HomeMy WebLinkAboutcc min 1972/07/31 MINUTES OF A REGULAR ADJOURNED MEETING OF THE CITY COUNCIL OF THE CITY OF C}~LA VISTA~ CALIFORNIA Held Monday - 3:00 p.m. July 31, 1972 A regular adjourned meeting of the City Council of Chula Vista, California, was held on the above date beginning at 3 p,m. in the Council Chamber, 276 Fourth Avenue, Chula Vista, with the following Councilmen present: Councilmen Hyde, Hamilton, Egdahl Absent: Councilmen Scott, Hobel Also present: City Manager Thomson, Deputy City Attorney Blick, Director of Planning Warren, Assistant Director of Planning Williams, Associate Planner Lee. HILLSIDE DEVELOPMENT Director of Planning introduced the prelimin- STANDARDS ORDINANCE ary draft of the Ordinance stating it was not a recommendation of the Planning Department or the City; it is a document illustrating the techniques for regulating hillside de- velopment, and the staff expects this to be used for discussion purposes. Mr. Warren added that, based on this meeting, he would hope to obtain some guidelines from the Council which would enable the staff to pre- pare a second draft. SLIDE PRESENTATION Mr. Lu Quinney, Assistant Planner, showed a slide presentation of hillside areas in the eastern section of the City. He noted the percentage of the slope of the various areas. Pictures were also shown of the grading which was done or in progress es- pecially in the E1 Rancho del Rey subdivi- sion, and pictures were also shown of those areas that have some form of landscaping on the banks. EXPLANATION OF SLOPES AND DENSITIES Mr. Norman Williams, Assistant Director of Planning, discussed the slopes and the densities which would be allowed if the staff recontmendations are approved: Average Maximum Gross Natural Density Slope (D.U.'s per acre) 0-10% 6.0 10-15% 4.0 15-20% 2.0 20-30% 1.0 30% + 0.5 Mr. Williams commented on the amount of grading which would be permitted, which would be determined by: Average Percent of Area Natural which may Slope be graded 0-10% 66% 10-15% 66% 15-20% 50% 20-30% 33% 30% + 0% Mr. Williams remarked that development should be based on the way the land lays now, instead of "remanufacturing" the land for the con- venience of the developer. COUNTY TRAFFIC STUDY Mr. Williams discussed the County Traffic Study remarking that is substantiates the fact that a great deal more density cannot be sustained than what is out ~here now (El Rancho del Rey). Of prime considera- tion is the number of roads that can actu- ally be constructed in the area to carry the traffic which affects the density. Mr. Williams commented that they should go a step further and determine where this density should be placed. A brief review was made of the soils anal- ysis report which was done by CPO. PURPOSE OF ORDINANCE Director of Planning Warren indicated that the proposed ordinance was in his words, an "ideal" to preserve the natural topography, and the canyons that go through these areas. He questioned what becomes of this open space - is it maintained by a Homeowner's Association, a District, is it purchased by the City? If it is preserved, what does it do to the neighborhood park concept? SHOPPING CENTER - Mr. Warren noted the letter received from EL RANCHO DEL REY Mr. Paul A. Peterson, Attorney for the de- velopers of E1 Rancho del Rey, in which he discussed the need for a regional shopping center. They maintain the present location consists of a "hole" that will require four million cubic feet of controlled engineered fill (H Street and 1-805 site). They claim that the source of this fill must come from adjacent hills. Mr. Williams claimed it would be possible to take the excess dirt from the development of the residential areas and begin to fill in the shopping center site. In answer to Mayor Hamilton's query, Mr. Williams confirmed the fact that contoured grading adds a great deal to the natural topography of the area. MAXIMUM HEIGHTS Councilman Egdahl askeR if any provision was put into the proposed ordinance for the maxi- mum height of contoured slopes. Mr. Williams indicated that this provision could be put into the grading ordinance. COUNCILMAN EGDAHL'S CO~[4ENTS Councilman Egdahl stated he was in favor of the concept of the ordinance. He cautioned, however, that it would take a great deal of staff time - both engineering and planning - to incorporate the provisions of the ordin- ance. There is also the cost factor to the City which needs to be considered. Council- man Egdahl noted the types of the mes that some of the slopes behind homes have been put to - motorcycles, trash, noise problems. He would like to see something more specific in this ordinance as to how these problems will be dealt with. TIMING OF PROPOSED ORDINANCE Director of Planning Warren indicated that it would take approximately six months before the or- dinance would be ready for a public hearing. The staff must first meet with the developers, interested parties, the Enviror~r~ntal C~ontrol {bmmission and other commission~ before the final drafte is submitted. Recess A recess was called at 4:17 p.m. and the meet- ing reconvened at 4:29 p.m. Carmen Pasquale Mr. Pasquale remarked that he is not prepared Otay Land Company to make any elaborate discussion on the pro- E1 Rancho del Rey posed ordinance. He stated that a lot of work has to be done on this ordinance - the staff should meet and get input from the various groups affected. The economics should be kept in mind - how are the open space lands going to be main- tained? Mr. Pasquale referred to an earlier discussion concerning the Shattuck Develop- ment whereby 13 acres of land is being proposed for park purposes on land that will be de- veloped with 160 units. Mr. Pasquale felt this size park should be for the entire cit- zenry of the City and not merely those 160 units, since it would be too costly to main- tain. Mr. Pasquale felt there should be a grading plan ', and that his land could be improved -- contour grading could be done. He felt six months was probably reasonable for the staff to meet with the various groups concerning the proposed ordinance, because it needs a "good hard look." EL RANCHO DEL REY Mr. Warren commented that the staff is in UNIT NO. 3 the process of having to make recommendations on Unit No. 3. They feel, at this time, that there will be too much grading, perhaps improper grading. The Council has given its approval to the planned unit development as proposed, and some development will con- tinue on that property. MASS TRANSIT City Manager Thomson referred to the County Traffic Study which made no provision for mass transit in terms of impact and calcula- tions. Mr. Thomson felt the staff should keep this in mind, as it will be very realistic. Jim Hutchison Mr. Hutchison commented on the traffic study Wilsey & Ham being made by the County: a calibration study used to assess the validity of generations and zones. In checking with the Director of Public Works, Mr. Hutchison found out that the City is doing some studies on the peak hour basis to satisfy themselves that the generation factors submitted by E1 Rancho del Rey would be the proper ones to use. REFERRED TO STAFF Mayor Hamilton reiterated that the Council would like to see the staff proceed with this ordinance, and that the City Manager work with the staff to see how this will affect the City financially. MOTION FOR STAFF DIRECTION It was moved by Councilman Hyde and seconded by Councilman Egdahl that the staff be in- structed to proceed, at the best possible speed, with the hillside development ordinance. Discussion of motion Councilman Hyde felt the ordinance would have to be tempered to the realities of the economic situation. The ordinance should include com- mercial and other land uses, not just the re- sidential. It should not preclude the idea that the economic impact of it will be reduced by alleviating the densities recommended. ~ 3 - Ma7~r Hamilton commented that the staff will be meeting with the various affected groups, and as a result, the staff will be coming back with a different proposal than that ~hmitted at this meeting. The Mayor declared that he believes reasonable natural terrains should be maintained. There may be certain areas in the City where the staff feels ~he terrain should not be disturbed at all, a~d a provision should be made for that ty~e~ situation. CoUncilman Hyde asked the staff to evaluate th~ c~unterproposals that will be made by El~R~cho del Rey, and present standards that will ~e acceptable to the City. Motion carries The motion for the staff to proceed with the proposed hillside development ordinance carried unanimously. ADJOURNMENT Mayor Hamilton adjourned the meeting at 4:52 p.m. to the meeting scheduled for Tuesday, August 1, 1972 at 7 p.m. - 4 -
