OF THE CITY OF CHULA VISTA, CALIFORNIA
Held Wednesday - 3:00 p.m. July 19, 1972
An adjourned regular meeting of the City Council was held on the above
date beginning at 3:00 p.m. in the Council Chamber, Civic Center, 276
Fourth Avenue, with the following Councilmen present:
Councilmen Scott, Hobel, Hamilton, Egdahl, Hyde
Absent: None
Also present: Acting City Manager Bourcier, City Attorney Lindberg,
Director of Public Works Cole, Director of Planning
Warren, Assistant Director of Planning Williams
EL RANCHO DEL REY Director of Planning Warren stated that
the conference was requested by Mr.
Gersten. The meeting'was turned over to
Mr. Gersten's representatives.
Mr. Paul Peterson, Attorney Mr. Peterson stated he is representing
E1 Rancho del Rey and referred to his
letter of July 14, 1972, to the Council.
He stated they requested the conference
due to the proposed revisions of the
planned community and general develop-
ment plan of E1 Rancho del Rey. The
revisions proposed may render the E1
Rancho del Rey project economically
unfeasible.
He stated when this project was origi-
nally planned, it was for a density of
approximately four units per acre.
Mr. Peterson commented that park, open
space, in lieu fees and school fees
and the increased construction costs
are related to the economic feasibility
of the project. Grading, traffic and
sewers are related ~o the density.
Parks, Open Space, Mr. Peterson stated they are committed
In lieu fees to dedicating approximately 11 acre~ of
land for park purposes, which is approx-
imately 2-1/2 acres in excess of that
required by the City's Park Ordinance.
They are objecting to improving the land
as well as dedicating it.
There was a general discussion on the
land proposed for park dedication and
that some of this land was actually
out-parcels adjacent to E1 Rancho del
Rey.
In regard to the additional 2 acres of
land to be dedicated, Director of
Planning Warren indicated that some of
the land is in compensation for the
abundance of 5,000-square-foot lots not
on a full 2,000-square-foot basis.
There are approximately 500 feet per lot
credited for that change. This is in
the resolution and was accepted by the
applicant.
There was further discussion on the
in lieu fees required of Shattuck
Construction Company and the dedica-
tion and improvement of park land
required of the E1 Rancho del Rey
project.
Ron Calhoun Mr. Calhoun questioned why they are
Wilsey & Ham being required to put the improvements
in as well as dedicating the land for
parks. Mr. Peterson stated it was
their intent to process an amendment
on this matter.
Open Space Mr. Peterson referred to the slopes
in Unit Nos. 1, 2 and 3, which are
adjacent to the streets. He would
like to see the District (Open Space
Maintenance District) go into effect
so that it can acquire and improve
the slopes. Mayor Hamilton directed
Mr. Peterson to City Attorney Lindberg
for the details of forming a District.
Grading Mr. Peterson spoke on the standard
approach to grading as being one which
relates to grading in terms of soil
content and degree of slope. His
concern in this matter is that the
City is considering a possible change
to a measure of density instead of
degree of slope. He stated that it
would not be economically feasible
for E1 Rancho del Rey to develop with
only two units per acre.
Ron Calhoun Mr. Calhoun commented on the difficulty
of creating a grading ordinance and
listed safety, appearance and main-
tenance as important factors to be
taken into consideration to meet the
interests of the City and the reel-
dents of the area. He added that slope
density grading does not take into
account modern technology and unity in
community planning.
Bruce Warren Mr. Warren indicated there are two
Director of Planning things that must be resolved: (1)
whether the Council Wants the staff
to proceed with the recommendations
on the revised plan for E1 Rancho del
Rey based on the proposed Hillside
Development Ordinance or variation of
it; and (2) does the Council want the
staff to proceed with its planning
using the traffic projection prepared by
the County Engineers or those offered by
Wilsey and Ham.
Norm Williams Mr. Willaims started the Planning De-
Assistant Director of Planning partment's presentation on the proposed
Hillside Development Ordinance by
stating there are two ways to regulate
hillside development:
(1) set specific regulations which
would reduce the density and grading
operations permitted as a function of
the natural slope; and

(2) set design criteria guidelines
which would assist a developer in
complying with the regulations and
in creating high quality hillside
developments, which not only respect
and conserve the natural terrain, but
are also safe and functional.
Mr. Williams listed the regulations
on density, grading, "Density Trans-
fer,'' open space, "Hillside Develop-
ment Performance Standards," and the
requirement of developers to consult
with the staff for clarification of
this ordinance for their particular
development, as listed in the proposal.
Mr. Warren indicated that because of
the type of topography, the area will
not accommodate a grid pattern of
streets and the streets that are
feasible will not carry a significantly
greater density than that proposed in
this ordinance.
Mr. Peterson stated they are not in a
position to comment on this proposal
since it was just presented; however,
he stated the results of this ordinance
have an "overwhelming impact, .... cutting
the proposed units from 13,000 to 7,000.
Traffic Mr. Peterson stated that when the pro-
ject was planned their studies showed
that the traffic produced by the pro-
ject would be amply carried by the
streets proposed.
Jim Hutchison Mr. Hutchison stated that their
Wilsey & Ham analysis of the County's study is that
%he effect of %he entire Chula Vista
area in 1990 will be for an overall
need of several freeways cutting
through in all directions.
Mr. Warren stated that the two groups'
studies on traffic were don~ using
different generation figures. Mr.
Williams discussed the County's report
on traffic and how they got their
fiqures. Mr. Williams stated that at
this time, it would appear that develop-
ment can only be for 2-3 units per acre
to adequately handle traffic in this
area. Mr. Warren discussed the figures
used by the different groups in regard
to the number of trips from each
household per day.
In answer to Councilman Egdahl's in-
quiry, Director of Public Works Cole
stated a six lane divided road with
controlled access will carry on an
average 47,000 cars a day.
Public transporation There was a discussion on the modal
split--forms of public transportation
of the future--and how this will effect
the street traffic pattern.

Councilman Hobel commented on the
County's study for rapid transpor-
tation~ which does not include any
transportation going eastwardly in
the Chula Vista area. The County's
proposed rapid transit comes straight
down the South Bay corridor and the
only way to get public transportation
to the east City area would be to pull
satelite buses or something similar.
Mrs. Katherine Moore Mrs. Moore commented that all the
1134 Tobias Drive traffic studies taken thus far have
fallen short of the actual amount of
traffic.
Motion for staff to continue Councilman Hyde made the motion that
· with Hillside Development with regard to the memo from the staff,
Ordinance and applying it to the Council affirm that it wants the
E1 Rancho del Rey staff to proceed with the Hillside
Development Ordinance and that it shall
be applicable to the plans of E1 Rancho
del Rey.
Motion dies The motion died for lack of a second.
Mr. Peterson stated they will be
developing further information re-
garding the traffic problem and will
feed this information back to the City
staff in order to reach areas of
understanding.
With regard to the Hillside Development
Ordinance, Mr. Peterson stated they
are anxious to have this matter developed
as soon as possible and they will work
with the staff in any way they ean.
Sewers Mr. Peterson commented that the
capacity of the land that drains into
Telegraph Canyon is of importance as
this capacity affects the density of
the E1 Rancho del Rey project. He
indicated there are some technical
problems in this area and that they
will be working with the staff to
resolve these.
Schools Mr. Peterson stated this matter is
one of economic impact. The new
requirements from Sweetwater Union
High School District is $300 per unit
and for the Elementary Schools it is
$240 per unit. This $540 per unit
in addition to park land dedication
and overall construction costs and
the possible reduction of units is
an economic matter of great concern
to the E1 Rancho del Rey project.
Councilman Scott's comments Councilman Scott indicated some con-
cern as to whether the City can
actually afford a single family develop-
ment such as this because of the cost
of schools and services.
Recess A recess was called at 5:12 p.m., and
the meeting reconvened at 5:24 p.m.
Mr. Peterson stated he feels that
E1 Rancho del Rey will help to
solve some Of the problems that
Councilman Scott referred to by means
of a shopping center and possibly by
light industry.
Conference to be set Mayor Hamilton directed the staff to
set a conference to make a further
presentation on the Hillside Develop-
ment Ordinance.
ADJOURNMENT Mayor Hamilton adjourned the meeting
at 5:42 p.m. to the meeting at 7:00 p.m.
on August 19, 1972.
