HomeMy WebLinkAboutcc min 1971/11/17 MINUTES OF AN ADJOURNED REGULAR MEETING OF THE CITY COUNCIL OF CHULA VISTA, CALIFORNIA Held Wednesday November 17, 1971 An adjourned regular meeting of the City Council of Chula Vista, California, was held on the above date beginning at 3 p.m. in the Council Chamber, Civic Center, 276 Fourth Ave- nue, with the following Councilmen present: Councilmen Scott, Hamilton, Hyde, Egdahl Absent: Councilman Hobel Also present: City Manager Thomson, Assistant City Manager Bourcier, Deputy City Attorney Blick, City Attorney Lindberg, Director of Planning Warren, Director of Parks ~ Recreation Jasinek PARK DEVELOPMENTS Director of Parks and Recreation Jasinek reported that develop- ment plans for Loma Verde and Palomar Parks have been completed. The plans have been presented to the Park-School committee and were unanimously approved. Mr. John Ortgiescn, Landscape Planner, presented sketches and slides of the proposed developments. Loma Verde Park The proposed park contains S.4+ acreas. This development will blend into the San Diego Gas g Electric right of way. The total development cost will be $16,S00. Palomar Park The total acreage is 5.1+ acres. The complete development of the park, excluding the wash rooms is estimated at $29,000. Presentation to Councilman Hyde suggested this same presentation be given to Commissions the various commissions and to the Tree Committee. He com- mented that perhaps a meeting time could be set up and all the commissions invited to attend. Plans accepted It was moved by Councilman Egdahl, seconded by Councilman Hyde, and carried that the plans be accepted. (Councilman Scott abstained from voting since he arrived late.) ACQUISITION AND IMPLE- Mayor Hamilton discussed the recent problems encountered by MENTATION OF SCHOOL SITES the school districts and developers in acquiring sites for IN NEW DEVELOP~NTS schools. He asked the help of the school districts for a Council policy which would expedite matters and not cause any due delay to the developer; a policy based on purpose, scope, definitions and procedures. Chula Vista Elementary Dr. Burton Tiffany, Superintendent, introduced Dr. Edward School District Kemler, Mitch Koteff and Susan Fuller of the Board of Trustees and Joseph Odenthal, Director of Business Services for the District. Sweetwater Union High Mr. Joseph Rindone, Superintendent, introduced Mrs. Bauer of School District the Board of Trustees and his staff, Dr. Burton Tiffany Dr. Tiffany stated that Council Resolution No. 6140 (Council policy relating to provision of public facilities concurrent with development) is working out quite well with the District. At the present time, the District is asking the developers for $100 per year per student for three years for temporary school facilities. Collection of fees Dr. Tiffany added that he talked to the City Attorney about the possibility of having the City collect these fees at the time the subdivider takes out his building permits. - 1 - Ordinance No. 1366 Dr. Tiffany discussed one section of Ordinance No. 1366 (Section 35.211 [4]) which states that the requirement of dedication shall automatically terminate unless the ~chool districts enter into a binding commitment within thirty days after the requirement is imposed by the Council. Dr. Tiffany indicated that this was not enough time for them to select the site, get their Board's approval, and obtain the numerous other channel approvements. Dr. Tiffany then discussed the number of homes needed to col- lect the fee - 401, as the ordinance is written. He declared that there was no way they could get to the developers building 20 homes or more. He asked that everyone be treated the same - whether it~ for 20, 200 or 2000 homes. Policy from other cities Councilman Scott asked if any attempt was made by the School District to get a similar policy from the cities of National City or the Board of Supervisors. Mr. Rindone, Superintendent, Sweetwater Union High School District, stated his District had not. He then explained that the $100 fee collected was only the excess cost to educate a pupil. It allowed the District for just the cost of renting a trailer for temporary classroom purposes. Mayor Hamilton's comments Mayor Hamilton asked Mr. Rindone if his Board would support the Council in going to the State Legislators and asking for a policy requiring the $100 per year per student for three years, and asking the other jurisdictions to support this policy. Mr. Rindone stated they would be happy to. He briefly dis- cussed the 30 day period as mentioned by Dr. Tiffany for the acquisition of the school site, and asked that this time per- iod be changed to 90 days. Mr. Rindone also suggested that the City collect the fees from the developers and turn it over to the school districts. Mrs. Gary Krueger Mrs. Krueger asked that the Council consider a comprehensive League of Women Voters school plan. This would include boundaries, site designation, population projections, etc. This could be turned into a planning tool to be used by the City Planning Department and would give the developers a long range look as to what their responsibilities are going to be regarding schools. City Attorney's comments City Attorney Lindberg declared that the City is interested in providing all necessary facilities to service people that are going to live within the new subdivisions, as approved by this Council. He discussed the State legislation and the policy as adopted by this Council regarding school sites, and he stated that the City does not have the authority to collect the money fer the schools; the schools must be willing to accept this burden, and they should go to the State to get all these school requirements. Mrs. Ann Pa)me Mrs. Payne felt that the criteria for acquisition of school League of Women Voters sites should be spelled out. This would then be available to the Planning staff and the subdividers which would eliminate much of the contention and controversy that has occurred in the past. Mr. Eugene York Mr. York maintained that the developer should not have to pay South Bay Improvement thi~ $100 a year for each student for three years and then Association be required to pay again in providing a school site. [te added that this condition be spelled out so that the developer would be aware of his responsibility. - 2 - Council policy Mayor Hamilton asked the two school districts to request, in writing, that a policy be adopted requiring $100 per year per pupil generated over a 3 year period. Mayor Hamilton commented that this would be in lieu of any- thing else--site reservation, otc. Motion modifying the It was moved by Councilman Scott, seconded by Councilman Hyde, Business & Professional and unanimously carried that the City and the school districts Code contact the Legislators to change the Business and Professional Code in regard to modifying the requirement of the 400 units and the 50-day waiting period. Motion modified Councilman Scott modified this motion to refer this to staff to come up with something more specific - to bring back a resolution with the appropriate number of units, days and procedures. Motion to notify other It was moved by Councilman Scott, seconded by Councilman Hyde, jurisdications and unanimously carried that the Chula Vista City School District, Sweetwater Union High School District, and the City of Chula Vista contact the City Council of Imperial Beach, National City and the County of San Diego, asking for adoption of a similar policy as that adopted by the City of Chula Vista, Resolution No. 6140. ADJOURNMENT Mayor Hamilton adjourned the meeting at 4:35 p.m. to the meeting scheduled for Tuesday, November 23, 1971, at S p.m.
