RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA APPROVING A THREE-PARTY
AGREEMENT BETWEEN THE CITY OF CHULA VISTA, RBF
CONSULTING, (CONSULTANT), AND MCMILLIN OTAY
RANCH, LLC, (APPLICANT), FOR MITIGATION
MONITORING AND ENVIRONMENTAL SERVICES TO BE
RENDERED FOR THE VILLAGE SIX SECTIONAL
PLANNING AREA PLAN, AND AUTHORIZING THE MAYOR
TO EXECUTE SAID AGREEMENT
WHEREAS, on January 22, 2002, the City Council certified Environmental Impact
Report (EIR) 98-01 and adopted the accompanying Mitigation Monitoring and Reporting
Program (MMRP); and
WHEREAS, the implementation of the MMRP necessitates the expertise of an
Environmental Monitor Specialist and requires the hiring of a consultant; and
WHEREAS, it was determined by the Director of Planning and Building that staff has
neither the available time or expertise to perform the subject work; and
WHEREAS, the Applicant has deposited or will deposit funds necessary for the
mitigation monitoring services; and
WHEREAS, the City solicited request for proposals from three qualified consulting finns
in accordance with the City's informal bidding process, and three proposals were received by the
City that were responsive to the request; and
WHEREAS, the City is in immediate need of an experienced Environmental Consultant
that is familiar with the City's policies and procedures and the Califomia Environmental Quality
Act; and
WHEREAS, the Consultant is uniquely qualified to serve as the consultant for this
project based on their projects of a similar nature, their experience with the resource agencies,
their grasp of the project's complexities, and the firm's project experience within this region; and
WHEREAS, the Environmental Review Coordinator has negotiated the details of this
agreement in accordance with procedures set forth in Section 6.5.2 of the Environmental Review
Procedures.
WHEREAS, Applicant has proposed that the high school and church site (Parcel Map
18481, Parcel 5 of Village Six) be monitored at the applicant's expense only through completion
of the rough grading plans (as shown on drawing numbers 01039-01) and improvements of
adjacent streets [as shown on improvement plan numbers 02031(Magdalena Avenue Phase 1),
02032 (Magdalena Avenue Phase 2), and 02035 (Birch Road)].
WHEREAS, the proposed contract with RBF to provide mitigation monitoring services
would be in an amount not to exceed $43,190.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula
Vista does hereby approve the three-party agreement between the City of Chula Vista, RBF
Consulting, and McMillin Otay Ranch, LLC ("Applicant") to conduct mitigation monitoring for
the Village Six Sectional Planning Area Plan.
BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista is hereby
authorized and directed to execute said agreement for and on behalf of the City of Chula Vista.
