HomeMy WebLinkAboutOrd 2016-3378 o�m�aricE �.To. »�s ORDII�'ANCE OF THE CITY OF CHULA VISTA APPROVII�'G A PRECISE PLAI�' (MPA 1�-0021) TO ALL0�1' A HEIGHT OF 120 FEET TO ACCOMMODATE A PROPOSED HOSPIT.AL TOV�'ER TO BE LOCATED AT THE NORTHERI�' EDGE OF THE HOSPITAL CAMPUS LOCATED AT 7�1 �4EDICAL CENTER COURT WHEREAS; the area of land that is subject to this Ordinance is diagrammatically represented in Exhibit "A" attached to this Ordinance and incorporated herein, and commonl�� kno���n as Sharp Chula Vista Hospital campus: and consists of a site located at 7�1 Medical Center Court (Project Site); and WHEREAS. a duly verified application was filed ��th the Cin�of Chula Vista De��elopment Sen�ices DeparUnent on November 30, 201�, bv Sharp Chula Vista Medical Center (SCMC) (Applicant) requesting approval of a Precise Plan in order to ailo�v for the makimum building hei2ht to be increased from 4� feet to 120 feet: and R'HEREAS, the Applicant has complied H�th the requirements of Chula Vista Municipal Code (CVMC) Section 19.�6.042 (Required Maps and Information) by pro��iding an application submittal package that includes detailed site plans and elevations; and VJHEREAS; the project consists of developing a se��en story hospital tower that ti�ll accommodate li8 beds, 6 operatin2 rooms, and other ancillary uses including a roofrop cafe (Project); and WHEREAS; the Citv Clerk set the time and place for the hearine on the Project application and notices of the hearino, together H�ith its purpose, w�as ei��en b�� its publication in a ne��spaper of general circulation in the cit��, and its mailing to propertv owners within 500 feet of the exterior boundaries of the Project at least ten (]0) days prior to the hearing; and WHEREAS, the dulv called and noticed public hearing on the Project was held before the Cih� Council on October 4. 2016. in the Council Chambers in Cit�� Hall. Cit�� of Chula Vista Civic Center, 276 Fourth A��enue, at �:00 p.m. to hear public testimonv ti�ith regazd to the same: and VdHEREAS, the Development Services Director has re��iewed the proposed Project for compliance with the California Environmental Qualit�� Act (CEQA) and has determined that there is substantial evidence, in lieht of the whole record before the City Council, that the Projec[ manv have a significant effect on the em�ironment therefore, the De��elopment Sen�ices Director initiated the preparation of an Em�ironmental Impact Report (EIRI�-0002), ���hich Citv Council certified at this subject meeting. NOVd. THEREFORE, the Cit�� Council of the Cit�� of Chula Vista does hereb�� find. determine. and ordain as follo���s: Ordinance No. 3378 Page No. 2 Section 1 A. PRECISE PLAN FINDINGS The City Council hereby finds that: SUCH PLAN WILL NOT, UNDER THE CIRCUMSTANCES OF THE PARTICULAR CASE, BE DETRIMENTAL TO THE HEALTH, SAFETY OR GENERAL WELFARE OF PERSONS RESIDING OR WORKING IN THE VICINITY, OR INJURIOUS TO PROPERTY OR IMPROVEMENTS IN THE VICINITY The Precise Plan being requested is limited to allowing a deviation from existing development standards for building height within the existing hospital campus. The hospital campus has been in development for approximately 35 years and contains two existing towers of approximately 68 feet in height and a pazking structure of approximately 96 feet in height (as measured to the top of the elevator tower). The new hospital tower will be located adjacent to or near existing hospital facilities, well within the campus boundaries. The hospital tower is located approximately 22> feet from the nearest residential property ]ocated to the northeast of the Project Site. Building design is consistent with City Design Guidelines. While additiona] traffic will be generated as a result of the hospital tower, mitigation measures have been required which, when implemented, will result in a less than significant impact. The proposed height increase is to allow development consistent with hospital uses. As discussed above, the existing hospita] tower on the site is approximately 68 feet in height and the existing parking structure is approximately 96 feet in height to the top of the elevator tower. The Project will contribute ro the well-being and general welfare of the Chula Vista residents by allowing the existing hospital facility to expand to meet the needs of the growing Chula Vista and South Bay community, and as such, will not be detrimental to the health, safety or general welfare of persons residing or working in the vicinity of the Project, nor injurious to property or improvements in the vicinity of the Project. THAT SUCH PLAN SATISFIES THE PRINCIPLE FOR THE APPLICATION OF THE P MODIFYING DISTRICT AS SET FORTH IN CVMC 19.56.041 The Precise Plan (P) Modifying District was atfached to the C-0 zoning at the time the subject property ti�as rezoned from R-1-H to GO-P in .lanuary 1990. The site has been developed as a hospital campus since approximately 1970. The hospital site had received prior approval for two hospital towers, the latest one being in 1989, with a heisht of approximately 68 feet; prior to the efPective date of this rezone. Given the existing hospital use; the P modifier ���as added to this new zonin� desionation in anticipation of the need to pro��ide future flexibility in the implementation of the Ordinance No. 3378 Paee No. 3 underh�ine development standards of the GO zone, especially the abilit}� to pro��ide for strucmres that exceeded the underlvina ��-foot heieht limit. The Precise Plan H�ill allow for flexibiliri in buildine height that ���ill enable the site to be developed consistent Nith the needs of a state of the art medical facilit�� in accordance H�ith CVMC 19.i6.041(A). THAT ANY EXCEPTIONS GRANTED �'HICH DE�'IATE FROA4 THE UI�'DERLYII�'G ZONII�'G REQUIREMEI�tTS SHALL BE WARRAI�'TED OI�'LY R�HEN I�'ECESSARY TO MEET THE PURPOSE AI`'D APPLICATION OF THE P PRECISE PLAN MODIFYII`'G DISTRICT Exceptions to the underhina zoning requirements aze ���arranted due to the fact that the site contains an existing hospital campus. Such use is unique N�thin the C-O zone in that hospitals usualh� contain buildin2s/to��ers that are over 4� feet in height. The inability for future de��elopment to exceed the current heieht limit of 4�-feet �aould preclude the abilit�� to provide necessarv espansions that meet the needs of the surroundins communitv. THAT APPROVAL OF THIS PLAN W'ILL CONFORM TO THE GENERAL PLAN AND THE ADOPTED POL[CES OF THE CITY Approval of a Precise Plan is consistent �i�ith the Public/Quasi-Public desienation of the General Plan for the property and General Plan Objective PFS 19 to provide art and culture proerams, childcare facilities and health and human sen-ices that enhance the quality of life in the City of Chula Vista. A hei�ht exceeding the current heieht restriction of 4� feet under the C-O (Administrative and Professional Office) zone, has been established b}� the t���o existine hospital to���ers and a parking structure on the campus and H�ill allow�the site to be developed consistent with the needs of a state of the art medical facilirv. NO��'. THEREFORE. BE IT FURT[-IER ORDAII�TED. that the Cirv Council of the Cim of Chula Vista does hereb�� adopt the subject Precise Plan, as follo���s � B. ADOPTION OF PRECISE PLAN In light of the findings above, the Precise Plan is adopted to increase the e�isting buildine heieht limit of 4� feet to 120 feet for the hospital to��er diagrammaticallv represented in Ezhibit "A" and described in Exhibit "B", said Eshibits attached hereto and incorporated herein b�� [his reference, and on file in the Office of the Cit}� Clerk. Section ILSeverabilih� If any portion of this Ordinance. or its application to anv person or circumstance, is for an�� reason held to be in�alid; unenforceable or unconstitutional. b�� a court of competent jurisdiction. that portion shall be deemed severable. and such im�alidit�, unenforceabilit�- or unconstitutionalit�� shall not affect the ��alidit�� or enforceabilit� of the remainine Ordinance No. 3378 Page No. 4 portions of the Ordinance; or its application to any other person or circumstance. The City Council of the City of Chula Vista hereby declares that it would have adopted each section, sentence_ clause or phrase of this Ordinance, irrespective of the fact that any one or more other sections, sentences, clauses or phrases of the Ordina�ce be declazed invalid, unenforceable or unconstitutional. Section III. Construction The City Council of the City of Chula Vista intends this Ordinance to supplement; not to duplicate or contradict, applicable state and federal law and this Ordinance shall be construed in light of that intent. Section N. Effective Date This Ordinance shall take effect and be in force on the thirtieth day after its final passage. Section V. Publication The City Clerk shall certify to the passage and adoption of this Ordinance and shall cause the same to be published or posted according to law.
