoCity
facilitiesandequipment.Asaresult,theCityactivateditsemergencyoperationscenterandtook
actioninresponsetotheemergency.ManyCityemployeesparticipatedintheresponsetothelocal
emergency and they should be highly commended for performing in an exemplary manner.
OnJanuary20,2017,pursuanttoGovernmentCodesection8630andChulaVistaMunicipalCode
(“CVMC”)section2.14.080(A),theDirectorofEmergencyServices(CityManager)fortheCityof
ChulaVistadeclaredalocalstateofemergencyasaresultoftheaforementionedsevereand
prolonged wind and rain storms.
GovernmentCodesection8630permitsanofficialdesignatedbyalocalagencytodeclarealocal
emergency.GovernmentCodesection8630,asinterpretedbythestate,alsoprovidesthata
declarationofalocalemergencymadebysuchdesignatedlocalofficialshallnotremainineffectfor
more than seven days, unless ratified by City Council.
CVMCsection2.14.080(A)providesthattheCity’sDirectorofEmergencyServicesmaydeclarea
localemergencywhenCityCouncilisnotinsession.TheCityManager,pursuanttoCVMCsection
2.14.070, functions as the director of emergency services.
CVMCsection2.13.080(A)alsorequiresthatCityCouncilratifyadeclarationofalocalemergencyif
itwasdeclaredbytheDirectorofEmergencyServicesatorbeforethe“nextregularlyscheduled
council meeting held after the date of the proclamation.”
Also,thisactionseekstoextendtheenddateforthedeclarationtoFebruary19,2017at5:00pm.
Theadditionaltimeisrequiredtopermittheimpactsoftheemergencytoendandtoconductafull
inventoryandreviewofthedamagecausedbythesevereandprolongedwindandrainstorm.
UndertheGovernmentCode,thedeclarationmustbereviewedeverythirty(30)daysforthe
declarationtocontinue.Thisrequestedextensionisthirty(30)daysfromtheJanuary20,2017

Thisresolutionseeksto(1)ratifytheDirectorofEmergencyServices’DeclarationofLocal
EmergencyasrequiredbySection2.14.080(A)andtheattendantprovisionsoftheGovernment

Staffisnotindependentlyaware,andhasnotbeeninformedbyany CityCouncil member,ofany
other fact that may constitute a basis for a decision maker conflict of interest in this matter.

additionalpersonnelexpenseswereincurred.Adeclarationofalocalemergencyandsimilar
declarationsbyothergovernmententitiesmayassist(andmayberequiredforfederalassistanceif
available)inreceivingaidfromotherlocal,state,orfederalagencies.However,theexpenditures
fromtheCity’sresponsetothelocalemergencyandanyaidthatmaybereceivedhavenotyetbeen
determined..

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA (1) RATIFYING THE DECLARATION OF A
LOCAL EMERGENCY DECLARED ON JANUARY 20, 2017
AS A RESULT OF SEVERE AND PROLONGED WIND AND
RAIN STORMS THROUGHOUT THE COUNTY OF SAN
DIEGO,INCLUDING THE CITY OF CHULA VISTA, ISSUED
BY THE DIRECTOR OF EMERGENCY SERVICES OF THE
CITY OF CHULA VISTA, (2) EXTENDING THE
DECLARATION UNTIL FEBRUARY 19, 2017AT 5:00 PM;
AND (3) DIRECTING AND AUTHORIZING THE CITY
DIRECTOR OF EMERGENCY SERVICES TO OBTAIN ANY
AND ALL LOCAL, COUNTY, STATE, AND FEDERAL AID
TO ASSIST IN RECOVERY AND ADDRESSING THE
AFOREMENTIONED STATE OF EMERGENCY
WHEREAS, California Government Code section 8630 authorizes local agencies to
proclaim a local emergency when such events occur as defined by California Government Code
section 8558(c); and
WHEREAS, Chula Vista Municipal Code section 2.14.080(A) empowers the Director of
Emergency Services for the City of Chula Vista (City Manager; hereinafter “Director of
Emergency Services”) to proclaim a declaration of local emergency and requires that such
declaration be ratified by City Council at the “next regularly scheduled council meeting held
after the date of the proclamation;” and
WHEREAS, the Director of Emergency Services does hereby find:
1.That conditions of extreme peril to the safety of persons and property have arisen with
the City of Chula Vista caused by severe and prolonged wind and rain storms in the
County of San Diego, including the City of Chula Vista; and
2.That among theimpacts cause by the severe wind and rains storms include: about two
hundred downed trees (which blocked roadwaysand crashed into homes), power outages,
auto accidents, multiple instances of flooding, anddamage to City facilities and
equipment; and
3.That these conditions are likely to be beyond the normal control of the services,
personnel, equipment, and facilities of the City of Chula Vista; and
4.That the City, as a result of those conditions, activated its Emergency Operations Center
and deployed police, fire, public works, and other resources to address the severe and
prolonged wind and rain storms; and
5.That City staff has taken and continues to take appropriate action(s) to meet those
conditions; and

WHEREAS, the Director of Emergency Services issued a Declaration of Local Emergency
onJanuary 20, 2017, effective the same date, and City Council was not in session when such
declaration was issued; and
WHEREAS, the aforementioned Declaration of Local Emergency is set to expire on January
27, 2017 at 5:00 pm.
WHEREAS, the State of California also declared a state of emergency on January 23, 2017.
NOW, THEREFORE, based on the facts and circumstances set forth above, the City Council
of the City of Chula Vista hereby resolves as follows:
1.The Declaration of Local Emergency issued by the Director of Emergency Services is
hereby ratifiedand that the City Council also adopts the above findings made by the
Director of Emergency Services.
2.The aforementioned Declaration of Local Emergency is hereby extended and shall expire
on February 19, 2017 at 5:00 pm, unless otherwise lawfully extended, or terminated
earlier by the Director of Emergency Services.
3.That the Director of Emergency Services, or their designee, is directed and authorized to
seek and obtain any and all aid from local, county, state and federal authorities to assist in
recovery and address the impacts caused by the severe and prolonged wind and rain
storm, including any and all aid pursuant to the California Disaster Assistance Act
(“CDAA”).
